The City Council met in regular meeting on the above date with Mayor Evans presid- ing and the following councilmen present: Virgil Dickerson, I. D. Reynolds, Wm. 0.,'' Croft, Mark Geeslin, Albert Graves, Raymond Anderson, W. H. Stem and Harlan Huey. Others present were Water Supt. Gann, St. Supt,. Collins, Chief Cornell and City, Atty.Chandler. Minutes of previous meeting were read and approved. A group, representing the Youth Recreation Committee, with Dr. Nathan Cedars as as spokesman, appeared before the council and explained that this group is interested in organizing a full time recreation program for the youth of this area. The plans are to hire a full time recreation director at an approximate cost of $5600.00 per year and an extimated $4000"-' for operating expenses. It was pointed out that the County would be asked to help pay these expenses. This was referred to the Finance Committee to check into and the council will discuss it later. Mr. Bras Cole appeared before the council to report the local insurance agents had met and organized. This group set up basic rules for an agency to qualify for a portion �( of the profits from City business. It was suggested that the insurance agents meet with the City Council Insurance Committee and work out the necessary details. A group, representing the Baseball Commission, came before the council and reported the summer baseball program has grown until it has become impossible to raise enough finances to pay expenses of the program. This group asked the council to budget $1000 to help pay for this program for next year. After discussion, this was referred to the Finance Committee for consideration in the next budget. The Mayor asked that the Finance Committee also consider an increase in pay for members of the City Council. Councilman Dickerson reported there are some persons interested in covering a portion of Methodist Branch between Piggly- Wiggly and the Crow Laundry, then leasing this property for a long period of time and placing a building on it. After discussion, it was moved by Councilman Anderson, seconded by Councilman Dickerson, that the City advertise for bids to lease a 50 ft. by 150 ft. strip of the Methodist Branch, the party leasing said property to cover the branch to City specifications. Motion carried. It was moved by Councilman Graves, seconded by Councilman Geeslin, to give Guy Manning a one week vacation. Motion carried. Councilman Stem asked that water be placed in the "large shed at City Park. It was agreed that Mr. Gann would handle this. Councilmen Huey and Geeslin had nothing to report. Councilman Reynolds reported some members of the countil, along with the Chief of Police, plan to check with other towns and find what they are doing about overparking fines. It was moved by Councilman Dickerson, seconded by Councilman Anderson, that the City Secretary issue Eddie Williams a check for part payment for work completed on the police building. This to be done upon the approval of the architect. Motion carried. Councilman Croft reported for the Gasoline Ordinance Committee stating their rec- ommendations are that this ordinance not be changed at this time. , It was moved by Councilman Dickerson, seconded by Councilman Graves, to authorize the Finance Committee to purchase a D -6 Tractor from C. C. Booth when the details can be worked out. Motion carried. City Attorney Chandler reported an opinion has been received from the Texas League regarding the proposed annexation and zoning of property along the new By -Pass. The opinion of the League is that this property can be zoned for residential and industrial use, that the council has power to exclude junk yards and unsightly things from the area. City Attorney Chandler also stated that some cities are passing ordinances to keep junk yards from going in and requiring such places to be licensed. These things are being done without zoning the city. It is the opinion of the League that should this latter procedure be used it would not stand up in court, however, several cities are SPEED ZONE ORDINANCE AN ORDINANCE ESTABLISHING MAXIMUM LEGAL SPEEDS UPON CERTAIN HIGIMAYS AND STREETS OR PARTS THEREOF WITHIN THE CORPORATE LIT UT OF THE CITY OF STMMVI= , TEXAS, AS SET FORTH IN THE ORDINKNCE YM PROVIDING A PENALTY OF A FINE NOT TO EXCEED x$200 FOR THE VIOLATION OF THIS ORDINANCE WHEREAS, Section 8 of Article 827a., Vernon Penal Code of the State of Texas, provides that whenever the governing body of the City shall deter- mine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pavement and other circumstances on such por- tion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersections or other place or part of the street or hidiway, now there- fore, BE IT ORDAINED by the City Council of the City of tethenville , Texas SECTION 1, The following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe, and such speed limits are hereby fixed at the rate of speed indicated for ve- hicles traveling upon the named streets and highways or parts thereof, described as follows: (a *) From Station 2238 +11.5 (North City Limits of Stephenville can U*S• 281) Southerly to Station 69+19.5 (South Eity Limits of Stephenville on uq!s* 281), at 40 Miles Pier Hour, Speed Zone Ordinance -2- SECTIOPI 2. The City Council of the City of St ,Yzenvi110 _ _ declares and fixes the above maximum speed limits and the District Engineer is hereby authorized to proceed with the erection of the appropriate signs. SECTIOi; 3. It is hereby declared that the construction project on U.S. Highway No. 281 has necessitated the enactment of this ordinance for the safety of those.traversing T.S. Highway No. 281 in the City of St heeav3 po, Tema Therefore, the above regulations shall be in effect a ter the passage of this ordinance and the erection of the proper signs; and, this shall remain in effect until the completion and acceptance of the said construction project by the Highway District Engineer or until such time as the construction project has progressed to a stage whereby, in the opinion of the Highway District Engineer, traffic may safely travel the construction project, or portions thereof, at the rate of speed posted prior to the con- struction. The Highway District Engineer will have the authority to replace the construction speed zone signs with speed zone signs reestablishing the speed zoning prior to construction and the placement of such signs shall be evidence of the governing speed zone or zones. The completion and /or accept- ance of the said construction project by the Highway District Engineer shall cancel the provisions of this ordinance and the Highway District Engineer shall be authorized to remove all such signed used in compliance with regul- ations set forth in this ordinance. SECTION 4. Any ordinance or any part thereof in direct conflict with this ordinance is hereby superseded and the part of the ordinance in conflict herewith shall be null and void so long as this ordinance is in effect. However, any ordinance or part of an ordinance superseded by this ordinance shall automatically be reinstated in force upon the date of completion and /or acceptance of the said construction project, when this ordnance is no longer in effect. SECTION 5. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred (4200.00) dollars. SECTION 6. If any part of this ordinance be declared unconstitutional or otherwise void by a court of competent jurisdiction, such decision shall, in no ways effect the validity of any of the remaining parts of this ordinance unless the part held unconsititutional or void is insepa- ble from, and indispensable to, the operation of the remaining parts. The City Council hereby declares that it would have passed those parts of this ordinance which are valid and would have omitted any parts which may be unconstitutional or void, if it had known such parts were stitutional or void at the time of the passage of this ordinance. Cit ecretary PLANNING AND ZONING COMMISSION ORDINANCE AN ORDINANCE CREATING A PLANNING An ZONING COMMISSION FOR THE CITY OF STEPHEM,LLE9 TEXAS, AND PRESCRIBING THEIR POWERS AND DUTIES BE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One There is hereby created and established for the City of Stephenville, Texas, a Planning and Zoning Commissiony which shall be composed of 5 members. The mem;ers shall be resident citizens, taxpayers and qualified voters of the City and shall be appointed by the Mayor subject to the confirmation of the CitY'CouncII to serve for a term of one Year. All vacancies shall be filled for the unexpired term in the same manner as provided in the original appoint- ment. All expired terms shall be filled for terms as provided for the original appointment and in the same manner. Members of the Commission may be removed by the Mayor, with the consent of the City Council, after public hearing and for cause assigned in writing. Members of the Commission shall serve without compensation. Section Two ------------------ 1__ The Planning and Zoning Comm* n shall elect a chairman and vice chairman from its membership and shall pc to employ such qualified per- sommission and o ons as may be tnecessary for the proper conduct and undertakings of the C pay for their services and such other necessary expenses, provided that the cost of such services and expenses shall not exceed the amount appropriated by the governing body for the use of the Commission. All costs incurred in this connection shall be submitted to the City Secretary for his checking and for approval of the City Council. Motion carried by vote of 5 for, 3 against. It was moved by Councilman Graves, seconded by Councilman Croft, to accept the Delinquent Tax Roll. Motion carried.
