A called meeting of the City Council of the City of Stephenville, Texas, was called to order by the Mayor with the following members present: Mayor: David Clayton Councilmembers: Floyd Gordon William G. Brede G. A. Swindle James L. McSwain Ray Reynolds Larry Tatum City Administrator Kurt Ackermann, City Secretary Joyce Pemberton, Director of Public Works Danny Johnson, P & I Clerk Betty Chew, Building Inspector Gary Nabors, Members of the Planning and Zoning Commission, and many others were present. TEM I: PUBLIC HEARI NEW ZONING Mayor Clayton opened the floor for a public hearing to hear comments on the proposed new zoning ordinance. Chairman of the Planning & Zoning Commission addressed the Council giving the Council the background of the preliminary work and planning that has gone into the Commission's presentation of a proposed new zoning ordinance and asked that the Council approve this proposed ordinance as presented. Seventeen persons addressed the Council regarding different aspects of the proposed ordinance. Mayor Clayton said it was obvious from the discussion that more discussion and work is needed before final action is taken. Councilman Swindle moved that the Council delay any formal action on the proposed zoning ordinance for a minimum of 90 days. Councilman Brede seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None. There being no one else present wishing to comment on this issue, Mayor Clayton closed the public hearing. II: HEAR RE NE YOUNG Director of Finance Charlene Young presented the following bids for the city's property and liability insurance: 1. Texas Municipal League -------------- $49,675.00 2. Arthur J. Gallagher ----------------- $44,820.00 3. Employers of Texas ------------------ $76,868.00 Mrs. Young advised the Council that the Mr. Fred Gillette, consultant for Risk Management Services, recommended the Arthur J. Gallagher bid and indicated it might be to the city's benefit to take advantage of this bid for a three year period rather than just one year because the cost of insurance is increasing so rapidly. After discussion, Councilman McSwain moved to accept the low bid of $44,820.00 from Arthur J. Gallagher Co. for property and liability insurance for three years. Councilman Reynolds seconded the motion. The motion carried by the following vote: M AYES: NOES: City Council Minutes 01/22/85 - Page 2 of 2 Councilmen Brede, Gordon, McSwain, Reynolds, and Tatum. Councilman Swindle. ITEM III: CONSIDER RESOLUTIO SUPPORTING APPLICATION TO TEXAS WATER COMMISSION. Councilman Swindle moved adoption of a resolution supporting application to Texas Water Commission for additional water rights on the Paluxy River. Councilman Gordon seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None. There being no other business to come before the Council, Mayor Clayton adjourned the meeting at 9:10 p.m. ATTEST: Cit Secretary L/ Mayo David layton .1/ RESOLUTION WHEREAS, the City of Stephenville has determined that existing groundwater supplies will not be adequate to meet future needs; WHEREAS, the City of Stephenville has made joint Application No. 4237 for a permit for water rights from the Paluxy River with the City of Granbury, the City of Glen Rose, and Hood and Somervell Counties; WHEREAS, the City of Granbury and Hood County have elected not to participate in the Paluxy Project at this time; WHEREAS, the remaining parties have determined that an additional joint application for a permit for water rights from the Paluxy River should be made in order to obtain the full dependable yield of the Paluxy Project as the same may be determined by the Texas Water Commission; WHEREAS, the parties to the additional application have agreed that the application should be filed in the name of the City of Stephenville on behalf of and for the benefit of all of the remaining parties to wit: The City of Stephenville, the City of Glen Rose, and Somervell County; and, WHEREAS, the parties to the additional application have agreed that should a permit be granted pursuant to the application, the water so appropriated will be allocated among and between the parties as follows: City of Stephenville 5904 acre -feet per annum City of Glen Rose 1171 acre -feet per annum Somervell County 1171 acre -feet per annum NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stephenville, Texas, that: (1) the City of Stephenville will apply for a water permit to appropriate public water from the Paluxy River on its own behalf and on behalf of and for the benefit of the City of Glen Rose, and Somervell County. (2) the City Administrator is hereby authorized and directed on behalf of the City of Stephenville to file the aforesaid additional application with the Texas Water Commission seeking a permit to build a dam on the Paluxy River and to appropriate water from the reservoir thereby created, to appear and arrange for appearances of persons representing the applicants at the hearings on the application, and to otherwise direct the prosecution of the application on behalf of the City of Stephenville, the City of Glen Rose, and Somervell County. Location of Structure: (1) Watercourse: Paluxy River, tributary of Brazos River, Brazos River Basin, (2) Location from County Seat: 3.2 miles in a West Northwest direction from Glen Rose, Somervell County, Texas. (3) Station 0 +00 on the centerline of the dam is 240 001, NE, 10,900 feet from the Southwest corner of Galveston County School Land Original Survey No. A -17, Abstract No. 37, in Somervell County, Texas. (4) Location of Dam: Galveston County School Land Original Survey No. A -17, Abstract No. 37, in Somervell County, Texas. C. Reservoir: (1) Acre -feet of water impounded by structure at normal maximum operating level: 99,674 (2) Surface area in acres of reservoir at normal maximum operating level: 3,848 D. This is not a U.S. Soil Conservation Service floodwater- retarding structure. E. The drainage area above the dam is 361 square miles. 3. Appropriated water will be used as follows: Acre -feet Purpose Place of Use Per Annum (1) Domestic and Erath, and 8,246 Municipal Somervell Counties (2) Recreation Reservoir -0- (3) Construction At dam site during -0- construction Appropriated water will be used for domestic and municipal water supply within the Brazos River basin in Erath and Somervell Counties. Water will be distributed by the proposed Paluxy Water Authority or by the named municipal water supply systems and by various rural water supply corporations allocated in the following amounts: City of Stephenville 5904 acre -feet per annum Somervell County 1171 acre -feet per annum City of Glen Rose 1171 acre -feet per annum B. Diversion: (1) Location of point of diversion 170 45' NE, 12,800 feet from the Southwest corner of Galveston County School Land Original Survey No. A -17, Abstract No. 37, in Somervell County, Texas. (2) Location from nearby town: 3.2 miles in a West Northwest direction from Glen Rose, a nearby town shown on attached vicinity map. (3)- The diversion will be: From a proposed on- channel reservoir. (4) Rate of Diversion: a. Maximum 24,306 gpm b. Diversion Facility: By gravity: Other method - Pipe attached to outlet works. See plans attached with Application No. 4237. C. Return Water or Return Flow: Water which is diverted but not consumed as a result of the above stated use will be returned to the Brazos River or its tributaries at various points: (1) No return flow is anticipated from the Somervell County area. This area has septic tank systems. (2) 3,542 acre -feet per annum of return flow is estimated from the City of Stephenville. The City of Stephenville's return flow will be to the Bosque River adjacent to its present sewage treatment facility. (3) 703 acre -feet per annum of return flow is estimated from the City of Glen Rose. The City of Glen Rose's return flow will be to the Paluxy River adjacent to its current sewage treatment facility, (4) The foregoing volumes of return flow are projected for the year 2030. -2 4,1 D. Surplus Water: None 4. General Information: A. The proposed works will be located on the land of owners of property in the vicinity of reservoir. Applicant has the power of condemnation. B. No lands are proposed to be irrigated. C. If a permit for the appropriation is granted, either in whole or in part, construction works will be begun within 2 years after such permit is issued. The proposed work will be completed within 5 years from the date of issuance of permit. 5. Maps, plats, and drawings to accompany this application as required by the Board's Rules were filed with Application No. 4237 and are incorporated herein by reference for all purposes.
