AN ORDINANCE AUTHORIZING RANDY THOMAS, CITY ATTORNEY, TO FILE
PROCEEDINGS TO CONDEMN AND ACQUIRE ON BEHALF OF THE CITY OF
STEPHENVILLE AN EASEMENT FOR RIGHT-OF-WAY OF A CITY STREET ON
AND ACROSS A 0.147 ACRE TRACT OF LAND OUT OF BLOCK 156 OF THE
WILLIAM MOTLEY SURVEY, ABSTRACT 515, IN ERATH COUNTY, TEXAS,
AND A 0.841 ACRE TRACT OF LAND OUT OF BLOCK 156 OF THE WILLIAM
MOTLEY SURVEY, ABSTRACT 515, IN ERATH COUNTY, TEXAS, AGAINST
CAROL BARNETT SCHNUR, THE OWNER OF SAID LAND, AND TO PROSECUTE
SAID CONDEMNATION PROCEEDINGS IN THE MANNER PRESCRIBED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
The City of Stephenville requiring an easement for public
purposes and having failed to agree with the owner upon the
damages and consideration to be paid and given to CAROL BARNETT
SCHNUR, the owner, for a right-of-way easement for a city
street, on the following described land:
Attached hereto as EXHIBIT "A"
RANDY THOMAS, City Attorney, is hereby authorized on
behalf of the City of Stephenville to file proceedings to
condemn the above described land for purposes of such easement,
such suit to be against Carol Barnett Schnur, owner of said
land and to prosecute condemnation proceeding in the manner
prescribed by law.
PASSED AND APPROVED this 16 day of December, 1992.

1967, from Don Coan, !'rustee, to Carol E. Barnett, recorded in
Vol. 734, Page 425, Deed Records of Erath County, Texas, and the
0.147 acres being described as follows:
Beginning at•an iron fod found in Northerly right of wa, of U,S.
Highway No, 377, as described in said deed to Barnett, for the
SEC of the 12.958 acre tract, and SEC of this traotr
Thence S. 68=22-35 W. with highway right of way, 63,71 :eel to
an Iron rod eat in South line of said 12.958 acres, for the SWC
of this tract;
Thence N. 10-34-15 W. 199.57 feet to an iron rod set at
beginning of a curve, for a corner of this tract;
Thence along a curve to the left, having a radius of 1050.00
feet and central angle or 00 deg, 16 min. 09 sac., an arc
distance of 4.93 feet (long chord bears N. 10-41-49 W. 4.93
feet) to an iron rod set in East line of the 12.958 acres, for
North corner of this tract;
Thence S. 28-35-08 R. 2D2.20 feet to the place of beginning,
containing 0.147 acres.

All that certain 0,841 acres out of Block 156, city of
Stephenville, Texas, situated within the Wm. Motley Survey,
A-515, Erath County, Texas, and being part of a certain 12,938
acre tract described in Special Warranty Deed dated Dec, 23,
1987, from Don Coan, Trustee, to Carol E. Barnett, recorded in
Vol. 734, Page 425, Deed Records of Erath County, Texas, and the
0.841 acres being described as -follows:
Beginning at an iron rod set in Northerly right of way of U.S.
Highway No, 377, as described in said deed to Barnett, from
which point the SEC of the 12,950 acre tract bears
N. 68-22-35 E, 63.71 feet, for the SBC of this tract;
Thence S. 68-22-35 W. with highway right of way, 101.89 feet to
an iron rod set in South line of the 12.95a acres, for the SWC
of this tract;
Thence N. 10-34-15 w, 219.11 feet to an iron rod set at slight
bead, for a corner in West line of this tract;
Thence H. 10-23-24 W. 309.39 feet to a point inundated in water
pond, in East line of the 12,958 acre tract, for the North
corner of this tract,

320.16 feet to an iron rod set for a corner on Easterly line of
this tract,
Thence along a curve to the right, baying a radius of 1050,DO
feet, and central angle of 00 deg. 16 min. 09 sec., an are
distance of 4,93 feet (long chord bears S. 10-41-49 E. 4.93
feet) to an iron rod set for a corner on Easterly line of this
tract,
