The City Council of the City of Stephenville, Texas, convened on July 5, 2016, at 5:30 p.m., in the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: Mayor Jerry K. Weldon II Council members Mark McClinton Carla Trussell Brady Pendleton Rhett Harrison Alan Nix Sherry Zachery Jerry Warren Absent: Doug Svien Others Attending Patrick C. Bridges, City Administrator Randy Thomas, City Attorney Cindy L. Stafford, City Secretary Call to Order. The meeting of the Stephenville City Council was called to order at 5:30 p.m. on Tuesday, July 5, 2016, by Mayor Weldon. II. Pledge of Allegiance to the Texas Flag —"Honor the Texas flag; I pledge allegiance to thee, Texas, one state under God, one and indivisible." Pledge of Allegiance to the United States Flag Mayor Weldon led the audience in the pledge to the Texas Flag and to the United States Flag. III. Invocation by Curt Plaxco, Pastor of Stephenville Church of the Nazarene IV. Proclamation Recognizing National Parks and Recreation Month Mayor Weldon presented the following proclamation, which he read as follows: WHEREAS, parks and recreational programs are an integral part of communities throughout this country, including Stephenville; and our parks and recreation are vitally important to establishing and maintaining the quality of life in our community, ensuring the health of all citizens, and contributing to the economic and environmental well-being of a community and region; and Regular Business Meeting —July 5, 2016 Stephenville City Council WHEREAS, parks and recreational programs build healthy, active communities that aid in the prevention of chronic disease, provide therapeutic recreational services, and improve the mental and emotional health of all citizens; and WHEREAS, parks and recreational programs increase a community's economic prosperity through increased property values, expansion of the local tax base, increased tourism, the attraction and retention of businesses, and crime reduction; and WHEREAS, we recognize the contributions of the Stephenville Parks and Recreational Advisory Board —Cheryl Hatton, Dennis Jones, Jason LaTouche, Contessa Harrison, Daron Trussell, Cary Strohmeyer, Colby Pack and the many parks and recreational professionals in our community. NOW THEREFORE, BE IT PROCLAIMED, that I, JERRY K. WELDON II, Mayor of the City of Stephenville, Texas, do hereby proclaim July 2016 as National Parks and Recreation Month and encourage all citizens to recognize and enjoy our parks and recreational programs as a place for fun, physical health and social function for all ages and abilities. Mayor Weldon also thanked the Police Department, Fire Department, Community Services Division, and all city employees for their contributions for a successful Fourth of July celebration. V. Citizen General Discussion Donna Wesson, 1325 Lydia, Stephenville, thanked Jeremy Allen for his help in securing and planting memorial trees in City Park. Wesson explained that she has purchased trees to memorialize former students of hers who have died. She said that Jeremy has been very supportive and helpful to her, and she wanted to publicly thank him. VI. Erath County Humane Society —Annual Report, Matt Harpole, President, and Diane McCoy, Executive Director Matt Harpole reported that since Diane McCoy assumed the position of executive director, she has established transparent record keeping as well as thorough reporting on the number and disposition of the animals coming through the shelter. Diane McCoy presented a profit and lost statement and a balance sheet (attached) from October 1, 2015 through April 21, 2016, when she began her term as director. McCoy said that intake numbers for dogs and cats are increasing dramatically. The shelter is taking advantage of social media for posting of stray animals and advertising adoptions. The number of volunteers at the shelter is also increasing. She said that since April, the number of animals at the shelter have increased by as much as 400%. On behalf of the Humane Society Board of Directors and the staff, Harpole and McCoy said that they are seeking additional funds for improving or relocating the animal shelter and urged the council to include their request during upcoming budget work sessions. Regular Business Meeting —July 5, 2016 Stephenville City Council A Mayor Weldon asked Harpole and McCoy to organize a meeting with the city, county, and humane society members to discuss this issue. MOTION by Brady Pendleton, second by Mark McClinton, to accept the annual report of the Erath County Humane Society. MOTION CARRIED by unanimous vote. VII. Consider Approval of Agreement for Utility Service between David Watkins and City of Stephenville David Watkins addressed the council asking that this matter be taken off the agenda at this time for additional planning and budgeting on behalf of the property owners. Vill. Consider Adopting Ordinance No. 2016-0-07 Providing for Water and Sewer Service Outside City Limits As a result of David Watkins withdrawing his item from the agenda, Mayor Weldon noted that it is not relevant that this matter be considered at this time. IX. Stephenville Type B Economic Development Authority —John Hubbard, Executive Director John Hubbard presented the SEDA report stating that the SEDA board has unanimously approved these policies. There were questions posed by council members concerning the policies. A. Consider Approval of Operating Policy MOTION by Rhett Harrison, second by Carla Trussell, to table Item A. MOTION CARRIED. It was noted that this policy will be reviewed by the board and resubmitted to the council for approval. B. Consider Approval of Conflict of Interest Polity, Confidentiality Statement and Conflict of Interest Verification Hubbard said that the confidentiality statement is a critical document protecting ongoing SEDA projects that are currently being discussed. He stressed that by signing this statement, each board member agrees to adhere to a strict policy of confidentiality on information discussed and presented in closed meetings. The board members also agree not to use confidential information for their personal or business interests. MOTION by Mark McClinton, second by Rhett Harrison, to approve the Confidentiality Statement. MOTION CARRIED by unanimous. Regular Business Meeting —July 5, 2016 Stephenville City Council X. Consider Approving the Sale to Rhyne Gailey of Lot 2, Block 13 and Lots 1, 2, 3, and 4 of Block 14, South Side Addition, located in the 500 block of 51h Street, City of Stephenville It was noted that a modification will need to be made concerning this agenda item; therefore, no discussion or action was taken. XI. PLANNING AND ZONING COMMISSION A. PUBLIC HEARING to consider request to rezone a 0.215 acre of land, Lot 4, Block 1, CVS @US Highway 67 Addition, City of Stephenville, from Retail and Commercial Business District B-2 to Multi -Family Residential District R-3 Mayor Weldon opened a public hearing. Noah Cullis, Director of Planning and Building Services, reported that the Planning and Zoning Commission unanimously recommends approval of this request. Speaking in Favor of Rezoning: Greg Jackson, owner of the property, thanked the council for its consideration of this matter. He said that he has recently built and opened a nail spa on property adjacent to subject property and seeks to construct a duplex on the property if rezoning is approved. f Speaking in Opposition of Rezoning: No one. Mayor Weldon closed the public hearing. B. Consider adopting Ordinance No. 2016-_ rezoning from Retail and Commercial Business District B-2 to Multi -Family District R-3, 0.215 acres of land, Lot 4, Block 1, CVS @ US Highway 67 Addition, City of Stephenville MOTION by Mark McClinton, second by Alan Nix, to adopt Ordinance No. 2016-0-07. MOTION CARRIED by unanimous vote. XII. CONSENTAGENDA MOTION by Alan Nix, second by Mark McClinton, to approve the Consent Agenda. MOTION CARRIED by unanimous vote. A. Approve Minutes 1. Comments by City Administrator Pat Bridges thanked the directors and city staff for their work on the Fourth of July parade and celebration in the park. He said there efforts and planning helped to ensure a successful event. Council budget work sessions will be conducted August 1-5 at 5:30 p.m. XIV. Comments by Council members Mark McClinton also thanked everyone for the success of the Fourth of July events. He thanked those people who participated in the City Park clean-up on June 11 following the flood events. He specifically thanked CH2MHILL OMI fordonating shovels, wheelbarrows and other equipment; HEB and Santa Fe Taco for donations of food; and Erath County Sheriff's Department for providing community service workers. Carla Trussell also thanked everyone involved in the success of the Fourth of July events. She especially thanked Mike Moncrief, Cliff Reese, and Freddie Martinez for voluntarily picking up trash along the route following the parade. She also thanked Jesus Coronado, Park Superintendent, for trimming, mowing, and cleaning the median at US 57/South Loop. Rhett Harrison also applauded the success of the July 4th events. He said that it brings about a very wholesome, down-home type atmosphere that is indicative of who we are. Harrison said that the day's celebration also included his wife's birthday. He said that he had a chance to sample Jimmy Finney's funnel cake and recommends them. Alan Nix acknowledged the city's police and fire departments as well as street and utility departments. Nix said that we are blessed with a group of outstanding employees. Mayor Weldon said that it is exceptional for us to have as a community with a sense of family and love for our town. XV. EXECUTIVE SESSION. At 6:32 p.m., Mayor Weldon recessed the open portion of the meeting, and council went into executive session in compliance with the provisions of the Texas Open Meetings Law, Subchapter D, Government Code, Vernon's Texas Codes, Annotated, in accordance with Sec. 551.071(a) Consultation with Attorney; pending or contemplated litigation —Lamar Advantage Holding Company v.
