The City Council of the City of Stephenville, Texas, convened on April 7, 2015, at 5:30 p.m., in the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: Mayor Mayor Pro -Tern Council members Absent Jerry K. Bridges, City Administrator Randy Thomas, City Attorney Cindy L. Stafford, City Secretary Call to Order. The meeting of the Stephenville City Council was called to order at 5:30 p.m. on Tuesday, April 7, 2015, by Mayor Weldon, who announced that he has executed proclamations for National Safe Digging Month, Veteran Mental Health Awareness, and Alcohol Awareness Month. Mayor Weldon also announced that recent action for the council to proceed with an economic development strategic plan will be funded in part by Tarleton State University, Ranger College, Stephenville Economic Development Corporation and the Stephenville Chamber of Commerce. 11. Citizens' General Discussion. No one wished to address the council. Ill. Tarleton State University —Growth and Construction Update; Dr. Kyle McGregor, Vice President for Advancement and External Relations and Tye Minkler, Vice President for Finance and Administration McGregor and Minkler presented a report on growth and construction at Tarleton State University. Current enrollment on the Stephenville campus is 8,600, and system wide is 11,734. Four thousand freshman and sophomore students are housed on campus and 1,000 off campus. Tarleton recently closed a $75 million bond that will finance new residence halls to be constructed east of Memorial Stadium. This $75m is a portion of Regular Business Meeting April 7, 2015 Stephenville City Council $240 million in capital improvements completed in the last few years and will extend into the next few years. Other construction projects include additional parking, pedestrian malls on Lillian and Vanderbilt, storm water improvements, renovations to Memorial Stadium, and crosswalks on Washington Street. IV. Stephenville Historical Museum Annual Report and Presentation of Budget —Kate Barton, Board President Kate Barton thanked the city for the generous support the museum receives in the form of money, volunteerism and participation. Barton reported that the Chapel on the Bosque received an exterior paint job at a cost of $11,000. Restoration and improvement work is planned in 2015 at a cost of $41,000. Barton reported more than an estimated 5,200 guests on museum grounds in 2014. These guests were from 7 countries, 31 states, and more than 100 Texas cities. The museum board consists of 18 members, and the museum employs a part-time office manager, a weekend docent/custodian. MOTION CARRIED. V. ERATH COUNTY APPRAISAL DISTRICT Jerry Lee, Chief Appraiser, explained that ECAD has an opportunity to purchase a larger building at 1197 South Loop, and have the funds set aside for this purchase. Lee explained that the growth of Erath County is the reason for this move citing that in 1984, ECAD employed seven people and appraised about 28,000 properties. In 2014, those numbers have risen to fifteen employees and 55,000 parcels. A. Consider and take action of Resolution No. 2015-04 approving the request of the Erath County Appraisal District to authorize pursuant to Texas Tax Code sec. 6.051 the purchase of real property located at 1197 South Loop West, Stephenville, Texas —Jerry Lee, Chief Appraiser of the Erath County Appraisal District MOTION by Brady Pendleton, second by Sherry Zachery, to approve Resolution No. 2015-04. MOTION CARRIED by unanimous vote. B. Consider and take appropriate action on Resolution No. 2015-05 approving the request of the Erath County Appraisal District to authorize pursuant to Texas Tax Code sec. 6.051 the sale of real property located at 1390 Harbin Drive, Stephenville, Texas —Jerry Lee, Chief Appraiser of the Erath County Appraisal District MOTION by Brady Pendleton, second by Sherry Zachery, to approve Resolution No. 2015-05. MOTION CARRIED by unanimous vote. VI. Consider the sale of Part of Lot 7 and Lot 8, Block 4, Clifton Heights Addition, located at 570 Broadway, City of Stephenville, to Garrett Glocar Regular Business Meeting April 7, 2015 Stephenville City Council MOTION by Russ McDanel, second by Doug Svien, to approve the sale of part of Lot 7 and Lot 8, Block 4, Clifton Heights Addition. MOTION CARRIED. VII. PLANNING AND ZONING COMMISSION —PUBLIC HEARINGS Mayor Weldon opened a public hearing. Judy Miller reported that the Planning and Zoning Commission recommends eliminating the residential house size minimum requirement for R-2 and R-3 districts only. She reported that staff recommends lifting the minimum requirement for building size in every district. Speaking in Favor: No one. Speaking in Opposition: Sara Neagle, 600 Riverside, Stephenville, said that if the minimum sizes are removed, the result will be a devaluation of homes in the area. It will also result in increased vehicular traffic which is a safety issue. She also claimed that sufficient notice was not given to alert the public to this matter. Jimmy Walker, 289 Hillcrest, Green Acres Subdivision, Stephenville, said that he built his house in this location with the expectation that similar houses would be built in the n area. He claimed that removing restrictions would "ruin the value of everyone else's {I land". Carla Trussell, 406 Tanglewood Trail, Stephenville, said that she is against "doing away with restrictions entirely". Sherry Keene, 691 North Graham Street, Stephenville, said that property owners had not received adequate notice. Mark Wallace said that he is a member of the Planning and Zoning Commission, and the only recommendation from the commission was to amend the R-2 and R-3 districts. Mayor closed the public hearing. MOTION by Brady Pendleton, second by Sherry Zachery, to adopt Ordinance No. 2015- 04 to amend only R-2 and R-3 districts. MOTION by Russ McDanel, second by Alan Nix, to table this agenda item. Consider approval of a replat of 0.308 acres being Lots 11 and 12, Block 5, Cage Addition, City of Stephenville, located at 1500 block of Ivy Street, City of Stephenville, Texas Judy Miller explained that the purpose of the replat is to allow the property owner to expand his existing structure with a larger lot. Consider approval of a replat of part of Lot 8, Block 32, South Side Addition, City of Stephenville, Texas, 700 block of Sixth Street Judy Miller reported that the owner has requested replatting in order to divide this property into two lots. MOTION by Brady Pendleton, second by Boyd Waggoner, to approve the replat of Lot 8, Block 32, South Side Addition. MOTION CARRIED. Regular Business Meeting April 7, 2015 Stephenville City Council D. Consider approval of a replat of Lot 1, Block 1, Wal-Mart Subdivision, City of Stephenville, Texas, and located in the 100 block of Wolfe Nursery Road Miller reported that replatting is requested in order to create a separate lot for an eight - pump gasoline station. Consider approval of a replat of lot 27 (1100 block of West Frey Street) and Lot 28 (West Shirley Street), Block 3, College Heights Addition, City of Stephenville, Texas Miller reported that the replat will adjust the lot lines according to the land use. MOTION by Brady Pendleton, second by Sherry Zachery, to approve the replat of Lots 27 and 28, Block 3, College Heights Addition. MOTION CARRIED. Vill. FINANCE COMMITTEE REPORT Committee Chair Doug Svien gave the committee report and recommended action. A. Consider Approval of Changes to Ambulance Standby Fee. MOTION by Doug Svien, second by Boyd Waggoner, to approve the increase for the Ambulance Standby Fee from $50 to $100 per hour with a three-hour minimum. MOTION CARRIED. B. Review of Audit Report. Reviewed the General Fund Financial Information. No action is required. C. Fund Balances. In compliance with GASB 54, the city adopted a fund balance policy that designates fund balances as "non -spendable, restricted, committed, assigned and unassigned". These were reviewed by the committee, and no action was required. Regular Business Meeting April 7, 2015 Stephenville City Council D. Consider Approval of Water and Sewer Rate Increases. The committee made an annual review of the city's water and sewer rate charges. MOTION by Doug Svien, second by Alan Nix, to increase the volume charge on water from $3.65 per 1,000 gallons to $3.75 per 1,000 gallons and to increase the volume charge on sewer from $3.40 per 1,000 gallons to $3.50 per 1,000 gallons. MOTION CARRIED. IX. PERSONNEL COMMITTEE REPORT A. Employment Benefits and Health Insurance Package (Recess to Convene Employee Benefits Trust Meeting) B. Air Evac Presentation/Proposal Mayor Weldon recessed the council meeting at 7:44 p.m. and called to order the Employee Benefit Trust meeting. The city council reconvened in regular session at 7:51 p.m. MOTION by Doug Svien, second by Sherry Zachery, to fund the employee benefit package for health and dental insurance with United Health Care, and to award a Contract to Financial Benefit Services for Employee Voluntary Life and Long -Term Disability. MOTION CARRIED. X. PUBLIC WORKS COMMITTEE REPORT —Consider the Purchase of a Compactor for the Landfill (Resolution No. 2015-07) MOTION by Alan Nix, second by Doug Svien, to approve the purchase of an E320 TANA Landfill Compactor from Humdinger Equipment Ltd. of Lubbock, Texas in the amount of $486,500; with financing option for $103,500 due upon receipt and $103,500 due at the beginning of each annual period for four years.. MOTION CARRIED XI. Consider 2015 Consumer Price Index Adjustment to Municipal Telecommunications Right -of -Way Access Line Rates MOTION by Russ McDanel, second by Doug Svien, to not adjust the rates for inflation and remain at the default rate for 2015. MOTION CARRIED. XII. Consider Approval of Resolution No. 2015-06 Authorizing Continued Participation with the Steering Committee of Cities Served by Oncor and Authorizing the Payment of the 2015 Membership Assessment MOTION by Doug Svien, second by Boyd Waggoner, to adopt Resolution No. 2015-06 authorizing participation with the Steering Committee of Cities Served by Oncor and payment of the membership assessment. Bid Awards 1.Bosque River Trail I Extension 2.Senior Citizen Center Remodel Mayor Weldon explained that the bid award for the Bosque River Trail Extension is for improvements to extend the trail into City Park. Weldon also explained that the bid award for the Senior Citizens Center will cover improvements to that facility including interior and exterior windows, ADA electrical door button, ADA restrooms, kitchen ceiling, dance floor, and exterior stucco. XIV. Comments by City Administrator. Pat Bridges announced that mid -year budget review will be held on April 21. XV. Comments by Council members Doug Svien commented on the willingness of the council to further consider a matter and to not act hastily in making a decision. Boyd Waggoner, Doug Svien, and Mayor Weldon made general comments concerning economic development efforts and the upcoming election to consider adoption of a Type B Economic Development Sales and Use Tax. Jerry Warren reminded everyone that early voting begins on Monday, April 27. Russ McDaniel complimented City Administrator Pat Bridges and his directors for the good job they do. XVI.
