HomeMy WebLinkAbout1993-08-17 - Special City CouncilMINUTES OF SPECIAL MEETING City of Stephenville - City Council TUESDAY, AUGUST 17, 1993 - 5:30 p.m. The City Council of the City of Stephenville, Texas, convened in special session on August 17, 1993 at 5:30 p.m., in the Council Chambers at City Hall, 354 N. Belknap, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Article 6252 -17, Section 3A, V.T.C.S., with the following members present, to wit: Mayor: Lavinia Lohrmann Mayor Pro Tem: Scott Evans Councilmembers: Alan Nix Donald L. Zelman Sam Taylor II John Wooley William F. (Bill) Johnson Bill Bailey Absent: None Others Attending: Don Davis, City Administrator Joyce Pemberton, City Secretary Randy Thomas, City Attorney I. CALL TO ORDER: Mayor Lavinia Lohrmann called the meeting to order and declared a quorum present. II. At 5:30 p.m., Mayor Lohrmann called the Council into EXECUTIVE SESSION Pursuant to Article 6252 -17, §2(g), Texas Revised Civil Statutes, the Council shall enter into executive session to discuss the following: A. Personnel: 1. Consider the salary of City Administrator 2. Consider the salary of Utilities Director 3. Consider the salary of Fire Chief 4. Consider the salary of Police Chief 5. Consider the salary of Community Service Director 6. Consider the salary of Finance Director 7. Consider the salary of Personnel Director 8. Consider the salary of City Secretary 9. Consider the salary of Community Development Director 10. Consider the reassignment of duties for the Landfill Superintendent. III. RETURN TO OPEN SESSION - 7:30 p.m. A. Consider items listed under Item II (executive session), as necessary Councilman Evans made the motion, seconded by Councilman Bailey, to apply the following pay raises to the executive payroll: 1. City Administrator . ............................... 0% 2. Utilities Director . ............................... 0% 3. Fire Chief ......... ............................... 0% 4. Police Chief ....... ............................... 2% 5. Community Service Director ........................ 2% 6. Finance Director ... ............................... 2% 7. Personnel Director . ............................... 0% 8. City Secretary ..... ............................... 0% 9. Community Development Director .................... 5% The motion carried by the following roll call vote: AYES: Councilmen Alan Nix, Don Zelman, Sam Taylor, John Wooley, Scott Evans, Bill Johnson, and Bill Bailey. NOES: Mayor Lavinia Lohrmann Councilman Evans made the motion, seconded by Councilman Bailey, to create a Community Development Inspection position, which will be a pilot program for six (6) months and is already in the budget. The motion carried UNANIMOUSLY by a roll call vote. IV. PUBLIC HEARING TO CONSIDER BUDGET FOR THE FISCAL YEAR 1993 -94. Mayor Lohrmann opened the floor for a public hearing to consider comments regarding the budget for the City of Stephenville for the fiscal year 1993 -94. THOSE IN SUPPORT OF THIS ISSUE: None THOSE OPPOSED TO THIS ISSUE: Jane Pratt, 1160 W. Pecan St., presented some pie charts to the Council; she commented that the pie charts show that the total budget in 1986 -87 was less than personnel costs were last year. She has also looked at the tax rolls and what was received or budgeted from 1986 -87 in property and sales tax there was $2, 095,000; in 1992 -93 $2,975,000, which is an increase of less than $900,000; salaries in the same time period have gone up in excess of $1,000,000. She said she hoped the Council will keep this in mind when considering next year's budget. When all of the sales taxes and all of the property tax increases have to go to pay salaries, maybe we need to look at something. Don Davis, City Administrator, advised the Council that after the budget work session last week, it was determined that the City of Stephenville will not be involved, at least financially, with the D.A.R.E. program this next year. Included in the proposed budget was $36,000 in revenue /grant monies set aside for the D.A.R.E. program. We have a like $36,000 in our expenses. Due to the fact we will not be involved in that program next year, we recommend the removal of $36,000 from revenue and $36,000 from expense. There being no one else wishing to address this issue, Mayor Lohrmann closed the public hearing at 7:50 p.m. V. CONSIDER AN ORDINANCE ADOPTING THE BUDGET FOR THE FISCAL YEAR 1993 -94 Councilman Nix said he would like to thank the staff for the work they have done in their preparation of the budget and they are to be commended in bringing the Council the programs and the things they have. We had the money to do some of these things this year. They went through the list of priorities that the Council had helped to establish and, by doing that, they made our job much easier. Staff is to be commended and he appreciated that because it made the Council's work a lot easier as they worked on the budget. Councilman Bailey commented that he agreed with Mr. Nix. Councilman Nix made the motion, seconded by Councilman Johnson, to approve Ordinance No. 1993 -26; AN ORDINANCE MAKING APPROPRIATIONS FOR THE SUPPORT OF THE CITY OF STEPHENVILLE, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1993, AND ENDING SEPTEMBER 30, 1994, AND ADOPTING THE ANNUAL BUDGET OF THE CITY OF STEPHENVILLE FOR THE 1993 -94 FISCAL YEAR. Noting the change of the $36,000 to be deleted from the revenues and expenses, due to the change in the D.A.R.E. Program. The motion carried UNANIMOUSLY by a roll call vote. VI. CANVASS THE ELECTION RETURNS OF THE AUGUST 14th SPECIAL ELECTION. Mayor Lohrmann appointed Bill Bailey, chairman, Bill Johnson and Scott Evans as a committee to canvass the election returns of the August 14 special election. Councilman Bailey reported that the Committee certified that the following is a total of all the votes received by each candidate: FOR COUNCIL, PLA BARBARA TERRELL_ BEE BENTLEY BILLY BOB HODGES GARY D. BENTON CE 6 202 108 217 58 5 7 After the reading of the Resolution canvassing the returns and declaring the results of the City Special Election on August 14, 1993, Councilman Sam Taylor made the motion, seconded by Councilman Scott Evans, to pass and approve Resolution No. 93 -10, declaring Billy Bob Hodges duly elected to the City Council, Place 6. The motion carried UNANIMOUSLY. VII. ADMINISTER THE OATH OF OFFICE TO NEW COUNCIL MEMBER. - 70 - Joyce Pemberton, City Secretary, administered the Oath of Office to Billy Bob Hodges, newly elected Councilmember to Place 6. VIII. ADJOURN. There being no other business to come before the Council, Mayor Lohrmann adjourned the meeting 8:30 p.m. ATT Lavi ohrmann, Mayor 12 &�� ce Pefterton, City Secretary - 71 - ORDINANCE NO. 1992 -26 AN ORDINANCE MAKING APPROPRIATIONS FOR THE SUPPORT OF THE CITY OF STEPHENVILLE, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1993, AND ENDING SEPTEMBER 30, 1994, AND ADOPTING THE ANNUAL BUDGET OF THE CITY OF STEPHENVILLE FOR THE 1993 -94 FISCAL YEAR. WHEREAS, the budget for the fiscal year beginning October 1, 1993, and ending September 30, 1994, was duly presented to the City Council by the City Administrator and a public notice was published in the Stephenville Empire Tribune; said public hearing was held according to said notice. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: SECTION 1. That the appropriations for the fiscal year beginning October 1, 1993, and ending September 30, 1994, for the support of the general government of the City of Stephenville, Texas, be fixed and deter- mined for said terms in accordance with the expenditures shown in the City's fiscal year 1993 -1994 budget. SECTION 2. That the budget is hereby approved in all respects and adopted as the City's budget for the fiscal year beginning October 1, 1993 and ending September 30, 1994. PASSED AND APPROVED this the 17th day of August, 1993. There came to be considered the returns of an election held on the 14 day of , August, 1993 for the purpose of electing the hereinafter named official, and it appearing from said returns, duly and legally made, that there were cast at said election 601 valid and legal votes; that each of the candidates in said election received the following votes: CITY COUNCIL, PLACE 6 Barbara Terrell 202 Bee Bentley 108 Billy Bob Hodges 217 Gary D. Bills 58 Scott Duane Johnson 5 Robert Houston Benton 7 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: That said election was duly called; that notice of said election was given in accordance with law, and that said election was held in accodance with law, and that: Billy Bob Hodges was duly elected to City Council, Place 6; Said above -named party is hereby declared duly elected to said respective office subject to taking the oath of office as provided by the laws of the State of Texas and the Charter of the City of Stephenville, Texas.
