The City Council met in called meeting on this date with Mayor Arthur presiding and the following councilmen present: Roy Swain, Robert Herrin, Mrs. Doyle White, Chas. Riggins, Telefus B. Cawyer and Mrs. Fred McCleskey. It was ipoved by Councilman Riggins, seconded by Councilman Cawyer, to adopt an ordinance declaring that'portion of Greenview Drive, in the Greenview Addition, in the City of Stephenville, and having as its Northweut Corner a point on the West Line of said Greenview Drive 27.1 feet southerly "from the Southeast Cornier of Lot 81 Block 3, of said Greenview Addition, and having its Northeast Cornier a point on the East Line of said Greenview Drive 51.3 feet southerly from the Southwest Corner of Lot 6, Block 4, of said addition, and running thence to the North Line of Swan Street, to have been abandoned as a street, ordering same vacated and closed and a uthorizing the Mayor to execute a Quit Claim Deed to that portion of the street so vacated and closed, to James T. Young Motion carried. (Said ordinance being attached to and becoming a part of these minutes). It was moved by Councilman Swain, seconded by Councilman Riggins, to adopt an ordinance on second reading annexing property to the City which is owned by Kenneth }� Lockhart out of the J. B. Dupuy Survey, Abstract 196, and being 13.609 acres of land which adjoins the present City Limits, along with dedicated streets and alleys as shown on plat presented to the City. Motion carried. (Said ordinance being attached to and becoming a part of these minutes). It was moved by Councilwoman McCleskey, seconded by Councilman Swain, that the City proceed to excavate and level Charlotte Street from Frey Street to Mimosa Lane, the City to pay one half this cost and Drs. Cedars and Terrell to pay the other half. The work to be done as soon as possible. A lso, that the City is not bound to do any other work under these terms in this addition. Motion carried. It was also agreed that the City will continue to lay water and sewer lines when Possible at a negotiated price. ,ZT, J DRIVE ORDINANCE DECLARING THAT PORTION OF GREENVIEW/IN THE GREENVIEW ADDITION IN THE CITY OF STEPHENVILLE AND HAVING AS ITS N.W.C. A POINT ON THE WEST LINE OF SAID GREENVIEW DRIVE 27.1 FEET SOUTHERLY FROM THE S.E.C. OF LOT 8 OF BLOCK 3 OF SAID GREENVIEW ADDITION AND HAVING AS ITS N.E.C. A POINT ON THE EAST LINE OF SAID GREENVIEW'DRIVE 51.3 FEET SOUTHERLY FROM THE S.W.C. OF LOT 6 OF BLOCK 4 OF SAID ADDITION AND RUNNING THENCE TO THE NORTH LINE OF SWAN STREET, TO HAVE BEEN ABANDONED AS A STREET ORDERING SAME VACATED AND CLOSED AND AUTHORIZING MAYOR TO EXECUTE A QUIT CLAIM DEED TO THAT PORTION OF THE STREET SO VACATED AND CLOSED TO JAMES T. YOUNG BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One That portion of Greenview Drive in the City of Stephenville having as its N.W.C. a point on the West line of such street which is 27.1 feet from the S.E.C. of Lot 8 in Block 3 of said Addition and having as its N.E.C. a point 51.3 feet from the S.W.C. of Lot 6 of Block 4 of said Addition and run- ning thence Southerly to the North line of West Swan Street is hereby declared to have been abandoned for street purposes and said portion of Greenview Drive is hereby ordered vacated and closed as a street. Section Two Jack Arthur, Mayor of the City of Stephenville, Texas, is hereby authorized and directed to execute to James T. Young for the sum of $25.00 paid to the City of Stephenville, a Quit Claim Deed covering that portion of Oreenview Drive above ordered vacated and closed which Quit Claim Deed shall convey the right, title and interest of the City of Stephenville to said James T. Young and which deed shall be attested by the City Secretary of the City of Stephenville and the seal of the City affixed thereto by said Secretary. January l { It 0 r� f t�Y too e AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT TO SAID CITY AND OUT OF THE J. B. DUPUY SURVEY, ABSTRACT 196, AND BEING 13.609 ACRES OF LAND WHICH ADJOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE DESCRIBES SAID LAND BY METES AND BOUNDS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: That certain area of land adjacent to the City of Stephenville and specifically described as follows: 13.609 acres of land out of the J. B. Dupuy Survey, Abstract 196, as surveyed for C. A. Taylor, situated in Erath County, Texas, being the North 13.609 acres out of said survey that wascconveyed to C. A. Taylor et ux by W. I. Martin et ux as shown by deed recorded in Vol. 375, page 604, of the Deed Records of Erath County, Texas, BEGINNING at a point on the W.B.L. of said J. B. Dupuy Survey, the S.W.C. of the W. D. Williams 25 -acre tract, being S. 30 E. 238 vrs. from the N.W.C. of said J. B. Dupuy Survey; THENCE S. 30 E. 433 feet to a 3/4 -inch pipe set in old fence line on the W.B.L. of the Dupuy Survey for S.W.C. of this; THENCE N.60 E. 1278 feet to a one -inch pipe set on the W.B.L. of F. M. Highway No. 914, for S.E.C. of this; THENCE N. 7 -12 W. along the West line of said Highway at 464 feet a fence corner post, over all 469.7 feet to a 3/4 -inch pipe for N.E.C. of this; THENCE S. 60 W. 1460 feet to the place of beginning; Being the same tract surveyed on October 11, 1962, for C. A. Taylor by J. O. Yantis, County Surveyor, Erath County, Texas, and State Registered Public Surveyor No. 684;, is hereby received into the City of Stephenville and made a part of the City of Stephenville and the City Limits of the City of Stephenville are hereby extended in accordance with the lines of the tracts of land hereinabove described. The above and foregoing ordinance was introduced at the meeting of the City Council of the City of Stephenville held on Tuesday, December 7, 1965, by Alderman Swain At such time, it was moved by Alderman Swain and seconded by Alderman Herrin and upon being put to a vote such motion carried to the effect that this ordinance be published for one issue of the Stephenville Daily Empire and that by such publication notice be given in accordance with Section 5 of Article 1 of the City Charter of Stephenville, Texas, that this ordinance will be finally acted upon at a meeting of this City Council to be held at least 30 days after such publication; and any citizen of Stephenville or of the territory to be annexed and which is hereinabove described, shall have the right to contest such annexation by filing with the City a written petition setting out their reasons for such contest and such citizen or citizens shall be given an op- portunity to be heard before said ordinance in the form hereinabove set out or in a form to be amended by this Council shall be acted upon. This proposed ordinance wanly published in the Stephenville Daily Empire in the issue of December 7101965, and notice was thereby given that this ordinance would be acted upon at least 30 days after such publication. The City Council of the City of Stephenville duly met on the 7th day of January , 1966, and a quorum being present the City Secretary was called upon to advise the Council whether any written petition or contests of the proposed annexation had been filed with him for presentation to the City Council. The City Secretary advised that no written petitions or contests of any kind had been filed and that no person had made any inquiry of him con- cerning cerning the annexation. Thereupon, it was moved by Alderman Swain and seconded by Alderman Riggins that this ordinance be finally passed as hereinabove set out. Said motion being put to a vote, it carried unanimously. PASSED AND APPROVED THIS ATTEST: \ _ City Secretary TT� , Also, in the future when utilities are needed the developer will contact Mr. Gann, then the developer, Mr. Gann and Mr. Cates will work out a price for the utilities, arrange payment, and arrange for the needed work to be done.
