HomeMy WebLinkAbout2015-R-05 - Sale 1390 Harbin DrRESOLUTION NO.2015-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS, APPROVING THE SALE OF REAL PROPERTY LOCATED AT 1390 HARBIN DRIVE, STEPHENVILLE, TEXAS, BY THE ERATH COUNTY APPRAISAL DISTRICT AS REQUIRED BY TEXAS TAX CODE §6.051(b); FINDING SUCH ACTION IS TAKEN WITHIN THE TIME REQUIRED BY TEXAS TAX CODE §6.051(b); ORDERING A COPY OF THIS RESOLUTION BE PROVIDED TO THE CHIEF APPRAISER; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Board of Directors ("the Board") and the Chief Appraiser of the Erath County Appraisal District ("the District") have evaluated the District's existing central offices and, based on the current and anticipated growth in the District's operations, the age and condition of the existing offices, and the potential cost of expansion and renovation of the current offices to meet the current and future needs of the District, the Board has determined that relocation to a newer, larger facility is more cost effective and in the best interest of the District and the taxing units it supports; and WHEREAS, the property located at 1197 South Loop West, Stephenville, Texas, presently owned by AgTexas Farm Credit Services ("the Property"), is available for sale and has been determined by the Board to be suitable for the future needs of the District as it provides services to all of the taxing entities in Erath County; and WHEREAS, the Board has approved a Purchase and Sale Agreement ("the Agreement") for the Property, closing on which is subject to the approval of three -fourths of the taxing units within the District as required by Texas Tax Code §6.051(b); and WHEREAS, the Board has determined it is in the best interest of the District and its member taxing units to sell the District's existing central offices located at 1390 Harbin Drive, Stephenville, Texas, ("the ECAD Offices") upon relocation of the Districts operations to new offices; WHEREAS, on or about the 1" day of April, 2015, the Chief Appraiser of the District delivered written notice of the District's proposal to sell the ECAD Offices to the Mayor, the presiding officer of this City Council, and has requested on behalf of the District that this the City of Stephenville approve the District's sale of the ECAD Offices in accordance with Texas Tax Code §6.051(b); and WHEREAS, the City Council of the City of Stephenville, Texas, finds the proposal by the District to sell the ECAD Offices is in the public interest of the residents of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STEPHENVILLE, TEXAS: 1. The sale of the ECAD Offices by the District is hereby approved in accordance with Texas Tax Code §6.051(b) subject to the purchase of alternate property to which to relocate the District's operations as approved by the Board and by the required number of taxing entities as set forth in Texas Tax Code §6.051(b). 2. The action taken pursuant to this resolution is found to have been taken on or before the 30t" day that the Chief Appraiser of the District provided notice and a copy of the Agreement to the Mayor. The City Secretary is hereby authorized and directed to deliver a true and correct copy of this Resolution to the Chief Appraiser of the District not later than the tenth (10th) day after the date of approval of this Resolution. 4. This Resolution shall be effective immediately upon approval. 5.
