HomeMy WebLinkAbout1992-O-21 - Sewer LineORDINANCE NO. 1992-21 AN ORDINANCE AUTHORIZING RANDY THOMAS, CITY ATTORNEY, TO FILE PROCEEDINGS TO CONDEMN AND ACQUIRE ON BEHALF OF THE CITY OF STEPHENVILLE AN EASEMENT FOR CONSTRUCTION, RECONSTRUCTION AND f MAINTENANCE OF A SANITARY SEWER LINE ON AND ACROSS LOTS 12 - THROUGH 16, BLOCK 74 OF THE CITY OF STEPHENVILLE IN ERATH COUNTY, TEXAS, AND TO ACQUIRE AN ADDITIONAL TEMPORARY CONSTRUCTION EASEMENT CONTIGUOUS TO THE PERMANENT EASEMENT AGAINST JACK L. BACCUS, THE OWNER OF SAID LAND, AND TO PROSECUTE SAID CONDEMNATION PROCEEDINGS IN THE MANNER PRESCRIBED BY LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: The City of Stephenville requiring an easement for public purposes and having failed to agree with the owner upon the damages and consideration to be paid and given to JACK L. BACCUS, the owner, for easement for sanitary sewer line on the following described land: Attached hereto as EXHIBIT "A" RANDY THOMAS, City Attorney, is hereby authorized on behalf of the City of Stephenville to file proceedings to condemn the above described land for purposes of such easement and to acquire an additional temporary construction easement contiguous to the permanent easement such suit to be against Jack L. Baccus, owner of said land and to prosecute ( condemnation proceeding in the manner prescribed by law. PASSED AND APPROVED this 6 day of October, 1992. Baccus, recorded in Volume 617, Page 211 of the Deed Records of Erath County, Texas, and being more particularly described as follows: BEGINNING at the northwesterly corner of said Baccus tract, being on the easterly line of South Graham Avenue (Highway 108); THENCE N 49030'00" E, 194.30 feet to a point for corner; THENCE N 49053'00" E, 130.40 feet to a point for corner on the westerly line of Old Hico Road; THENCE S 66001'00" E, with the westerly line of Old Hico Road, 22.23 feet to a point for corner; THENCE S 49053'00" W, 140.01 feet to a point for corner; THENCE S 49030'00" W, 42.47 feet to a point for corner; THENCE S 35"31'00" E, 431.86 feet to a point for corner on the northerly line of Lot 10, Block 74; (00111 THENCE S 51037'00" W, with said Lot line, 20.02 feet to a point for corner; THENCE N 35031'00" W, 431.17 feet to a }point for corner; THENCE S 49030'00" E, 135.36 feet to a point for corner, being on the easterly line of South Graham Avenue; THENCE N 30000'00" W, with said easterly line, 20.34 feet to the POINT OF BEGINNING and containing 15,254 square feet or 0.350 acres of land, more or less. Accompanying the above described 20 foot wide sanitary sewer easement are 30 foot wide Temporary Construction Easements, being parallel and contiguous to each side, where possible, of the above described Sanitary Sewer Easement. f^
