CITY OF STEPHENVILLE, TEXAS, HELD ON
TUESDAY, OCTOBER 23, 1984 - 5:00 P.M.
A called meeting of the City
Stephenville, Texas, was called to
following members present:
Mayor: David Clayton
Councilmembers: Larry Hammett
G. A. Swindle
Ray Reynolds
Council of the City of

and with the following members absent: Charles Riggins.
City Administrator Kurt J. Ackermann, City Secretary Joyce
Pemberton, City Attorney Joseph Chandler, and Director of Public
Works Danny Johnson were also present.
ITEM I: CONSIDER
PROPOSITION II AS

Dr. Joe Autry, retired Vice - President of Tarleton State
Univeriity, addressed the Council in support of Proposition 2 as
an amendment to the Constitution of the State of Texas. Dr.
Autry explained to the Council why this proposition would be of
great benefit to the Tarelton State University and other colleges
and universities of the State.
After discussion, Councilman moved adoption and passage of
the following resolution expressing the Council's support of
Proposition 2 as an amendment to the Constitution of the State of
Texas. Councilman Reynolds seconded the motion. The motion
carried by the following vote:
AYES: All members present voted aye.
NOES: None
RESOLUTION
WHEREAS, in order to provide the State of Texas with a first
class public university system, the State of Texas should
provide a permanent source of funding for all state public
universities not included in the Permanent University Fund;
and
WHEREAS, this amendment would establish a new $100 million
annually dedicated fund for the use of universities outside
The University of Texas System and Texas A & M University
System; and
WHEREAS, certain institutions of the University of Texas
System and the Texas A & M University System not currently
included in the Permanent University Fund would be brought
under this endowment program; and
WHEREAS, the proposed special higher education assistance
fund for construction and related activities would be
created from general revenue to replace the constitutionally
dedicated state ad valorem tax fund which was repealed in
November 1982; and
WHEREAS, uses of both the special higher education
assistance fund and the Permanent University Fund would be
broadened to allow expenditures for repair and rehabilita-
tion of existing buildings, purchase of equipment and
library books and materials, as well as new construction and
land acquisition; and

WHEREAS, the need for modern state -of- the -art laboratory and
teaching equipment in the state's public universities is a
problem of critical magnitude; and
WHEREAS, the amendment provides that the Legislature will
develop formulas for distributing the special higher educa-
tion assistance fund to assure continuing equity; and
WHEREAS, safeguards for responsible review of expenditure of
state funds are incorporated into the proposed constitu-
tional amendment; and
WHEREAS, a viable state public university system will
ensure higher education to all citizens of Texas; and
WHEREAS, this constitutional amendment will be presented to
the voters of the State of Texas on November 6, 1984;
BE IT THEREFORE RESOLVED, that the Mayor and City Council of
the City of Stephenville does, by this Resolution, express
their support of Proposition 2.
PASSED AND ADOPTED this the 23rd day of October, 1984.
ITEM II: CONSIDER FOR AWARD, BIDS RECEIVED FOR WEST LOOP
WATERLINE PROJECT.
Mr. Tony Plumlee presented the bid tabulations for the West
Loop Waterline Project.
The following bids are the four lowest bids received:

After some discussion, Councilman Swindle moved acceptance
of the low bid of $341,056.26 from McKinney Construction Co. for
the West Loop Waterline Project. Councilman Gordon seconded the
motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None
ITEM III: EXECUTIVE SESSION.
Mayor Clayton recessed the open session and called the
Council into executive session as provided in the Open Meetings
Law, V.T.C.S., Articles 6252 -17, Section 2(g), for the purpose of
discussing pending litigation regarding the Elmo Cobb suit.
Mayor Clayton reconvened the Council into open session.
No action was taken on matters discussed in executive
session.

There being no other business to come before the Council,
Mayor Clayton adjourned the meeting at 6:00 p.m.

SPEED ZONE ORDINANCE
AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF
SECTION 167 AND 169 OF ARTICLE XIX, R.C.S. 6701d,
UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON
THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION
UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF,
WITHIN THE CORPORATE LIMITS OF THE CITY OF STEPHENVILLE
AS SET OUT IN THE ORDINANCE: AND PROVIDING A PENALTY
OF A FINE NOT TO EXCEED $200.00 FOR VIOLATIONS OF THIS
ORDINANCE.
WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d,
Uniform Act Regulating Traffic on Highways, provides that whe-
never the governing body of the City shall determine upon the
basis of an engineering and traffic investigation that any prima
facie speed therein set forth is greater or less than is reaso-
nable or safe under the conditions found to exist at any inter-
section or other place or upon conditions found to exist at any
intersection or other place or upon any part of a street or
highway, with the City taking into consideration the width and
condition of the pavement and other circumstances on such portion
of said street or highway, as well as the usual traffic thereon,
said govern body may determine and declare a reasonable and safe
prima facie speed limit thereat or thereon by the passage of an
ordinance, which shall be effective when appropriate signs giving
notice thereof are erected at such intersection or other place or
part of the street or highway.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF STEPHENVILLE, TEXAS:
SECTION 1. Upon the basis of an engineering and traffic investi-
gation heretofore made as authorized by the provisions of Section
167 and 169 of Article XIX, R.C.S. 6710d, Uniform Act Regulating
Traffic on Highways, the following prima facie speed limits
hereafter indicated for vehicles are hereby determined and
declared to be reasonable and safe; and such speed limits are
hereby fixed at the rate of speed indicated for vehicles tra-
veling upon the named streets and highways, or parts thereof,
described as follows:
A. From Station 414 +20 (northwest city limit of Stephenville)
easterly 0.323 mile to Station 431+25 (approximately 2,300'
west of F.M. 988), at 55 miles per hour.
B. From Station 431 +25 easterly 1.883 miles to Station 530 +66
(intersection with S. H. 108), at 40 miles per hour.
C. From Station 530 +66 easterly 0.766 mile to Station 571+10
(east city limit of Stephenville), at 50 miles per hour.
SECTION 2. Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon con-
viction thereof shall be fined in any sum not more than two -
hundred ($200.00) dollars.
This ordinance supersedes all previous ordinances pertaining to
the above referenced highway.
PASSED AND APPROVED THIS 6th DAY OF NOVEMBER, 1984.
