The City Council of the City of Stephenville, Texas, convened in special session on Tuesday, August 25, 1998, at 5:30 p.m., in the Council Chambers at City Hall, 298 West Washington Street, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: Mayor: John Moser Councilmembers: Marshall Shelton Joel Hillin K. Stafford, City Secretary Randy Thomas, City Attorney I. CALL TO ORDER. Mayor Moser called the meeting to order at 5:33 p.m. and declared a quorum present. IL DISCUSS TAX RATE FOR FISCAL YEAR 1998 -99 City Administrator Don Davis reviewed the certified tax roll comparison schedule (attached) with the council. He noted the total land market value, improvements, and personal property for a total market value of $651,662,604, which is up from $628,597,969 last year. He then noted the deductions, which are exempt property (school districts, university, churches, etc.), old age exemptions, disabled persons and disabled vets exemption, freeport tax exemption, abatements, and ag use. These exemptions total $190,951,629, which leaves a net taxable roll of $460,710,975. This net tax roll is up approximately $35,000,000 from last year. August 25, 1998 - Minutes of Special Meeting Davis then reviewed comparisons using tax rates for the last four years (attached). The figures used for purposes of illustration for the 1998 tax year are based on a $.4677 tax rate. This $.4677 is the same O &M tax rate plus what was approved by the voters for the increase in the debt retirement. Don reminded the council that the city uses a 98% collection figure. If you take $2,154,000 and multiply by 98 %, you get what is in the budget which is shown as income to the city from the certified tax roll. Davis then discussed how the tax rate is divided between the General Fund versus debt service. Those two components added together is the total tax rate. On the next attachment, Davis pointed out that the $2.7 million obligation bond approved by the voters in May requires a $0.0650 tax increase to the debt service fund, and that is set by the bond covenants and is nondiscretionary. Because of the growth in the tax roll, we can generate the same amount of monies in the general fund (operation and maintenance) with a three cent reduction in the tax rate. Therefore, it would go from $0.0365 to $0.0333 in the general fund to generate the same amount of operating dollars. The net effect on the overall tax rate would be from $0.43.3 to $0.467 or approximately $0.035 increase to cover the general operation budget and the increase in the debt service. Davis mentioned that when we were promoting the bond sale, we estimated the increase in the tax rate would be about $0.08 necessary to retire the debt, and in fact, because of the reduction in the general fund, the net effect to the — taxpayer is only a little over three cents. The next attachment shows a comparison of various home values and the annual cost to a taxpayer at this year's tax rate of $.4333 and two proposed tax rates, $.4677 and $.4724. The last illustration shows a comparison of various levels of tax rates. Davis reminded the council that state statute requires a certain procedure for establishing a tax rate. The council must propose a tax rate, vote on the proposed tax rate, and set a date for a public hearing on the proposed tax rate. Davis explained that at the $.4677 rate, there would be a projected balance in the general fund of $3,105.00. At the $.4724 rate, there would be a project balance in the general fund of approximately $25,000. Davis added that the budget is balanced at the $.4677 rate. Council member Conatser moved to set the tax rate at $.4677. Council member Shelton seconded the motion. The motion failed by the following vote: Ayes: Council members Shelton and Conatser. Noes: Council members Madkins, Terrell, Hillin, Stanley, Jergins, and Marin. August 25, 1998 - Minutes of Special Meeting F Council member Madkins moved to set the tax rate at $.4724. Council member Marin seconded the motion which passed by the following roll call vote: Ayes: Council members Marin, Jergins, Conatser, Stanley, Hillin, Terrell, and Madkins, and Mayor Moser. Noes: Council member Shelton. Council member Madkins moved to set a public hearing on the tax rate for Thursday, September 3, at 5:30 p.m. Council member Stanley seconded the motion, which passed by unanimous vote. III. PUBLIC HEARING TO CONSIDER THE BUDGET FOR THE FISCAL YEAR 1998 -99 Mayor Moser opened a public hearing on the budget for the fiscal year 1998 -99. Speaking in Favor: Bob Kimball, 789 West Green Street, Stephenville, Texas. Kimball spoke regarding the volunteer appreciation dinner. He said the idea of a potluck meal was a good one, and he hoped the council would pursue this plan. He also asked the council to report on the new tax rate in a simple and easy -to- understand way in the newspaper. Speaking in Opposition: No one. Mayor Moser closed the public hearing. III. CONSIDER AN ORDINANCE ADOPTING THE BUDGET FOR FISCAL YEAR 1998 -99 Council member Jergins moved to adopt Ordinance No. 1998 -16 making appropriations for the support of the City of Stephenville, Texas, for the fiscal year beginning October 1, 1998, and ending September 30, 1999, and adopting the annual budget of the City of Stephenville 1998 -1999 fiscal year. The motion passed by the following roll call vote: Ayes: Council members Madkins, Terrell, Hillin, Stanley, Conatser, Jergins, Marin, and Mayor Moser. Noes: Council member Shelton. IV. EXECUTIVE SESSION At 6:28 p.m., Mayor Moser recessed the open portion of this meeting and called the council into executive session in compliance with the August 25, 1998 - Minutes of Special Meeting provisions of the Texas Open Meetings Law, Subchapter D, Local Government Code, Vernon's Texas Codes, Annotated, in accordance with §551.074(x)(1) Deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee. Police Chief At 7:15 p.m., the council returned to open session. V. ACTION TAKEN ON MATTERS DISCUSSED IN EXECUTIVE SESSION No action was taken by the council. V1. WHEREAS, the budget for the fiscal year beginning October 1, 1998 and ending September 30, 1999, was duly presented to the City Council by the City Administrator and a public notice was posted in the Stephenville City Hall. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: SECTION 1. That the appropriations for the fiscal year beginning October 1, 1998 and ending September 30, 1999, for the support of the general government of the City of Stephenville, Texas, be fixed and determined for said terms in accordance with the expenditures shown in the City's fiscal year 1998 -1999 budget. SECTION 2. That the budget is hereby approved in all respects and adopted as the City's budget for the fiscal year beginning October 1, 1998 and ending September 30, 1999.
