The special meeting of the City Council of the C Texas, was called to order by the Mayor with the present: Mayor: David Clayton Councilmembers: Bob Self Larry G. A. Swindle (late) James Ray Reynolds Larry ity of Stephenville, following members Hammett L. McSwain Tatum and with the following members absent: Wm. G. Brede and Allen Horne. Also present were City Administrator Kurt J. Ackermann, City Secretary Joyce Pemberton, City Attorney Joseph Chandler, Director of Finance Charlene Young, and Director of Public Works Danny Johnson. ITEM I: A PUBLIC HEARING TO CONSIDER THE PROPOSED BUDGET FOR FISCAL YEAR 1986. City Administrator Kurt Ackermann presented the proposed budget for fiscal year 1986. Mr. Ackermann advised the Council the proposed budget totals $5,160,413.00 which is an increase of $424,729.00 or 8.9% over the preceding year. Mr. Ackermann also stated that the Effective Tax Rate Ordinance is not included in the proposed budget due to the Erath County Central Appraisal District not having all the information available at this time. Mayor Clayton opened the floor for a public hearing to con- sider the proposed budget for fiscal year 1986. There being no one present wishing to comment on the pro- posed budget, Mayor Clayton closed the public hearing. Councilman Reynolds moved approval of AN ORDINANCE MAKING APPROPRIATIONS FOR THE SUPPORT OF THE CITY OF STEPHENVILLE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1985 AND ENDING SEPTEMBER 30, 1986 AND ADOPTING THE ANNUAL BUDGET OF THE CITY OF STEPHENVILLE FOR THE 1985 -86 FISCAL YEAR. Councilman Hammett seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None The Mayor and Council commended Director of Finance Charlene Young for her efforts and work in obtaining the Certificate of Conformance in Financial Reporting for the fourth consecutive year from the Municipal Finance Officers Association. ITEM II: CONSIDER CONTRACT WITH ERATH COUNTY FOR ASSE City Administrator Kurt Ackermann advised the Council that the contract with Erath County for assessment and collec- tion of taxes is essentially the statutory requirements that Erath County will perform in the collection of the city's advalorem taxes. The Mayor and Council discussed the above referenced contract, Section II (7) (8) (9), and Section III (B), with Jennifer Schlicke, County Tax Assessor /Collector. After discussion, Councilman Self moved that City Attorney Chandler draw up a contract specifiying the City's needs "MI for the assessment and collection of the City's advalorem taxes. Councilman Reynolds seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None CONSIDER PROPOSAL BY GY JR., P.C. WITH Mr. Edwin R. York, Jr., P.C., with the law firm of Calame, Linebarger & Graham of Corsicana, Texas, addressed the Council presenting a proposal for legal services for delinquent tax accounts. Mr. York advised the Council that his firm has represented the City of Stephenville in collecting delinquent property taxes since May 1984 and would like to continue in this capacity. After discussion, Councilman Swindle moved to accept the contract presented by Mr. York for the collection of delinquent property taxes beginning September 1, 1985 ending August 31, 1987. Councilman Hammett seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None CONSIDER PITAL Councilman Hammett, reporting for the committee, said the committee had asked Director of Public Works Danny Johnson to submit some projects with estimated costs. Mr. Johnson had presented the following "possible capital improvement projects ": POSSIBLE CAPITAL IMPROVEMENT PROJECTS WATER FUND Project by Ranking Estimated Cost 1. Water Supply Lines to Tarleton, Pass, and Cook Well Sites 2. South Outfall Sewer Line 3. East Loop Sewer Line 4. 6 Additional Water Wells in Future Well Field 5. Supply Line for New Wells in Future Well Field Toward Paluxy 6. Update automation at Pump Stations 7. Replace Paddock Pump Station $ 235,000 - $550,000 $1,000,000 $ 250,000 $1,200,000 $1,000,000 $ 450,000 $ 200,000 8. Complete NE Water Loop $ 500,000 $4,835,000 - $5,150,000 Councilman Hammett said the committee unanimously supported Items 1, 2, 3, 6, 7, and 8. The committee felt Items 4 and 5 could possibly be deleted as they are not sure what the water consumption will be with the new water rates. These 160 two Items could be considered again in a year or two. Councilman Hammett said the committee was looking at a bond issue of approximately $3.5 million. Councilman McSwain said the committee was not sure how soon the money would be needed. They were not sure it would not be better in the long run to do the financing as they went with increased water rates over a 3 -year period and save the interest paid on a bond issue for 20 years. Mr. Jack Gray, financial consultant, representing Schneider, Bernet, Hickman, Inc., presented the Council with copies of a "Debt Service Comparison Summary" and "Water and Sewer Bonds & Certificates (Comparison Schedule) ". Ater discussion, Councilman Hammett moved to consider a $3.5 million bond issue on new money for Water & Sewer Improvements. Councilman Tatum seconded the motion. The motion carried by the following vote: AYES: Councilmen Self, Hammett, Swindle, McSwain, and Tatum. NOES: None ABSTAIN: Councilman Ray Reynolds. There being no other business to come before the Council, Mayor Clayton adjourned the meeting at 4:10 p.m. 4 David Clayton, Mayor My,Aecretary 16-7 /70 CONTRACT FOR THE COLLECTION OF DELINQUENT TAXES THE STATE OF TEXAS COUNTY OF ERATH This contract is made and entered into by and between the City of Stephenville acting herein by and through its governing body, hereinafter, called First Party, and EDWIN R. YORK, JR., P.C., IN ASSOCIATION WITH CALAME, LINEBARGER AND GRAHAM, P. 0. Box 1916, Corsicana, Texas 75110, hereinafter called Second Party. I. First Party agrees to employ and does employ Second Party to enforce by suit or otherwise the collection of all delinquent taxes, penalty and interest owing to First Party, provided current year taxes falling delinquent within the period of this contract shall become subject to its terms upon the following conditions: (1) Taxes that become delinquent during the terms of this contract that are not delinquent for any prior years, become subject to the terms of this contract on July 1st of the year in which they became delinquent; and taxes that become delinquent during the term of this contract on property that is delinquent for prior years shall become subject to its terms on the first day of delinquency. II. Second Party is to call to the attention of the collector or other officials any errors, double assessments, or other discrepancies coming under his observation during the progress of the work and is to intervene on behalf of First Party in all suits for taxes hereafter filed by any taxing unit on property located within its corporate limits. III. Second Party agrees to make progress reports to First Party on request, and to advise First Party of all cases where an investigation reveals taxpayer to be financially unable to pay their delinquent taxes. IV. First Party agrees to pay to Second Party as compensation for services required hereunder fifteen (15 %) percent of the amount collected of all delinquent taxes, penalty an interest of the years covered by this contract actually collected and paid to the collector of taxes during the term of this contract as and when collected. All compensation above provided for shall become the property of the Second Party at the time pay- ment of taxes, penalty and interest is made to the collector. In consideration of the terms and compensation herein stated, Second Party hereby accepts said employment and undertakes the performance of this contract as above written. VI. Either party to this contract shall have the right to terminate said contract for cause, giving said other party not less than thirty (30) days written notice of such intention to terminate, together with a statement of the cause or causes for such termination. In case such termination is initiated by First Party, Second Party shall be entitled to receive compensation due said Second Party up to the date of said termination.
