The City Council of the City of Stephenville, Texas, convened on May 27, 2014, at 5:30 p.m., in the Council Chambers at Stephenville City Hall, 298 West Washington Street, forthe purpose of a Special Council Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: Mayor Jerry K. Weldon II Council members Casey Hogan Boyd Waggoner Doug Svien Russ McDanel Brady Pendleton Alan Nix Sherry Zachery Jerry Warren Others Attending Mark A. Kaiser, City Administrator Randy Thomas, City Attorney Cindy L. Stafford, City Secretary Call to Order. The meeting of the Stephenville City Council was called to order at 5:30 p.m. on Tuesday, May 27, 2014, by Mayor Weldon. 11. Consider Adopting Ordinance No. 2014-15 Declaring all of McKewn Street located adjacent to Blocks 55 and 56, College View Addition, Stephenville, Texas, to have been abandoned as a street City Administrator Kaiser presented the staff report providing background information to this matter. He reported that the Planning and Zoning Commission recommends vacating and abandoning the above -referenced street right of way. The site location is McKewn Street between the 800 block of North Lillian and Garfield Avenue. Tarleton State University is acquiring the College Point II apartments and plans to demolish the apartments, plat the property with adjoining property to the south, and build student housing. The city has coordinated with Tarleton over the years to achieve their long-term master plans. The city has abandoned a previous section of McKewn Street to the west to allow for one of their housing projects in 2000. Previous actions by the city have not had the same kind of time sensitivity. The scheduled closing of Tarleton's transaction is mid-June which allowed for this matter to be on the June 3r° council meeting. However, TSU and Texas A&M University (TAMU) have requested immediate action to meet their transaction deadlines. The executed deed needs to be in escrow for the pricing to occur on the bond sale which is scheduled at 10am on June 3. Therefore, council will consider this matter at this special council meeting. Special Council Meeting May 27, 2013 Stephenville City Council Kaiser further explained that a request was made by Timothy V. Coffey, Managing Counsel, Property and Construction, Office of General Counsel with Texas A&M University, in which he explained that the closing to acquire McKewn Street and to purchase the two apartment complexes would have to be simultaneous because the purchases are financed with bonds. Coffey stated that Tarleton/TAMU cannot close the bond transaction without the deed. Ty Minkler, Vice President for Finance and Administration at Tarleton State University, stated that this is a "complex project", and he had not anticipated any problems with this transaction based on prior similar dealings with the city. Minkler explained that Tarleton is behind approximately 2,000 beds, and needs to move expediently to remedythe situation. He said that this is a $40 million project and hopes council will approve the request. In reply to questions, Kaiser stated that the value of the 8,000 square foot street is approximately $4-5,000 based on a value of $0.50 per square foot. TAMU requires two appraisals on land transactions, which appraisals could cost between $4,000 and $10,000 in this instance. MOTION by Alan Nix, second by Doug Svien, to approve Ordinance No. 2014-15 as amended. MOTION CARRIED by the following roll call vote: Ayes: Council members Waggoner, Svien, Pendleton, Nix, Zachery, Warren, Noes: Council member McDanel. Abstentions: Council member Hogan, having filed a conflict of interest affidavit. III. Consider Adopting Ordinance No. 2014-16 Declaring that Sewer line situated under Garfield Street from McKewn Street to Frey Street to have been abandoned as an easement MOTION by Brady Pendleton, second by Alan Nix, to adopt Ordinance No. 2014-16. MOTION CARRIED by unanimous vote. IV. Adjourn MOTION by Casey Hogan, second by Russ McDanel, to adjourn the meeting. MOTION CARRIED, and the meeting was adjourned at 6:25 p.m. �- Jerr. K.vodon II, Mayor ATTEST: Special Council Meeting May 27, 2013 Stephenville City Council ORDINANCE NO. 2014-15 AN ORDINANCE DECLARING ALL OF McKEWN STREET, LOCATED ADJACENT TO BLOCKS 55 AND 56, COLLEGE VIEW ADDITION TO THE CITY OF STEPHENVILLE, TEXAS, TO HAVE BEEN ABANDONED AS A STREET, ORDERING THE SAME VACATED, ENCLOSED, AND AUTHORIZING THE CONVEYANCE OF SAME TO BOARD OF REGENTS OF THE TEXAS A&M UNIVERSITY SYSTEM AND WAIVING THE "POLICY FOR THE SALE OF RIGHTS OF WAY" OF THE CITY OF STEPHENVILLE, TEXAS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: All of McKewn Street, located adjacent to Blocks 55 and 56, College View Addition to the City of Stephenville, Texas, a forty foot right of way. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEPHENVILLE, TEXAS: That portion of street right of way hereinabove described is hereby found by the City of Stephenville, Erath County, Texas, to be vacated and closed for street purposes. It is hereby ordered and directed that Jerry K. Weldon II, Mayor of the City of Stephenville, Texas, execute a special warranty deed to Board of Regents of the Texas A&M University System for the use and benefit of Tarleton State University, the said university owning Blocks 55 and 56, College View Addition, adjacent to said street. It is further ordered and directed that the "Policy for the Sale of Rights of Way" is hereby waived. PASSED AND APPROVED this the 27th day of May, 2014. �• vv. Jerry . Kaiser City Administrator Randy Thomas, City Attorney Approved as to form and legality ORDINANCE NO. 2014-16 AN ORDINANCE DECLARING THAT SEWER LINE EASEMENT WHICH IS SITUATED UNDER GARFIELD STREET FROM MCKEWN STREET TO FREY STREET TO HAVE BEEN ABANDONED AS AN EASEMENT AND ORDERING THE SAME VACATED AND RELEASED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: Section One That certain sewer line easement situated under Garfield Street from the near the northwestern line of McKewn Street to the southern line of West Frey Street, according to the King's 1956 Map of Stephenville, Erath County, Texas, adoption thereof recorded in Volume 381, page 105, Erath County, Texas, is hereby declared to have been abandoned for easement purposes and is hereby declared vacated and abandoned for easement purposes. Section Two It is hereby ordered and directed that the Mayor of the City of Stephenville, Texas, execute any and all documents necessary to facilitate the vacating and releasing of the easement on the above-described property.
