September 10, 1965.
The City Council met in a called meeting on this date with Mayor Arthur presiding,
the following councilmen present: Robert Herrin, Mrs. Doyle White, Roy Swaim, Chas.
Riggins, Bill Christian, Telefus B. Cawyer, and Mrs. Fred McCleskey.
The Mayor reported that a letter was received from Mr. Clyde Sweeny, attorney
representing parties interested in the apartments which are to be built on land in
Blocks 140 and 145, City Addition, should the zoning be changed. Mr. Sweeney, in his
letter, pointed out the fact that the Petition against re- zoning was not notarized and
therefore was not valid.
City A ttorney Chandler advised the Council that if the lack of acknowledgement
had been brought up at the Tuesday meeting he would have advised the Council a major-
ity vote only was necessary, however, the Council acted on the assumption that the
petition was valid. He also advised the Council they may reconsider the action taken
Tuesday night.
The Mayor asked if the Council wanted to let the decision stand, and possibly go
to court, or reconsider under the facts which have been brought out.
It was moved by Councilman Swaim, seconded by Councilwoman White, to reconsider
the action taken on Tuesday, September 7, 1965. Motion carried by vote of 6 for with
Councilman Christian abstaining.
Mr. Frank DePree, one of the petitioners, who lives on the South Loop near the
Property in question, asked the Council to adjourn and give the persons against re-
zoning a chance to prepare a defense. Mr. Joe B. Meador, another petitioner, stated
that the group had not been told the petitio n should be notarized and asked for time

to prepare a defense.
It was moved by Councilman Cawyer, seconded by Councilman Riggins, to delay
action to allow persons against re- zoning to be properly represented. The vote was
3 for the motion and 4 against. Motion did not carry.
It was moved by Councilman Cawyer, seconded by Councilman Swaim, to accept the
recommendations of the Zoning Commission & Adjustment Board thereby changing the
zoning of land in Blocks 140 and 145, City Addition, from R -1 to R -2; provided the
apartments be built as per plan presented. Motion carried by a vote of 5 for, and
2 against. (Councilman Riggins asked that his vote be recorded against).
