City of Stephenville - City Council
TUESDAY, JANUARY 18, 1994 - 5:30 P.M.
The City Council of the City of Stephenville, Texas, convened in
special session Tuesday, January 18, 1994, at 5:30 p.m., in Council
Chambers at City Hall, 354 N. Belknap Street, with the meeting
being open to the public and notice of said meeting, giving the
date, time, place and subject thereof, having been posted as
prescribed by Article 6252 -17, Section 3A, V.T.C.S., with the
following members present:

I. CALL TO ORDER.
Mayor Lavinia Lohrmann called the meeting to order and
declared a quorum present.
II. CHAMBER OF COMMERCE - Hotel /Motel Tax Report.
Robert Defer, Director of the Chamber of Commerce,
presented the Hotel /Motel Tax Report and the 1994 budget.
After some discussion, Councilman Nix moved to accept the
Chamber of Commerce's 1994 budget, as presented. Seconded
by Councilman Taylor. Motion carried UNANIMOUSLY.
III. COMMUNITY CLEAN -UP.
Don Davis, City Administrator, presented a list of
structures in town that have been removed. He also showed
a video of some city -owned property that has been cleaned
up. The City will be reimbursed for the demolition of the
house on N. Clinton Street. We are cleaning up at the
cemetery also. We are doing all this prior to closing of

the landfill.
Mr. Davis advised he was making two proposals for the
Council to consider: 1) offer an encouragement to our in-
town residents to do some additional clean -up by waiving
the landfill fee for any resident that wants to make use
of the landfill; and 2) those persons who wish to employ
a contractor to do some of this work, we will offer a
"free pass" to that individual, so that the contractor
could take that load to the landfill and have the gate
fee waived. He said this helps clean up the community,
which is the first objective, and also, will take advantage
of the landfill space we have, which will curtail or
eliminate us having to buy dirt to fill in the cell when we
do close the landfill.
After some discussion, Councilman Taylor made the motion to
waive the landfill gate fee for residents upon proof of
residency and approve the free pass program for those
residents who choose to use contractors. Seconded by
Councilman Wooley. Motion carried UNANIMOUSLY.
IV. WATER PLANNING COMMITTEE REPORT.
Councilman Evans, Chairman of the Water Planning Committee,
presented the Committee's report.
A. Change Orders #1 and #2 - Wastewater Treatment Plant.
Councilman Evans made the motion to approve Change Order
#1 by adding an air conditioning unit to the new lift
station at an additional cost of $4,050.00. Councilman
Johnson seconded the motion. Motion carried
UNANIMOUSLY.
Councilman Evans made the motion to approve Change Order
#2 by replacing four shafts which turn the disks at the
aeration basin, at a cost of $11,097.50 Motion carried

B. Employ LBG - Guyton Associates - Update of Stephenville's
Ground -Water Supplies.
Councilman Evans made the motion to hire LBG - Guyton
Associates to update the 1983 Ground -Water Report at a
cost of $39,800. Seconded by Councilman Johnson.
Motion carried UNANIMOUSLY.
V. PUBLIC HEALTH & SAFETY COMMITTEE REPORT.
Counilman Don Zelman, Chairman of the Public Health &
Safety Committee, presented the Committee's report.

After some discussion, Councilman Zelman moved to authorize
the City's participation in the area arson investigative
task force and to approve the interlocal government
agreement with Mineral Wells, Weatherford, Palo Pinto
County and Parker County, as recommended by the Committee.
Councilman Hodges seconded the motion. Motion carried
UNANIMOUSLY.
Councilman Zelman made the motion to award the bid for the
purchase of a new fire truck to Emergency Vehicles of Texas
in the amount of $141,000 and that equipment items 1 thru
25 and item 27 be purchased from Casco Industries in the
amount of $21,989 for a total of $163,029. Seconded by
Councilman Wooley. Motion carried UNANIMOUSLY.
Counciman Zelman made the motion to transfer $13,029 from
Unrestricted Reserves into the Fire Department to cover the
difference between the budgeted amount ($150,000) and the
total outlay ($163,029) for this fire truck and equipment.
Seconded by Councilman Wooley. Motion carried UNANIMOUSLY.
VI. CONSENT AGENDA:

Councilman Evans made the motion to approve the Consent
Agenda, as presented. Seconded by Councilman Zelman.
Motion carried UNANIMOUSLY by a roll call vote.
VII. DISCUSS CITY MOTTO.
Mayor Lohrmann reminded the Council that at the last
meeting Joe Sawyer was here suggesting that we approve
a city motto saying "CITY OF CHAMPIONS" and during
discussion, it was decided that a committee be formed
consisting of members of the council and various other
organizations in the city.
Mayor Lohrmann appointed Councilmen Scott Evans, John
Wooley and Don Zelman as the City's representatives.
Mr. Sawyer addressed the Council stating that he wanted
to get the motto adopted, then the committee work on the
ways and means of using the motto. He proposed that the
motto "CITY OF CHAMPIONS" be adopted tonight.
After considerable discussion, it was the consensus of the
Council that if the Committee is ready, bring it to the
February meeting for a Council vote.
VIII. EXECUTIVE SESSION - In compliance with the provisions of the
Texas Open Meetings Law, Article 6252 -17, V.T.C.S., in
accordance with the authority contained in Section 2(e),
LEGAL; and Section 2(g), PERSONNEL:

B. City Secretary's Position
IX. ACTION TAKEN on Matters Discussed in Executive Session.
Mayor Lohrmann reconvened the Council into open session and
the following actions were taken.
A. Don Blackwell vs the City of Stephenville
Councilman Evans made the motion to authorize Randy
Thomas, City Attorney, to appeal the Don Blackwell
lawsuit. Seconded by Councilman Bailey.
Councilman Taylor moved to amend Councilman Evans' motion

whereby the City, by whatever mechanism the attorneys
work out or is appropriate, afford B -4 recognition to Mr.
Blackwell during the appendency of this appeal and
pending the final resolution of the case. Seconded by
Councilman Zelman. The amendment failed by the
following roll call vote:
AYES: Councilmen Taylor and Zelman and Mayor Lohrmann.
NOES: Councilmen Bailey, Hodges, Johnson, Evans, Wooley,
and Nix.
The motion carried by the following roll call vote:
AYES: Councilmen Nix, Zelman, Wooley, Evans, Johnson,
Hodges and Bailey.
NOES: Councilman Taylor and Mayor Lohrmann.
B. City Secretary's Position.
Councilman Taylor moved to employ Cindy Stafford as the
next City Secretary. Seconded by Councilman Evans. The
motion carried UNANIMOUSLY.
There being no other business to come before the City Council at
this time, Mayor Lohrmann adjourned the meetin at 7:30 p.m.

ORDINANCE NO. 1994 -01
j AN ORDINANCE OF THE CITY OF STEPHENVILLE, TEXAS, ESTABLISHING FEES
FOR SERVICES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the rates and charges and procedures relative to the
collection thereof shall be established by the Council
from time to time by ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE, THAT THE ATTACHED FEE SCHEDULES FOR SERVICES BECOME
EFFECTIVE AS HEREIN PROVIDED.
SECTION 1.
That the fee schedule, attached hereto as EXHIBIT "1 ", for the
support of the general government of the City of Stephenville,
Texas, be established.
SECTION 2.
This ordinance shall become effective immediately from and after
its passage.
PASSED AND APPROVED AT A MEETING OF THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE, TEXAS, this 4th day of January, 1994.
