The City Council met in called meeting on this date with Mayor Cook presiding and the following councilmen present: Hubert Darby, Mrs. Fred McCleskey, E. Lee Orbison, Roy Swain, Bill Christian, W. H. Stem and Mrs. Doyle white, The council discussed the deeding to James YounP a portion of West Swan Street. It was moved. by Councilman Swain, and seconded. by Councilwoman white, to ad.opt an ordinance declaring that portion of ?nest Swan Street lying southwesterly of the West line of U. S. Highways 67 & 377, or Loop 179, in the City of Stephenville, to have been abandoned. as a street, ordering some vacated and. closed and. authorizing the Mayor to execute a Quit Claim Deed. to that portion of the street so vacated and. closed. to James T. Young. Motion carried. (City Seal) �/ ' City Secretary �u 1 �, ORDINANCE DECLARING PLACES OF AMUSEMENT IN THE CITY OF STEPHENVILLE IN WHICH DRUNKENNESS, PROFANITY, DISORDERLY CONDUCT, BOISTEROUS LANGUAGE II ANY TYPES OF IMMORAL CONDUCT OR UNLAWFUL ACTS ARE CARRIED ON SHALL CONSTITUE NUISANCES; MAKING SAME AN OFFENSE, PROVIDING PENALTY AND DECLARING AN EMERG14 CY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One' Domino halls, pool halls, billiard halls, bowling alleys, theaters or any other places of amusement open to the public in which drunkenness, profanity, disorderly conduct, boisterous language, any type of nmoral conduct or unlawful acts are carried on shall constitute a nuisance and are lereby declared to be nuisances. Section Two Any person permitting any of the acts above ment exist upon ioned to any place or premises under his control within the City of Stephenville or vithin a distance of 5,000 feet from the city limits of the City" .1 Stephen - ville shall be deemed guilty of a misdemeanor and upon convictioiathereof shall be fined in any sum not exceeding $200.00; and each day thaGany nuisance as hereinabove defined may continue after notice from the City of Stephen- ville to discontinue same shall constitute a separate offense. Section Three The acts hereinabove defined as constituting nuisancesR "are hereby prohibited within the City of Stephenville and also out the city limits of the City of Stephenville for a distance of 5,000 feet from the city limits of Stephenville and in addition to the action hereinabove provided the City may proceed in the district court having jurisdiction to close any such places of amusement in which such nuisances are being carried on by suit for injunction under the laws of the State of Texas. Section pour In the event any section, clause, sentence or paragraph 'or any Portion of this ordinance shall for any reason be adjudged by any -court of competent jurisdiction to be invalid such invalidity shall not affect, impair or invalidate the remainder of this ordinance. Section o -- n— Five The welfare of the citizens of Stephenville requires that this ordinance go into effect immediately from and after its passage and publica- tion as provided by law, and any provision of the ordinances of the City of Stephenville or of the law providing otherwise are hereby suspended. Notary Public, Erath County, Texas ORDINANCE DECLARING THAT PORTION OF WEST SWAN STREET LYING SOUTHWESTERLY OF THE WEST LINE OF U. S. HIGHWAYS 67 AND 377 OR LOOP 179, IN THE CITY OF STEPHENVILLE, TO HAVE BEEN ABANDONED AS A STREET, ORDERING SAME VACATED AND CLOSED AND AUTHORIZING MAYOR TO EXECUTE A QUIT CLAIM DEED TO THAT PORTION OF THE STREET SO VACATED AND CLOSED TO JAMES Tr YOUNG BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One The West part of West Swan Street in the City of Stephenville as said street is shown by the plat of the Greenview Addition in said City of record in Volume 328 at page 103 in the Deed Records of Erath County, Texas, and being all of said street that lies Southwesterly of the West line of U. S. Highways 67 and 377, or Loop 179, which crosses said Swan Street, the East line of this portion of said street so abandoned and vacated to be parallel to and 60 feet Southwesterly from the centerline of said highway and the West' line of this tract or abandoned portion of the street to be the West line of the former 0. T. Young 4.6 -acre tract out of which said Greenview Addition was created, is hereby declared to have been abandoned for street purposes and said portion of West Swan Street is hereby ordered vacated and closed as a street, but there is reserved to City water and sewer easements in said land. Section Two W. E. Cook, Mayor of the City of Stephenville, is hereby authorized and directed to execute to James T. Young for the sum of $10.00 paid to the City of Stephenville, a Quit Claim Deed covering that portion of West Swan Street hereinabove described, which Quit Claim Deed shall convey the right, title and interest of the City of Stephenville to said James T. Young, and which deed shall be attested by the City Secretary of the City of Stephenville and the seal of the City affixed thereto by said Secretary, and wh ich ich shal 1 reserve said easeme nts abov e mentioned.
