HomeMy WebLinkAbout1993-O-32 - Amend 1993-22ORDINANCE NO. 1993-32 AN ORDINANCE AMENDING ORDINANCE NO. 1993-22 PROHIBITING THE DISCHARGE OF FIREARMS, INCLUDING AIR GUNS, WITHIN THE CORPORATE LIMITS OF THE CITY OF STEPHENVILLE, ADDING TWO EXCEPTIONS TO SECTION 4: 4) PERSONS WHO WERE BORN BEFORE SEPTEMBER 2, 1971, AND 5) PERSONS WHO HAVE SERVED IN THE UNITED STATES ARMED FORCES; AND PROVIDING A PENALTY CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: SECTION 1 - DEFINITIONS 1. Air Gun: An air rifle or air pistol of any description, by whatever name known, that, by means of compressed air, compressed gas, springs, or any other means capable of discharging and propelling shots, pellets or any solid object for a distance of greater than fifty (50) feet. 2. Firearm: Any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by an explosion or burning substance or any device readily convertible to that use. SECTION 2 - DISCHARGE OF FIREARMS PROHIBITED It shall be unlawful for any person to discharge firearms of any kind or description within the corporate limits of the City of Stephenville, Texas. SECTION 3 - SHOOTING AIR GUN It shall be unlawful for any person to shoot any air gun within the corporate limits of the City of Stephenville, Texas. SECTION 4 - EXCEPTIONS 1. Any person discharging a firearm in defense of person. (As defined in the Texas Penal Code). 2. Police Officers or Animal Control Officers in the discharge of their duties. 3. Persons shooting air guns on private property who have completed a gun safety course as approved by the Chief of Police. 4. Persons who were born before September 2, 1971. 5. Persons who have served in the United States Armed Forces. SECTION 5 - PENALTY Any person violating the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined any sum not less than $25.00, nor more than $200.00 for each and every offense.
