HomeMy WebLinkAbout1968-07-02 - Regular City CouncilStephenville, Texas July 2, 1955 The City Council met in a regular meeting with Mayor Arthur presiding and the following; Council members present: Robert Herrin, Don Metsgar, Garlan Louder- milk, Charles Ri:-gins, Telefu.s Cawyer, and Mrs. Fred McCleskey. Others present were: Director of Public Works Gann, Fire Marshall Ferguson, and Assistant Chief of Police McCoy. Minutes of previous meetings were read and approved. Mr. E. A. Blanchard, Chairman of the Equalization Council and reported that the Board has completed herewith are anprovile the tax roll and returning Mr. Blanchard also presented a retort showing the past seven years, and discussed some preposed cha forms. The motion carried unanimously. Councilman Herrin reported that Chief of Police is on vacation. Also a need for someone to take over the duties of City Judge during his vacation. It was moved by Councilman lerrin and seconded by Councilman Loudermilk that Rex H. Cates handle the duties of City Judge for the vacation period. The motion carried unanimously. Councilman Cawyer had nothing to report. Councilman Loudermilk, reporting for the Committee, stated that the Industrial Foundation has agreed to trade the necessary land on Harbin Drive for highway right of way for equal amount of land south of the proposed highwiy; and to also trade the balance of the original two acres of land for an equal amount, so that all the Industrial Foundation land. will be in one tract. AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT TO SAID CITY, WHICH LAND JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE DESCRIBES SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: That certain land adjacent to the City of Stephenville and specifically described as follows: All that certain tract or parcel of land, being a strip of land off of the North end of that certain 13.03 acre tract which is described in Warranty Deed from Mrs. Norma L. Moorhead et vir to Mrs. Sarah K. Shuler, dated November 17, 1928, and of record in Vol. 215, page 337, in the Deed Records of Erath County, Texas, and being all of said 13.03 acres that lies within 60 feet of the South lines of Blocks 2 and 3 in the West Oaks Addition in the City of Stephenville, in Erath County, Texas, according to the plat of said Addition of record in Vol. 406, page 294, in the Deed Records of Erath County, Texas; is hereby received into the City of Stephenville and made a part of the City of Stephenville and the City Limits of the City of Stephenville are hereby extended in accordance with the lines of the tract of land hereinabove described. The above and foregoing ordinance was introduced at the meeting of the City Council of the City of Stephenville held on the 2nd day of July, 1968, by Alderman McCleskev At such time it was moved by Alderman McCleskev and seconded by Alderman Metsaar , and being put to a vote such motion carried to the effect that this ordinance be published for one issue in the Stephenville Daily Empire and that by such publi- cation notice be given in accordance with Section 5 of Article 1 of the City Charter of Stephenville, Texas, that this ordinance will be finally acted upon at a meeting of the City Council to be held at least 30 days after such publica- tion; and any citizen of Stephenville or of the territory to be annexed,and which is hereinabove described,shall have the right to contest such annexation by filing with the City a written petition setting out their reasons for such contest and such citizen or citizens shall be given an opportunity to be;heard before said ordinance in the form hereinabove set out or in a form to be amended by this Council shall be acted upon. The above and foregoing ordinance was duly published in the Stephen- ville Daily Empire in the issue of July 5, 1968, and notice was thereby given that this ordinance would be acted upon at least thirty days after such publica- tion. The City Council of the City of Stephenville met on the 6th day of August, 1968, and a quorum being present the City Secretary was called upon to advise the Council whether any written petition or contest of the proposed annexation had been filed with him for presentation to the City Council. The City Secretary advised that no written petition or contest of any kind had been filed and that no person had made any inquiry of him concerning the annexation. Thereupon it was moved by Alderman Metsgar and seconded by Alderman Irwin that this ordinance be finally passed as hereinabove set out. Said motion being put to a vote, it carried unanimously. PASSED AND APPROVED this 6th ATTE City Secretary AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT TO SAID CITY AND OUT OF THE JOHN BLAIR SURVEY, ABSTRACT NO. 32 AND THE WM. MOTLEY SURVEY, ABSTRACT NO. 515, WHICH LAND - ADJOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE DESCRIBES SAID LAND BY METES AND BOUNDS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: That certain areaof land adjacent to the City of Stephenville and specifically described as follows: Parts of the John Blair Survey, Abstract No. 32, and the Wm. Motley Survey, Abstract No. 515, in Erath County, Texas, described by metes and bounds as follows: BEGINNING in the West line of the City of Stephenville at the S.W. Corner of Block 3, of the West Oaks Addition as shown by plat of record in Volume 406, page 294, in the Deed Records of Erath County, Texas; THENCE S. 30 -12 E. 60 feet to the South line of Frey Street as shown on the plat of Blocks A, B, and C of the Spanish Heights Addition prepared by George W. Black, Surveyor, dated May 4, 1968, for the S.E. Corner of this in the East line of the Shuler Heirs property; THENCE S. 60 deg. W. at 745.3 feet the East line of N. Dale Avenue as shown on said Spanish Heights Addition plat, in all 825.3 feet to the S.W. Corner of this; THENCE N. 30 deg. W. at about 30 feet the South line of the Stephen- ville School property at a point 50 feet S. 60 W. from the S.E. Corner of said School land, and running 50 feet Westerly of the East line of said School property, in all 1269 feet to the projection of the North line of Wisteria Drive from the East as shown by said Spanish Heights Addition plat, for the N.W. Corner of this; THENCE N. 60 deg. E. at 80 feet the East line of N. Dale Avenue, in all 821.3 feet to the West line of said City of Stephenville and West line of the West Oaks Addition for the N.E. Corner of this; THENCE S. 30 -12 E. 1269 feet to the place of beginning; is hereby received into the City of Stephenville and made a part of the City of Stephenville and the city limits of the City of Stephenville are hereby extended in accordance with the lines of the tracts of land hereinabove described. The above and foregoing ordinance was introduced at the meeting of the City Council of the City of Stephenville held on the 7th day of May, 1968, by Alderman Raymond Anderson I At such time it was moved by Alderman Don Mets ar and seconded by Alderman Chas. This proposed ordinance was duly published in the Stephenville Daily Empire in the issue of May 12, 1968, and notice was thereby given that this ordinancevould be acted upon at least thirty days after such publication. The City Council of Stephenville duly met on the 2nd day of July, 1968, and a quorum being present, the City Secretary was called upon to advise the Council whether any written petitionsor contests of the proposed annexation had been filed with him for presentation to the City Council. The City Secretary advised that no written petitions or contests of any kind had been filed and that no person had 450 made any inquiry of him concerning the annexation. Thereupon, it was moved by, Alderman Metsgar and seconded by Alderman'Cawyer that this ordinance be finally.. passed as hereinabove set out. Said motion being put to a vote, it'carsied unanimously. PASSED-AND APPROVED this 2n a of July, 1968. Mayor I 11115 It was moved by Councilman Loudermilk and seconded by Councilwoman McCleskey that the City trade land with the Industrial Foundation. The motion carried unanimously. k Councilman Loudermilk reported that the auditors did a good ,job and would like to recommend to the Council to adopt the changes in bookeeping system as suggested by the auditors. The Council discussed the Problem of vandalism and agreed that there is an urgent need to do something abou', this. Director of Public Works reported that 21,000 lineal feet of paving has been done on. City streets. It was moved by Councilman Metsgar and seconded by Councilman Loudermilk that the `1000.00 b4eted for curtains in the Fire Hall be used to purchase a tank for the n -w fire truck. The motion carried unamimously. It was moved by Councilman Metsgar and seconded by Councilman Cawyer to adopt upon final reading an ordinance making a pact of the City of Stephenville land adjacent to said City and out of the John Blair surney, absyrace no. 515, which land ad loins the present City Limits of the City of Step'nenville and which ordinance describes said land by metes and bound. The annexed land to be subject to all City specifications. T'h- motion carried unanimously. (Said ordinance being attac' -ed to and )7ecoming a part of these minutes). It was moved by Councilwoman McCleskey and seconded by Councilman Metsgar to introduce an ordinance making a part of the City of Stephenville land adjacent to said City, which loins the Present City limits of the City of Stephenville and which ordinance describes said land.. Also that this ordinance be published in the Stephenville Daily Empire and that such publication notice be given in accordance with Sec. 5 art. 1 of the City Charter. The motion carried unanimously. It was moved by Councilman Herrin and seconded by Councilman C: =wyer to authorize the Mayor to sign a letter to Dr. _Nathan Cedars confirminv t':Gat the City will Y 1! collect from the owner of Lot 2. Slock _4 City addition U90.00 for six inch sewer main extended to said pr.onerty. Such money to be reimbursed to Dr. Cedars. The motion carried unanimously. It was moved by Councilman Loudermilk and seconded by Councilwoman McCleskey to place ''`)'120,000.00 in Certificates of Deposit at 6� % interest to'be drawn quarterly. Such money to be transferred from City funds as follows: From Water Works operating $80,000.00 From Sewer Maintenance "25,000.00 From ?,dater Works Depreciation15,000.00 The motion carried unanimously.
