The City Council of the City of Stephenville, Texas, convened in spec- ial session on July 22, 1992 at 5:30 p.m., in the Council Chambers at City Hall, 354 N. Belknap, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Article 6252-17, Section 3A, V.T.C.S., with the following members present, to wit: f 1 Mayor: Lavinia Lohrmann Mayor Pro Tem: Scott Evans Councilmembers: Alan Nix Donald L. Zelman Sam Taylor II William F. (Bill) Johnson Dan Collins Bill Bailey Absent: None Others Attending: Don Davis, City Administrator Joyce Pemberton, City Secretary Randy Thomas, City Attorney I. CALL TO ORDER: Mayor Lavinia Lohrmann called the meeting to order and declared a quorum present. II. MATTERS BY COUNCILMEMBERS: ^ A. Discussion of Proposed Contract with James 0. Bachus. I , Don Davis, City Administrator, and Randy Thomas, City Attorney, explained that the City has had litigation pending with James Bachus for several years over an easement crossing his property at the coarner of Race and Frey Streets. They feel they have successfully negotiated this contract, which will keep it out of court. Councilman Alan Nix made the motion, seconded by Councilman Bill Johnson, that the City Council authorize Don Davis, City Administrator, to sign said agreement, if and when Mr. Bachus signs the agreement. The motion carried UNANIMOUSLY. B. Discussion of Landfill and Solid waste Disposal Alternatives Mayor Lavinia Lohrmann, reporting for the Landfill Committee, advised the Council that the new Federal Regulations go into effect in October, 1993, and it has reached the point where the Council must make some decisions regarding the Landfill operation. Ron Jones, representing the Institute for Applied Environmental Research, addressed the Council. Mr. Jones presented some composting alternatives for Council con- sideration. Bill Prikryl, with TEAM Consultants, Inc., addressed the Council presenting the liabilities now existing with the present landfill and some alternatives for a new operation. After lengthy discussion, Councilman Bill Johnson made the motion, seconded by Councilman Sam Taylor, that we stop taking garbage October 8, 1993, at the landfill and authorize the staff to proceed in the closing procedure. The motion carried UNANIMOUSLY. Councilman Dan Collins made the motion, seconded by Council- man Don Zelman, to authorize staff to proceed with all due haste to find the most viable options to consider for dis- posal of the waste. The motion carried UNANIMOUSLY. C. Discussion Regarding Date of August Regular Meeting. Councilman Dan Collins made the motion, seconded by Sam Taylor, to move the date of the regular meeting to August 11, 1992, in order to canvass the election returns of the Special Election held on August 8, 1992. The motion carried UNANIMOUSLY. r 1 III. CITY COUNCIL/CITIZEN GENERAL DISCUSSION: Councilman Dan Collins commented that he would like for the staff to work closely with the media in getting a good publicity piece out on what the Council has learned tonight regarding the landfill; the problems, the alternatives and the decision that was made to night to close the landfill in 1993. Carroll Gentzel said that he would like to thank the Institute for working with the City on this problem, at no charge at all. He said they have done a lot of work and spent a lot of hours on the landfill. Elizabeth Zicklefoose commented that she would like to see a citywide clean up before closing the landfill. There being no other business to come before the Council at this time, Mayor Lohrmann adjourned the meeting at 7:30 p.m. ATT ce emberton, City Secretary Lavinia Lohrmann, Mayor - 189 -
