HomeMy WebLinkAbout1970-03-09 - Special City Council (2)Stephenville, Texas March 9, 1970 The City Council met in a called meeting on the above date with Mayor Arthur presiding and the following council members present: Robert Herrin, Don Metsgar, Garland Loudermilk, Charles Biggins, and W. M. Irwin. Mayor reported that the meeting was called for the purpose of hearing a report of Hunter Associates. Mr. Homer Hunter appeared before the council and briefly discussed the things that have been done in order to attempt to reach a satisfactory agreement on rates with Lone Star Gas Co.. Mr. Hunter presented an ordinance and copies showing comparison of rates offered by the council in February and the suggested rates as shown on the ordinance that is being presented today. It wa•smoved by Councilman Loudermilk, seconded by Councilman Irwin, to adopt an ordinance fixing and determining the general service rate to be charged for sales of natural gas to residential and commercial consumers within the city limits of Stephenville, Erath County, Texas and providing for the manner in which such rate may be changed, adjusted and amended. Motion the unanimously. (Said ordinance being attached to and becoming a part of these minutes). There bing no other business at this time the cou x-� stood adjourned, subject to the Mayor's call. /11' "7 �— 1"--2 Cit, ecretary Stephenville, Texas March 18, 1970 The City Council met in a called meeting with Maryor Arthur presiding and teh following council members present: Robert Herrin, Don Metsgar, Garland Loudermilk, Charles Riggins, Raymond Anderson and Mrs. Fred McCleskey. Mr. Dan Almon appeared before the council and presented ordinances for water system inprovements. It was moved lby Councilman Riggins, seconded by Councilman Metsgar, to adopt `F an ordinance approving change order number 1 on the contract of Bella Company. Motion carried unanimously. (Said ordinance being attached and becoming a part of these minutes). It was moved by Councilman Anderson, seconded by Councilwoman McCleskey, to �r approve estimate number 2 and final estimate of Layne Texas Company for water 7� system improvements. Motion carried unanimously. (Said ordinances being at- tached to and becoming a part of these minutes). It was moved by Councilman Loudermilk, seconded by Councilman Herrin, to adopt ordinances approving estimate number 6 and final estimate of Bella Company for water system inprovements. Motion carried unanimously. (Said ordinances being attached to and becoming a part of these minutes). C;) V City Secretary Mayor (SEAL) ORDINANCE APPROVING CHANGE ORDER WHEREAS, pursuant. to an ordinance passed by this City Council on the 29th day of May, 1969, this City entered into a contract with the Bella Company under which said Contractor agreed to furnish materials and perform certain work as set out in the specifications for water system improvement work to be done in said City; and WHEREAS ", it was desirable to make certain changes in said contract; and WHEREAS, this City and the Bella Company agreed to said changes but said changes were not reflected in the minutes of this City Council and said changes should now be ratified and confirmed; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE- 1. The City of Stephenville, Texas, hereby authorizes Change Order Number 1 as attached hereto and made a part hereof. 2. The Mayor of this City is directed to sign the contract change order for the change above mentioned. 3. The amount of warrants to be delivered to said Contractor is hereby decreased by the deducted payment required by the above change. 4. The agreement heretofore entered into between this City and the Bella Company evidenced by the above mentioned change order is hereby in all things ratified and confirmed. 5. ADTUSTMENT The amount of each net monthly bill computed at the above stated rates shall be subject to the following adjustment: Plus an amount equivalent to the proportionate part of any new tax, or increased tax, or any other governmental imposition, rental, fee or charge (except state, county, city and special district ad valorem taxes and taxes on net income) levied, assessed or imposed subsequent to July 1, 1969, upon or allocable to the Company's distribution operations, by any new or amended law or ordinance. Each gross monthly bill shall be adjusted proportionately. Company, at its option, may forego the application of this adjustment; however, failure of Company to apply such adjustment shall not constitute a waiver of Company's right from time to time, or at any time, to make such adjustment, in whole or in part, in any sub- sequent current monthly bill that may be applicable to such bill. Net rate shall apply to all bills paid within ten days from monthly billing date; gross rate shall be applicable thereafter. The above rate is applicable to each residential and commercial consumer per month or for any part of a month for which gas is used at the same location. In addition to the aforesaid rates, Company shall have the right to collect such reasonable charges as are necessary to conduct its business and to carry out its reasonable rules and regulations in effect. SECTION 2. The rate set forth in Section 1 may be changed and amended by either the City or Company furnishing gas in the manner provided by law. Service hereunder is subject to the orders of regula- tory bodies having jurisdiction, and to the Company's Rules and Regula- tions currently on file in the Company's office. Each installation shall be subject to periodic inspections to determine the pro - per maintenance and the nature or strength of the drainage liqu- ids after having passed through the sand trap, if it is found that improper maintenance, or prohibited substances are being depo- sited into the sand trap, then written notice shall be given the owner, or operator to correct such conditions. If' these conditions prevail after such notice the City has the right to terminate city water and sewer services to the place of business untill such prohibited conditions are cobrected. All floor drains in areas adjacent to the sand trap and subject to sand, oil, or grease being washed into them shall terminate into the primary section of the sand trap. Other interceptors or separatots shall be installed if in the judgment of the Plumbing Inspe9tor they are necessary to control liquid wastes that might be harmful to the building drain- age systems, the city sewer treatment plant or any of its processes. Anproval of such additional devices shall be handled on an indiv- idual basis due to the various types of chemicals, acids, or oils that may be encountered.
