A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS, APPROVING A
CHAPTER 380 ECONOMIC DEVELOPMENT PROGRAM AND AGREEMENT WITH HIGHWAY 377, LLC;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Chapter 380 Economic Development Program Agreement, a copy of which is
attached hereto as Exhibit A, is authorized by and adopted pursuant to Chapter 380 of the Texas
Local Government Code, as amended; and
WHEREAS, the City Council of the City of Stephenville, Texas (hereinafter referred to as the
"City Council") hereby determines that this Resolution and the attached Chapter 380 Economic
Development Program Agreement, a copy of which is attached hereto as Exhibit A, comply with all
of the applicable requirements of Chapter 380 of the Texas Local Government Code, as amended,
the Texas Open Meetings Act, Chapter 551 of the Texas Government Code, as amended, and the
ordinances and home -rule Charter of the City of Stephenville, Texas; and
WHEREAS, this Chapter 380 Economic Development Program Agreement is consistent with
the Chapter 380 Economic Development Incentive Program, approved by the City on March 1, 2016;
and
WHEREAS, the City Council finds that this Chapter 380 Economic Development Program
fff Agreement will promote local economic development and stimulate business and commercial
activity within the City; and
WHEREAS, the City Council hereby determines that it is in the best interest of the City to
adopt this Resolution approving the attached Chapter 380 Economic Development Program
Agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,
TEXAS, THAT:
SECTION 1. That the foregoing recitals are hereby found to be true and correct findings of
the City of Stephenville, Texas, and are fully incorporated into the body of this Resolution.
SECTION 2. That the City Council of the City of Stephenville, Texas, does hereby approve
the Chapter 380 Economic Development Program Agreement, a copy of which is attached hereto as
Exhibit A, by and between the City of Stephenville, Texas, and Highway 377, LLC.
SECTION 3. If any section, article paragraph, sentence, clause, phrase or word in this
Resolution, or application thereto to any persons or circumstances, is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of
the remaining portions of this Resolution; and the City Council hereby declares it would have passed
such remaining portions of this Resolution despite such invalidity, which remaining portions shall
remain in full force and effect.
SECTION 4. This Resolution shall become effective immediately upon passage.
