The City Council met in regular session on the above date with Mayor Evans presiding and the following councilmen present: Virgil Dickerson, I. D. Reynolds, Mark Geeslin, Albert Graves, Raymond Anderson, W. H. Stem and Harlan Huey. — Others present were Water Supt. Gann, St. Supt. Collins and Chief Cornell. Minutes of previous meetings were read and approved. Mr. George Nelson came before the Council stating the sewer line stops up and sewage backs -up.in his;house and overflows on his yard. Mr. Nelson asked that some - thing be done to correct this situation. Mr. Gann was asked to check into this and try to work something out. Messrs. Caleb Smith and L. N. Miller appeared before the council to present a pentition signed by more than a hundred persons. This petition asked the City not to grant Farmers Feed Mill.a permit to operate a mill on property located on the corner of Collins and Race Streets. After discussion, the council agreed to check with City Attorney Chandler before any action would be taken. Councilman Dickerson reported that he, Councilmen Graves and Anderson had looked at some of the City Dump Ground west of Cleveland Street and would like to see the City advertise some of this land for sale. It was pointed out that this parcel of land wpuld sewer. It was moved by Councilman Dickerson, seconded by Councilman Stem,, to adver- tise for sale a strip of land approximately 340 feet wide, lying west of N. Cleve - land Street, and lying between Chamberlin Addition and Lingleville Road. Motion carried. Councilman Dickerson reported Mrs. 'Bone has been contacted about the possibility of moving the rock columns on'Erath Street, near Piggly Wiggly Store. Mrs. Bone personally agreed this_is.a traffic hazard and would take it up with the 20th Cen- tury Club and advise the results. Councilman Dickerson also reported that some of the city land near the river on E. Long Street has been levelled off and fixed for a baseball field to be used for the colored people. Councilman Dickerson reported Henry Noonkester "wants to build a house near the Graham Street river bridge which does not comply with zoning regulations. Councilman Dickerson would like for the Council to grant this permit. It was pointed out that this should be handled by the proper proceedures as set out in the Zoning Ordinance. Councilman Dickerson expressed appreciation to all members of the Council and City Employees for their fine cooperation while he was a member of the Council. Councilman Graves reported there were some complaints of Mfr. Jokel, on Lydia Street', not being connected to the sewer line. This is causing an unsanitary con - dition. The Council asked that City Secretary Cates contact Mr. Jokel and ask him to connect with the sewer. Councilman Stem reported he has written Texas Water Commission concerning hydrology reports and should have something by the next regular meeting. Councilmen Geeslin, Huey, Reynolds and Anderson had nothing to report. Mayor. Evans stated that several days ago each council member was mailed a letter asking that they consider the appointment of a Director of Public Works, with the Water, Sewer, Street, Park and Cemetery Departments being handled by the director. It was moved by Councilman Anderson, seconded. by Councilman Stem, that R. Y. Gann be appointed Director of Public Works. Motion carried. It was moved by Councilman Graves, seconded by Councilman Dickerson, to appoint Dean Cox to fill the unexpired term of Paul Kilgore on the Zoning Board. Motion carried. The'Mayor presented all the Council Members a folder with copies of city pro - CeeduX'P,9, policies, -City Charter and City Ordinances. In doing this it is felt it will be very helpful to Council Members. Tommy Lochridge expressed appreciation to the council members for all favors while he was manager of the Chamber of Commerce. It was moved by Councilman Dickerson, seconded by Councilman Graves, to adopt an ordinance dedicating a tract of land of B. W. Roberts 582 acre subdivision of the John Blair Survey as a continuation of Cleveland Avenue in the City of Stephenville. Potion carried. (said ordinance being attached to and becoming a part of these minutes). Im AN ORDINANCE DEDICATING A TRACT OF LAND OUT OF B. W. ROBERTS 582 -ACRE SUBDIVISION OF THE JOHN BLAIR SURVEY AS A CONTINUATION OF CLEVELAND AVENUE IN THE CITY OF STEPHENVILLE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: Cleveland Avenue from its present terminal point is hereby continued in that certain land described as follows: BEGINNING at a channel iron stake 25 feet N. 30 -00 W from the Northwest corner of Block L of the Chamberlin Addition in the City of Stephenville according to ,plat of said Addition of record in Vol. 353, page 236, Deed Records of Erath County, Texas, on the E.B.L. of Cleveland Avenue where it intersects the S.B.L. of a 52 -acre tract conveyed to the City of Stephen- ville, May 7, 1902, recorded in Erath in Erath County Deed Records in Vol. 73, page 615, by J. H. Cage , out of the John Blair Survey, Abst. No. 32, for the S.E.C. of this; THENCE N. 30 -00 W. 839.5 feet along the E.B.L. of Cleveland Avenue to an iron pin for the N.E.C. of this; THENCE N. 87 -44 W. 67.6 feet along the South R.O.W. line of FM Highway 8 and 60 feet from its centerline to an intersection with the W.B.L. of Cleveland Avenue to a stake for the N.W.C. of this; THENCE S. 30 -00 E. 884.9 feet along the W.B.L. of Cleveland Avenue to a stake for the S.W.C. of this; THENCE N. 60 -00 E. 50 feet with the N. line of a 25 -foot street to the place of beginning; and the above described land is hereby designated as such a continuation of Cleve- land Avenue and said land as hereinabove described shall be from henceforth a public street and a continuation of said Cleveland Avenue and so designated on the map and plat of said City. Louis Evans, is hereby authorized to execute deed on the following described land:,. 8.96 acres of land out of a 52 -acre tract conveyed to the City of 6tephenville, May 7, 1902, Vol. 73, page 615, by J. H. Cage out of the John Blair Survey, bst. No. 2 said Y 3 , land being formerly known as the old City dump round and located d ' Y p g e in the Northwest part of Stephenville, Erath County, Texas, along FM Highway No. 8 be- tween Garfield and Cleveland Avenue, and BEGINNING in the S. B. L. of said 52 -acre tract where it intersects with the WBL of Garfield. Avenue, an iron pin by the side of a fence corner pose, N. 30 -00 W. 25 feet from the N. E. corner of Lot 1, Block L of the Chamberlin Addition, for S. E. C. of this; THENCE N. 30 -00 W. 85.2 felt along W. B. L. of Garfield Avenue to its inter - section with the S. B. L. of FM Highway No. 8 known as the Lingleville Road to an iron pin for N. E. C. of this; THENCE along the South R. O. W. line of FM Highway 8 and 60 feet from its centerline in a Westerly direction along a curve to the right whose radius is 1015.4 feet and whose central angle is 21 -04, 373.3 feet to a hexagon- shaped ash stake; THENCE continuing along the South R. 0. W. line of FM Highway 8 and 60 feet from its centerline, N. 87 -44 W. 792.8 feet to its intersection with the E. B. L. of Cleveland Avenue, an iron pin, for the N. W. C. of this; THENCE S. 30 -OOE: 839.5 feet along E. B. L. of Cleveland Avenue to a channel iron stake on S. B. L. of said 52 -acre tract and being the S. W. C. of this; THENCE N. 60 -00 E. 886.0 feet to the place of beginning; (said land being from survey on the ground made by Thomas B. King, Registered Public Surveyor No. Texas, on March 23 -25, 1963)a 425 of conveying same to Villa Fontana, Inc., a corporation, for the sum of X5,123.00 to be paid in cash, said deed to be in the name of the City of Stephenville by the Mayor and attested by the City Secretary. It was moved by Councilman Dickerson, seconded by Councilman Graves, to authorize the transfer of the necessary funds. Motion carried. Mayor Evans appointed Councilmen Anderson, Reynolds and Huey as a committee to canvass the results of the City Election. Stem, Ward # 4 --- - -- - --- 227 -------------------------- - - - - -- -406 It was moved by Councilman Geeslin, seconded by Councilman Dickerson, that the report Of the committee be accepted and payroll for holding election be approved. Motion carried. The candidates receiving,the highest number of votes being: Hubert Darby, Ward 1; E. Lee Orbison, ?-lard # 2; Roy Swain Jr., Ward # 3; and W. H. Stem, Ward # 4• These candidates were declared elected, a motion put to a vote carried unanimously. There being no other business at this time, the Council stood adjourned subject 12 to the Mayor's call. A, S y Secretary.
