HomeMy WebLinkAbout1967-05-19 - Special City CouncilStepehenvill8, Texas May 19, 196' The City Council met in a called meeting on the above date with Mayor Arthur presiding and the following council members present: Mrs. Doyle White, Garland Loudermilk, W. M. Irwin, Telefus Cawyer and Mrs. Fred McCleskey. Mayor reported that the purpose of this meeting is to hear anyone who has objections' to rezoning of Block 1, McAlester Second Addition. There was no one appeared before the Council to register objection to such change of zoning. It was moved by Councilman Loudermilk, seconded by Councilwoman McCleskey, that the zoning of Block one, McAlester Second Addition, be changed from Residence 1 to - Business 2, thereby sustaining the recomendation of Zoning Commission and Adjustment. Board, Motion carried unanimously. The council discussed the appointment of a 3rd member of Board of 19 Equalization.. There were no recomendations at this time. The council agreed to meet at 1:15 P. M. Monday, May 22, to select such board member. The Council discussed the condition of the wooden building at the City Park. This building has been examined by a building contractor and is reported to be beyond repair. The Council members made a personal inspection of this building and after discussions it was moved by Councilwoman McCleskey, seconded by Councilman Loudermilk that the building be condemned for public or private use in its preset condition. A notice of this action to be published in local newspaper. Motion carried unanimously. There being no other business at this time the Cou cil stood adjourned subject to the Mayor's call. ' — �17 AT / 'Ci secretary !r i NOTICE TO BIDDERS Sealed proposals addressed to the Mayor and Councilmen of the City of Stephenville, Texas, will be received at the office of Mr. Rex Cates, City Secretary, until 7 :00 o'clock on June 6th , 1967 for furnishing and installing street improvements as follows: CONTRACT "A" Courthouse Square and Appurtenances $2,000.00 Bid Bond CONTRACT "B" Traffic Signal System and underground Electrical Conduits $4,800.00 Bid Bond CONTRACT "C" Parking Meters $ 500.00 Bid Bond Bidders must submit with their bids a Cashiers or Certified Check payable to or endorsed, without recourse, to the City of Stephenville, Texas, or a Proposal Bond in the same amount, from a reliable Surety Company, as a guarantee that Bidder will enter into a contract and execute bond and guarantee forms provided within five (5) days after notice of award of contract to him. Bids without check or proposal bond will not be considered. In accordance with Chapter 93, Acts of the 56th Legislature, which became effective April 27, 1959, . the successful Bidder will be re- quired to furnish not only a performance bond in the amount of the contract, but, also a payment bond in the amount of the contract, for the protection of all claimants supplying labor and materials as defined- in said law. The bonds must be executed by an approved Surety Company holding a permit from the State of Texas to act as Surety and acceptable according to the latest-list of companies holding certificates of authority from the Secretary of the Treasury of the United States, or other Surety or Sureties acceptable to the Owner. All unit prices must be stated in both script and figures. The Owner reserves the right to reject any or all bids and to waive forma- lities. In case of ambiguity or lack of clearness in stating the price in the bids, the Owner reserves the right to consider the most ad- vantageous construction thereof, or to reject the bid. Unreasonable or unbalanced unit prices will be considered sufficient cause for rejection br any bid or bids. i I] Bidders are expected to inspect the site of the work and to inform themselves regarding local conditions and conditions under which the work is to be done. Not less than the prevailing rate of per diem wages for work of similar character in the City of Stephenville, and County of Erath, and not less than the general prevailing rate of per diem wages for legal holiday, Saturdays, Sundays, and overtime work shall be paid to all laborers, workmen and mechanics employed in said City and County on the above project. Deposit will be returned provided: (1) The Bidder return the plans and specifications within 72 hours after the bid date; OR (2) The Non - Bidder return the plans and specifications in good condition 72 hours prior to bid date; OR If the above is not complied with, the entire $25.00 deposit will be forfeited and no refund made. Suppliers may obtain Specifications and Plans at the address stated above upon deposit of Fifteen ($15.00) Dollars which sum is non - refundable., It is the intention of the City Council to issue the time warrants of the City of Stephenville for payment of a part or all of the Contractsto be made pursuant to this notice, and to pay part or all of the Engineer's fees and inspection and testing fees, to pay for the purchase of land and right of way for street purposes and the cost of acquiring same, to pay for street improvement work to be done by the City, and to pay for legal and financial advisory services in connection with the issuance of said warrants. The maximum amount of time warrant indebtedness to be incurred for said purposes shall be $240,000, the maximum rate of interest such time warrants are to bear is 52% per annum, and maturing not more than twenty years after their date. The City has. obtained a commitment from an investment company for the purchase of said warrants from the Contractor, so that said warrants shall be delivered to the Contractor on approved estimates and the Contractor will immediately deliver said warrants to said investment company and receive in cash the par value therefor. The City Council has ascertained and hereby finds that the general prevailing rate of per diem wages in the City of Stephenville and in Erath County, for work similar to that to be performed under the contracts to be awarded pursuant to said notice is as set out in the foregoing prescribed form of notice. 3. Said notice shall be published in the "Stephen- ville Empire Tribune ", a newspaper of general circulation published within the City of Stephenville, on the same day of each of two consecutive weeks, the first publication being at least fourteen days prior to the date set for received bids as shown in the form of notice above described. -------------------------- -------------- ORDINANCE NO. FIXING AND AUTHORIZING RATES AND CHARGES FOR LOCAL TELEPHONE SERVICE IN THE CITY OF STEPHENVILLE, TEXAS, AND AUTHORIZING THE GULF STATES - UNITED "TELEPHONE COMPANY TO GIVE EFFECT THERETO: WHEREAS, the Gulf before the City Council and telephone service heretofore said company to earn a fair devoted to furnishing local exchange, and States - United Telephone Company has appeared has shown that rates and charges for local authorized have proved insufficient to permit return on the fair value of its property, exchange telephone service in the Stephenville WHEREAS, the rental rates now charged for local telephone ser- vice in the City of Stephenville were established over nine years ago and have changed only twice in the past thirty -nine years, and WHEREAS, Gulf States - United Telephone Company has more than complied with its agreement with the City of Stephenville at the time of the last rate adjustment to make an additional investment of $30,000 in 'the improvement and expansion of its central office and outside plant facilities, and WHEREAS, Gulf States - United Telephone Company has increased its total investment in telephone plant in the Stephenville exchange since 1957 from approximately $575,000 to over $1,500,000 in 1966, over 160 %, �Y and has increased the number of telephones served during this same period from 2,839 to 5,191, an increase of 83 %, thereby making telephone service more valuable to its customers served by the Stephenville exchange, and WHEREAS, the Gulf States - United Telephone Company has indicated its willingness to continue to provide such outside, pole, wire and cable telephone plant and central office equipment as may be required to furnish the classes of service listed in Section 1 below for its subscribers in the City of Stephenville in accordance with such subscribers choice or option, provided relief is given by adjustments upward of its present rental rates to the rental rates set forth in Section 1 below and, WHEREAS, after investigation by the City Council of all per- tinent matters relating to the application, and the adjustments applied for appear to be just and reasonable and are considered necessary to insure the continued growth, improvement, and expansion of telephone service to meet the reasonable needs of the citizens of Stephenville, Texas. SECTION 3: Nothing herein shall be construed to deny the City its power to determine or fix in the future, or to deny the right of Gulf States - United Telephone Company to charge in the future, local exchange telephone rates which will yield a fair return upon the then fair value of said company's properties used and useful in furnishing local exchange telephone service to the City of Stephenville, Texas. SECTION 4: The fact that telephone service is a public necessity creates an emergency; therefore, all rules and regulations providing for the reading of ordinances more than one time and on more than one occasion be, and they are hereby suspended, and this ordinance is passed and shall take effect as an emergency measure. All ordinances and parts of ordinances in conflict with this ordinance are, to the extent of such conflict, hereby repealed.
