A special meeting of the City Council of the City of Stephenville was called to order by the.Mayor with the following uembers present: Mayor Joe F. Cummings Councilmembers: John E. Pollan G. A. Swindle William G. Brede James L. McSwain Floyd Gordon and with the following councilmembers absent: Councilmen Charles Riggins, Ray Reynolds, and David Clayton. City Administrator Kurt J. Ackermann, City Secretary Joyce Pemberton, City Attorney Joseph Chandler, Director of Finance Charlene Young, and members of the press . were also present. ITEM I: A PUBLIC HEARING AND CONSIDERATION FOR PASSAGE OF THE 1983 -84 CITY BUDGET. Mayor Cummings opened the meeting for a public hearing to hear discussion of the proposed budget for the fiscal year 1983 -84. City Administrator Kurt Ackermann explained the increases in the proposed budget of $4,443,512 as compared with the $3,556,329 budget of last year. There being no one present wishing to convent on the proposed budget, Mayor Cummings closed the public hearing. After some discussion, Councilman Swindle moved approval and passage of the following ordinance approving the budget for the fiscal year 1983 -84. The motion was seconded by Councilman Pollan. The ration carried by the following vote: AYES: All nenbers present voted aye. NOES: None to il"D Mkffis AN ORDINANCE APPROVING THE BUDGET SUBMITTED BY THE CITY ADMMSTRATOR OF THE CITY OF STEPHENVILLE FOR THE FISCAL YEAR OCTOBER 1st, 1983 TO SEPTEMBER 30th, 1984. Councilman Pollan moved passage and approval of the following ordinance levying a total tax of $.269 on each $100.00 valuation of all taxable property, both real and personal, located in the City of Stephenville and appearing on the assessment rolls for the year 1983 at 100% of value. Councilman Brede seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None E•010 AN ORDINANCE LEVYING ADVALOREM TAXES ON BOTH REAL AND PERSONAL PROPERTY IN THE CITY OF STEPHENVILLE FOR THE YEAR 1983; PROVIDING FOR OCCUPATION TAXES ON EVERY PERSON, FIRM OR CORPORATION PURSUING ANY OCCUPATION, PRO- FESSION OR BUSINESS IN THE CITY OF STEPHENVILLE. Mayor Cummings advised the City Administrator that several members of the Council had indicated their desire to consider, in next year's budget, some of the administrative personnel who are doing such outstanding jobs and whose salaries are, according to the survey submitted with this year's budget proposal, considerably below the average. The Council wants to try to get those in line next year. 290A AN ORDINANCE Approving the budget submitted by the City Administrator of the City of Stephenville for the fiscal year October 1st, 1983 to September 30th, 1984. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: SECTION 1: That the budget prepared by the City Administrator of Stephenville for the City of Stephenville for the uear commencing October 1st 1983, through and including September 30th 1984, is hereby approved and ordered filed with the City Secretary of the City of Stephenville. Cummings, Mayor ATTEST: C ty S cretary M 290E AN ORDINANCE Levying Advalorem Taxes on both real and personal property in the City of Stephenville for the year 1983; providing for occupation taxes on every person, firm or corporation pursuing any occupation, profession or business in the City of Stephenville. BE IT ORDAINED, by the City Council of the City of Stephenville; That the direct and advalorem municipal taxes by, and the same are hereby levied for the calendar year, 1983 upon the $100.00 valuation of all property both real and personal, in the City of Stephenville, subject to taxation for the said year under the constitution of Stephenville adopted on the 4th day of April, 1961, for the purpose and at the rate hereinafter specified. section 1: That a total tax of $.269 shall be levied on each $100.00 valuation of all taxable property, both real and personal, located in the City of Stephenville and appearing on the assessment rolls for the year 1983 at 100% of value.. SECTION 2: That $.269 of the above total tax is hereby specifically levied for current expenses and general municipal purposes of the City of Stephenville; that none of the above tax is levied for payment of the principal and interest on, and services on the outstanding bonded indebtedness of the City of Stephenville. BE IT FURTHER ORDAINED by the City Council of the City of Stephenville, that there is hereby levied, and there shall be collected from every person, firm or corporation pursuing any occupaiton, profession or business in the City of Stephenville which is taxable by law, the full Amount of occupation taxes and the charter of the City of Stephenville. CUMMINGS, Mayor of the CITY OF STEPHENVILLE, be, and he is hereby authorized to execute a special warranty deed to Joe M. Stasey, Glenda I. Stasey, Wayne W. Morehead and Melva V. Morehead on the following described land: 0.011 acre out of the John Gaylor Survey, A -289, and being part of a certain net acreage tract of 12.90 acres in the John Gaylor Survey, A -289, described in Addendum to Contract of Sale dated February 14, 1975, made by Wayne W. Morehead and Joe M. Stasey, recorded in Volume 527, page 633, Deed Records of Erath County, Texas, and said 0.011 acre being described as follows: BEGINNING at an iron rod set in the northeasterly right of way of Highway No. 67 and southwesterly line of said 12.90 acre tract, from which point the NW corner of said 12.90 acres at SW corner of a 0.45 acre tract conveyed to J. R. Garrett by deed recorded in Volume 312, page 351, said records, bears N 691 31' W, 36 feet for the west corner of this tract; THENCE S 69° 31' E, with highway right of way, 20 feet to an iron rod set for the south corner of this tract; THENCE N 200 29' E, 25 feet to an iron rod set for the east corner of this tract; THENCE S 69° 31' W, 20 feet to an iron rod set for the north corner of this tract; THENCE S 20° 29' W, 25 feet to the place of beginning, containing 0.011 acre. Euge ngotman e ublic rvy�No o f Texas. (D- 291 ITEM II: CONSIDER RESOLUTION EXECUTING SPECIAL WARRANTY DEED TO JOE M: STACEY. City Administrator Kurt Ackermam explained that this deed was for a well site that the city bought from Mr. Stacey, then the site was not used and the city traded that site for another on Mr. Stacey's property and we forgot to deed the first site back to Mr. Stacey. Councilman Swindle moved passage of the following resolution executing a special warranty deed to Joe M. Stacey deeding a water well site back to him when the city had to move to another well site on Mr. Stacey's property due to drilling problems. Council- man Gordon seconded the motion. The unction carried by the following vote: AYES: All members present voted aye. NOES: None Mayor Cummings adjourned the open meeting and called the Council into executive session to consider pending litigation as provided in the Open Meetings Law, V.T.C.S. Article 6252 -17, Section 2(e). ?! Mayor Cummings reconvened the Council in open session and adjourned the meeting with no action being taken on matters discussed in executive session.
