HomeMy WebLinkAbout2018-01-02 - Regular City CouncilMINUTES City of Stephenville TE*AS Regular City Council Meeting Tuesday, January 2, 2018 at 5:30 PM The Regular City Council Meeting of the City of Stephenville, Texas, convened on Tuesday, January 2, 2018, at 5:30 PM, in the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: COUNCIL PRESENT: COUNCIL ABSENT: OTHERS ATTENDING: I CALL TO ORDER Mayor Kenny Weldon Council Member Mark McClinton Council Member Doug Svien Council Member Rhett Harrison Council Member SherryZachery Council Member Carla Trussell Council Member Brady Pendleton Council Member Alan Nix Council Member Jerry Warren Mayor Weldon called the meeting to order at 5:30 p.m. II Pledge of Allegiance to the United States Flag Pledge of Allegiance to the Texas Flag III Invocation by Rev. Jim DeGraw, Grace Fellowship Church, Stephenville IV Regular Agenda a) Citizens' General Discussion Frank Chamberlain, 1321 West Frey, came forward to address the council about drainage issues in the area of Chamberlin and Frey Streets during extended rain events. Mr. Chamberlain believes this flooding is due to apartments that have been constructed in the area. b) Update on Hotel Occupancy Tax Fund and Tourism and Visitors Bureau Allen Barnes, City Administrator, presented council with concerns and possible solutions to the creation of a Tourism and Visitors Bureau. Mr. Barnes stated that he hoped to have additional information after speaking with the Texas Hotel and Lodging Association on January 3. A council work session will be held on January 11, 2018 to discuss the Tourism and Visitor Board in more detail. V Planning and Zoning Commission a) Planning and Zoning Commission Annual Report - Chairman Mark Wallace Mark Wallace, Chairman of Planning and Zoning Commission, updated the council on what had been accomplished in 2017, and what the 2018 goals are. In 2017, the Planning and Zoning Commission reviewed and recommended the Thoroughfare Plan, Wireless Communications Facilities Ordinance, and Sign Regulations Ordinance. They also reviewed and recommended seven property rezones and three subdivision plats. Mr. Wallace stated that the goals for 2018 were:review the Comprehensive and Future Land Use plans, which would become an annual occurrence; review the parking, B-5, and historical overlay district sections in the zoning ordinance, and; review lot size requirements in R-1.5, R-1, R-2, and R-3. Mr. Wallace stated that all commissioners had met the attendance requirements for the commission. He acknowledged Janet Whitley and Milton Woodrow Horner as outgoing member and welcomed Bruce Delater and Cliff McCrury to the commission. Mayor Weldon thanked Mr. Wallace and the Planning and Zoning Commission for their hard work over the past year. b) PUBLIC HEARING - Case No. RZ2017-007 Applicant Dong Dong Duan and Phil Rainey, representing PRVS Holdings, LLC, are requesting a rezone of the property located at 100 Wolfe Nursery Rd, Suite 198, from B- 2 (Retail and Commercial Business District) to B-5 (Restaurant -Alcoholic Beverage Service). Mayor Weldon opened the public hearing. No one came forward to speak in favor of or opposition to the rezone. Mayor Weldon closed the public hearing. c) Consider Approval of Ordinance No. 2018-0-01 rezoning the property located at 100 Wolfe Nursery Rd., Suite 198, from B-2 (Retail and Commercial Business District), to B-5 (Restaurant -Alcoholic Beverage Service). MOTION by Mark McClinton, second by Carla Trussell, to approve Ordinance No. 2018-0- 01 rezoning the property described above. MOTION CARRIED, Alan Nix casting an opposing vote. d) PUBLIC HEARING - Case No. RZ2017-008 Applicant, Lonnie Allsup, is requesting a Rezone of the property being a part of Lot 10 as recorded in document number 2026-02779 of the official public records of Erath County, Texas, Block 152, of the City Addition to the City of Stephenville, Erath County, Texas, from I (Industrial District), to B-2 (Retail and Commercial Business District). Mayor Weldon opened the public hearing. No one came forward to speak in favor of or opposition to the rezone. Mayor Weldon closed the public hearing. e) Consider Approval of Ordinance No. 2018-0-02 rezoning the property being a part of Lot City Of Stephenville Regular City Council Meeting - 02 Jan 2018 Page 2 of 6 10 as recorded in document number 2016-02779 of the official public records of Erath County, Texas, Block 152, of the City Addition to the City of Stephenville, Erath County, c Texas, from I (Industrial District), to B-2 (Retail and Commercial Business District). MOTION by Brady Pendleton, second by Mark McClinton, to approve Ordinance No. 2018-0-02 rezoning the property described above. CARRIED by unanimous vote. f) PUBLIC HEARING -Case No. CRP2017-001 Applicant, Lonnie Allsup, is requesting a Replat of Lots 3, part of Lot 10 as recorded in document number 2016-02779 of the official public records of Erath County, Texas, and 6R, Block 152, of the City Addition to the City of Stephenville, Erath County, Texas, into Lot 12, Block 152, of the City Addition to the City of Stephenville, J.B. Dupuy Survey A- 196, Erath County, Texas. Mayor Weldon opened the public hearing. No one came forward to speak in favor of or opposition to the replat. Mayor Weldon closed the public hearing. g) Consider Approval of Replat of Lots 3, part of Lot 10 as recorded in document number 2016-02779 of the official public records of Erath County, Texas, and 611, Block 152, of the City Addition to the City of Stephenville, Erath County, Texas, into Lot 12, Block 152, of the City Addition to the City of Stephenville, J.B. Dupuy Survey A-196, Erath County, Texas. MOTION by Mark McClinton, second by Brady Pendleton, to approve the replat as presented. CARRIED by unanimous vote. h) Consider approval of amendments to the Thoroughfare Plan of the 2030 Comprehensive Plan: Changing the classifications of Christi Plaza and Lockhart Road to collector streets. MOTION by Mark McClinton, second by Sherry Zachery, to approve changing the classifications of Christi Plaza and Lockhart Road as presented. CARRIED by unanimous vote. i) Consider Approval of Ordinance No. 2018-0-03 Wireless Communication Facilities MOTION by Brady Pendleton, second by Mark McClinton, to approve Ordinance No. 2018-0-03 Wireless Communication Facilities. CARRIED by unanimous vote. VI Planning and Development Committee Report a) Committee Report b) Consider Adoption of the Future Land Use Plan for the City of Stephenville MOTION by Mark McClinton, second by Alan Nix, to adopt the Future Land Use Plan as presented. CARRIED by unanimous vote. c) Consider Approval of Ordinance No. 2018-0-04 Maintenance of Sidewalks, Driveways and Trees by Property Owners or Occupants. MOTION by Brady Pendleton, second by Mark McClinton, to approve Ordinance No. 2018-0-04 Maintenance of Sidewalks, Driveways and Trees by Property Owners or City Of Stephenville Regular City Council Meeting - 02 Jan 2018 Page 3 of 6 Occupants. CARRIED by unanimous vote. d) Consider Approval of Ordinance No. 2018-0-05 Sign Regulations MOTION by Carla Trussell, second by Brady Pendleton, to approve Ordinance No. 2018-0- 05 Sign Regulations. CARRIED by unanimous vote. e) Consider Approval of Ordinance No. 2018-0-06 Subdivision Ordinance Mayor Weldon wanted to note that prior to adoption, the proposed Subdivision Ordinance was held for a 30-day review period in which the community was asked for input. MOTION by Mark McClinton, second by Brady Pendleton, to approve Ordinance No. 2018-0-05 Subdivision Ordinance. CARRIED by unanimous vote. f) Consider Approval of Administrative Services Contract with Public Management, Inc. for Texas Department of Agriculture Community Development Block Grant MOTION by Carla Trussell, second by Mark McClinton, to approve the contract with Public Management, Inc. for administrative services for the Texas Department of Agriculture Community Development Block Grant. CARRIED by unanimous vote. g) Consider Approval of Engineering Services Contract with KSA Engineering for the Texas {fr I Department of Agriculture Community Development Block Grant MOTION by Mark McClinton, second by Sherry Zachery, to approve the contract with KSA Engineering for engineering services for the Texas Department of Agriculture Community Development Block Grant. CARRIED by unanimous vote. VII MONTHLY BUDGET REPORT - Monica Harris, Director of Finance Ms. Harris gave the following report: In reviewing the financial statements ending November 30, 2017, the financial indicators are expected or better than expected. • Property Tax: We received $235K in property taxes in the month of November, resulting in a $137K increase over funds collected through November 30th of last year. • Sales Tax: We received $537K in sales tax in November, resulting in $74K over the target budget through November 30th. We have received $9K less than last year. • Revenue (Budgetary comparison): The target budget for operating revenue is $3.95 million. We received $3.47 million in revenue, resulting in $481K under budget. This is a result of property taxes, which are billed in November and due by January 31st, and other taxes, which are due quarterly and annually. • Expenditures (Budgetary comparison): The target budget for operating expenditures is $3.19 million. We expended $2.98 million, resulting in $203K under budget. • Revenue (Prior year comparison): Operating revenue received last year was $3.3 million as compared to the current year's $3.47 million, resulting in a $153K increase due to property taxes and other income. • Expenditures (Prior year comparison): Operating expenditures last year were $2.74 City Of Stephenville Regular City Council Meeting - 02 Jan 2018 Page 4 of 6 million as compared to the current year's $2.98 million, resulting in a $240K increase due largely to paying the liability insurance annually instead of quarterly saving over $8,600 dollars. • New Programs: The Park Maintenance department has purchased the Field Rake, and the Agenda Management Software has been purchased. VIII Stephenville Type B Economic Development Authority Update Dr. John Hubbard gave the council the following updates: • Panda Express has closed on their property and will begin breaking ground in January or February • SEDA's marketing video that was presented to council in December has received over 4,400 views • SEDA will be holding a new board member orientation on January 18 at 2:00 p.m., following the SEDA meeting. This will be open to the public and is being billed as "Economic Development 101." • Seven different companies are currently looking at Stephenville as potential sites for their business. Dr. Hubbard said that infrastructure and trainable work force seem to be priorities in companies that are looking to relocate or open new locations. CARRIED by unanimous vote. X Comments by City Administrator • Charter Review Committee - Thursday, January 4 • Finance Committee and Council Work Session- Thursday, January 11 • Filing Period for a Place on the Ballot January 17 - February 16 • Personnel Committee -Tuesday, January 23 Mr. Barnes explained the city's new PRIDE (Personal Responsibility in Developing Excellence) initiative. The second Friday of the month will be Stephenville PRIDE day and employees will wear their PRIDE t-shirts. City staff is "striving to provide excellence in our systems, our programs, and our service delivery. Our citizens deserve the best, and that's what we're striving to do." XI Comments by Council members Council member McClinton wished everyone a happy and prosperous new year. Council member Trussell wanted to remind everyone of the Oxford House Soup Supper on n January29. On January 22 there will be a forum for candidates running for county office. Mayor Weldon wished council member Jerry Warren a speedy recovery from his illness. He thanked the council for their hard work, and recognized staff support for the council. He wished everyone a happy new year. XII EXECUTIVE SESSION In compliance with the provisions of the Texas Open Meetings Law, Subchapter D, Government Code, Vernon's Texas Codes, Annotated, in accordance with • Section 551.072 Deliberations about Real Property - Land for Erath County Humane Society This item was removed from the agenda.
