HomeMy WebLinkAbout2017-O-03 - Rezone Wm Montey Survey I to B-5ORDINANCE NO. 2017-0-03 AN ORDINANCE REZONING THE LAND DESCRIBED FROM THE ZONING CLASSIFICATION OF "I" INDUSTRIAL DISTRICT TO "B-5" RESTAURANT —ALCOHOLIC BEVERAGE SERVICE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: All that lot, tract or parcel of land legally described as follows: The easternmost portion of a building situated on 3.11 acres of land herein below described and being identified by GPS coordinates as follows: SE corner set at 32" 12' 12.64" N, 98° 14' 30.65" W; NE corner set at 32` 12' 13.47" N, 98° 14' 31.05" W; NW corner set at 32° 12' 13.36" N, 98° 14' 31.42" W; SW corner set at 32° 12' 12.50" N, 98° 14' 31.07" W; and said 3.11 acre tract out of the Wm. Motley Survey, A-515, in Stephenville, Erath County, Texas, is described by metes and bounds as follows: A tract of land situated in the Wm. Motley Survey, Abstract No. 515, Erath County, Texas, being the same tract of land described in the deed to Texas Coca-Cola Bottling Company, recorded in Volume 547, Page 70, Deed Records, Erath County, Texas, save and except a portion of said land deeded to the State of Texas, recorded in Volume 834, Page 305, Deed Records, Erath County, Texas, being more particularly described by metes and bounds as follows: BEGINNING at a 2" pipe found (control monument) in the northwest line of West Washington Street (also known as U.S Highway No. 377) for the south corner of this described tract; same being the east corner of a tract of land described in the deed to Stephenville Holiday Ltd., recorded in. Volume 1290, Page 818, Real Records, Erath County, Texas; THENCE N 21' 55' 07" W. (base bearing per GPS Observation, WGS 84), 556.67 feet along a common line between the Texas Coca-Cola Bottling Company Tract and the Stephenville Holiday Ltd. Tract to a 3/8" rebar rod found (control monument) for the west corner of the Texas Coca- Cola Bottling Company Tract, same being the north corner of the Stephenville Holiday Ltd. Tract and in the southeast line of a tract of land described in the deed to FMC Technologies, Inc., recorded in Volume 1051, Page 926, Real Records, Erath County, Texas; THENCE N 68 29' 51" E., 247.60 feet along a common line between the Texas Coca-Cola Bottling Company Tract and the FMC Technologies, Inc. Tract to a 1/2" rebar rod set with a cap stamped RPLS 1983 for the north comer of the Texas Coca-Cola Bottling Company Tract; THENCE S 21 04' 55" E., along a common line between the Texas Coca-Cola Bottling Company Tract and the FMC Technologies, Inc. Tract, at 307.22 feet passing a corner of the FMC Technologies, Inc. Tract, same being the west corner of Lot I, Block A, FMC Technologies Addition, an addition to the City of Stephenville, Erath County, Texas, according to the plat thereof, recorded in Cabinet B, Slide 8A, Plat Records, Erath County, Texas, continuing along a common line between the Texas Coca-Cola Bottling Company Tract and Lot 1, in all, 557.22 feet to a 1/2" rebar rod recovered with a cap stamped RPLS 1983 in the northwest line of West Washington Street for the east corner of this described tract, same being the south corner of Lot 1; THENCE S 68 37' 46" W., 239.47 feet along the northwest line of West Washington Street to the point of beginning and containing 3.11 acres. Washington Page 1 And it is hereby rezoned and the zoning classification changed from the classification of "I" Industrial District to "B-S Restaurant —Alcoholic Beverage Service District, in accordance with the Zoning Ordinance of the City of Stephenville.
