MINUTES OF THE CITY COUNCIL
OF THE
CITY OF STEPHENVILLE, TEXAS, HELD ON
FRIDAY, JANUARY 14, 1983 - 3:00 P.M.
A called meeting of the City Council of the City of Stephenville was called to
order by the Mayor with the following members present:
Mayor Joe F. Ciu[mTi_ngs
Councilman G. A. Swindle
Councilman John E. Pollan
Councilman William G. Brede
Councilman Charles Riggins
Councilman E. W. Ferguson
and with the following members absent: Councilmen Ray Reynolds and David Clayton.
City Administrator Kurt J. Ackermann, City Secretary Joyce Pemberton, and the
Director of Finance Charlene Young were present also.
Councilman Riggins moved that the following RESOLUTION OF RESPECT be adopted:
WHEREAS, RAYMND ANDERSON served the City of Stephenville as a member of
the City Council for more than 15 years; and
WHEREAS, he was a diligent and conscientious City Councilman who always
carefully considered all matters coming before the Council; and
WHEREAS, his efforts were thorough and his decisions were made in the best
interests of the people of the City of Stephenville; and
WHEREAS, he was held in the highest respect and esteem by the other members
of the City Council;
NOW THEREFORE, BE IT RESOLVED that this City Council hereby express its
appreciation for the long, capable and tireless service of
RAYMOND ANDERSON on behalf of the City o£ Stephenville and its
citizens by the passage of this Resolution which shall be spread
upon the minutes of this body and that a copy hereof be delivered
to his surviving wife, Mrs. Johnie Anderson.
PASSED AND APPROVED THIS 14th day of January, 1983.
Signed by the Mayor and all members of the Council.
Councilman Brede seconded the motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None
ITEM I: A PUBLIC HEARING ON A PROPOSAL TO INCREASE TOTAL TAX REVENUES FROM

Mayor Cummings opened the floor for a public hearing the purpose of which is to
hear the pros and cons of the proposed tax rate for the city for the coming taxing year.
City Administrator Kurt Ackermnn reported that the city is proposing a tax rate
of 26.40 per $100. of assessed value. This would represent an increase of approximately
$29,634. in ad valorem tax revenue.
No one addressed the Council in favor of the proposed tax rate.
Mr. Jim McSwain, 888 Lydia, addressed the Council stating that he did not know if
he was really opposed to the proposed tax rate, but that he just did not understand the
amount his taxes would be if he used the proposed rate of 26.4 per $100 assessed value.
Last year his taxes were $68.85 and, using the proposed ta_x rate, his taxes for this
year would be $137.81. He said with his taxes doubling others have to be less, but he
has not heard of anyone whose taxes were going down. He said he just did not understand
where this difference occurs.

Mayor Cummings commented that his taxes had increased also. He had just
assumed that the people whose taxes had decreased were just not saying anything.
That the Council was dealing with the total valuation and applying a tax rate to
that total to generate the revenues needed to operate the city.
Mr. Jack Heath, 878 Lydia, presented the Council with a table of "1982
Property Tax Calculations" and a "1982 Tax Levy Calculation ". Mr. Heath stated
that "if you work with figures you can do about anything you want to with those
figures." He said, properly calculated, the taxable value of Stephenville at
26.4¢ will give the City of Stephenville $80,849 in increased tax levy. He said
his question was "Are we misinforming the public ?" Have we misinformed the public ?"
City Administrator Kurt Ackermann advised Mr. Heath that the city does not
calculate the budget based on 1007 collections of taxes, only on 95% of collections
is used in budget calculations.
Mr. Heath said what he is talking about is total taxes levied and it is an
$80,849 increase not $29,634. - Using the figure based on 957 collections it would
be much more than $29,000 total taxes levied. He said he was not complaining about
his taxes. His purpose in being here was to let the people of Stephenville understand
that they are not getting a tax break as the Peveto Bill said they would and that 85%
of them voted for it because next year you can add 3% without public hearing and within
10 years, off this $80,000, you will have collected $1,035,000 based on the decision
the Council makes when they set the tax rate. The city is allowed 3% without going
through the public hearing process and would collect $32,000 more. He thinks the City
Council should be responsible enough to the people of Stephenville to "roll back" to
that 3% and let's get on with our business.
There being no one else wishing to address the Council on this issue, Mayor
Cummings closed the public hearing.
Mayor Cummings, with the consent of the Council, called for a special meeting
Tuesday, January 18, 1983 at 1:00 p.m. in Council Chambers at City Hall, 354 N. Belknap,
Stephenville, Texas, for the purpose of setting a tax rate for the City of Stephenville.

LES "BUDDY" FORNES TO THE
Mr. Charles "Buddy" Fornes had requested that the Mayor and Council appoint
another person to serve in his place on the Planning & Zoning Commission.
Mayor Cummings, with the consent of the Council, appointed Dr. Don Beach to
Place 9, for a two year term, on the Planning & Zoning Conanission.
ITEM III: DISCUSSION OF ALLOCATION PROVISIONS FOR AIRPORT T- HANGARS
After discussion, Councilman Pollan moved that the allocation of the new T- hangars
at the airport be on the basis of persons within the city limits have first priority.
The paynent of $60.00 per month for the first eight (8) months be paid in advance to
the City of Stephenville. Councilman Riggins seconded the motion. The motion carried
by the following vote:
AYES: All members present voted aye.
NOES: None
There being no other business to come before the Council, the meeting adjourned
at 3:45 p.m.
