Texas ,The City Council met in regular meeting on the above date with Mayor Evans presiding and the following councilmen present: I. D. Reynolds, Hubert Darby , Mark Geeslin, E. Lee Orbison, Raymond Anderson, Roy Swain, Harlan Huey and W. H. Stem. Others present were Dir. of Pub. Wks. Gann, Chief Cornell and City Atty. Chandler. Minutes of previous meetings were read and approved. Councilman Geeslin reported some of the property owners have given per- mission for the survey crew to work on their land. There are some who have refused to allow the survey crew to work on their property. This committee asked the Council to take the necessary action so the survey crew can complete their work. The Mayor appointed councilmen Orbison and Swain to serve with other committee members to help secure the necessary right -of -way for the water line. It was moved by Councilman Orbison, seconded by Councilman Swain, to adopt `an ordinance prohibiting deposit and throwing of animal, fruit, vegetable refuse, or offal and other articles of trash upon any vacant lot or tract of land and upon gutters adjacent to lots and prohibiting the sweeping, throwing or placing of dirt from stores into the streets or gutters, declaring any of said acts to be nuisances, providing for penalties and declaring an emergency. Motion carried. (Said ordinance being attached to and becoming a part of these minutes). City Attorney Chandler reported condemnation suit;;hss<r'besn = filld adnd:; all11 parties involved have been served. The b.uit is set for trial on April 16, 1964. After this date the City should be in position to move on this land at any time. It was moved by Councilman Stem, seconded by Councilman Orbison, to author - " ize the Mayor to sign a contract with Homer Hunter & Associates for engineering on the proposed pipe line and tying in of wells in the well field. Motion carried. AT i y ecretary. 3conded by Councilman Stem, that City the Tax School at Tyler, Texas, the Motion carried. time, the Council stood adjourned Mayor. 5_ RESOLUTION CANVASSING RETURNS AND DECLARING RESULT OF CHARTER AMENDMENT ELECTION At a meeting of the City Council of the City of Stephenville held at the regular meeting place thereof in the City Hall in Stephenville on the 13th day of April, 1964, a quorum being present, came on to be considered the returns of an election held in the City for the purpose of the adoption or rejection of an amendment to the City Charter of the City of Stephenville, Texas, and upon consideration of such returns the following resolution was passed: WHEREAS, under and by virtue of an ordinance duly enacted and approved on the 3rd day of March, 1964, and thereafter duly published as provided by law, an election was held in said City on the 7th day of April, 1964, for the purpose of the adoption or rejection of said amendment to the City Charter of the City of Stephenville, Texas: AND WHEREAS, upon consideration of the returns of said election it appears that same was in all respects legally held; that due notice had been given; that returns thereof were duly and legally made; and that there were cast at said election 1364 votes, of which there were cast for amending and changing Section 5 of Article III of the City Charter of Stephenville, 857 votes and against amending and changing Section 5 of Article III of the City Charter of the City of Stephenville, 507 votes. And it appearing to the City Council that a majority of the qualified voters of said City of Stephenville, voting at said election, voted in favor of the amendment of Section 5 of Article III of the City Charter of the City of Stephenville and that said proposed change and a- mendment was adopted: THEREFORE, BE IT RESOLVED by the City Council of the City of Stephen- -- ville, Texas, that the proposition to adopt the Charter Amendment was sustained, and at such election said amendment was adopted by a majority of the qualified voters of said City, voting at said election, and the said charter amendment thereby became and is now hereby recognized and declared to be a part of the City Charter of the City of Stephenville, Texas. The above resolution being duly presented and read, it was moved by Alderman Stem and seconded by Alderman _Darby that the same do pass; thereupon the question being called for, the aforesaid resolution was adopted by the affirmative vote of all the members of the City Council. PASSED AND APPROVED this 13th day of _pril, 1964. Mayor ATTEST: City Secretary 5-49 ORDINANCE PROHIBITING DEPOSIT AND THROWING OF ANIMAL, FRUIT, VEGETABLE REFUSE OR OFFAL AND OTHER ARTICLES OF TRASH UPON ANY VACANT LOT OR TRACT OF LAND AND UPON GUTTERS ADJACENT TO LOTS AND PROHIBITING THE SWEEPING, THROWING OR PLACING OF DIRT FROM STORES INTO THE STREETS OR GUTTERS, DECLARING ANY OF SAID ACTS TO BE NUISANCES, PROVIDING FOR PENALTIES AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One It shall be unlawful and is hereby declared to be a nuisance for any person to cast, throw or place or to suffer his agents or employees, or any person of his family or by his orders to cast, throw or place into or upon any street, highway, alley, sidewalk, street; gutter or any public or private place or any vacant lot or tract of land within the City Limits of Stephenville any animal, fruit or vegetable refuse or offal, or any tin, glass, bones, rags, iron, pieces of wood, straw, dirt, filth, ashes, chips, shells, paper or any other rubbish or trash. Section Two It shall be unlawful and it is hereby declared to be a nuisance for, anyone to throw, place or sweep any paper, dirt, trash, or rubbish from any store into the streets or gutters of the streets in the City of Stephenville. Section Three It shall be unlawful and is hereby declared a nuisance for any owner, lessee, tenant or occupant of any building or premises within the City of Stephenville to allow the gutters, sidewalks and alleys adjacent to such build= ing or premises to become littered, clogged or filled with any offensive sub - stance, liquid or solid, or any dirt, rubbish, water, bottles, broken glass, crockery ware, iron, tin, wire or stones or any other thing dangerous to health, life or limb of man or beast. Section Four Any person found guilty of violating any provision of this ordinance. shall be guilty of a misdemeanor and upon conviction shall be fined not less than $5'.00'nor more than $100.00. Section Five In the event any section, clause, sentence or paragraph or any por- tion of this ordinanoteoshall, for any reason, be adjudged by any court of competent jurisdiction/be invalid, such invalidity shall not affect, impair or invalidate the remainder of this ordinance. Section Six The fact that conditions exist in the City of Stephenville giving rise to the nuisances herein prohibited and causing situations to exist which are dangerous to health and property, creates an emergency and an imperative public necessity that this ordinance go into effect immediately from and after its passage and publication as provided by law,', and any provision of the ordinances of the City of Stephenville or of the law providing otherwise are hereby suspended.
