The City Council of the City of Stephenville, Texas, convened in special session on January 16, 1996, at 5:30 p.m., in the Council Chambers at City Hall, 354 N. Belknap Street, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes. Annotated, with the following members present, to wit: Mayor C ouncilmemb ers : Others Attending I. CALL TO ORDER Lavinia Lohrmann Barbara Terrell John Pollan Scott Evans Billy Bob Hodges Bill Corbin Jim McCray Darrell W. Brown Joel Hillin Don Davis, City Administrator Cindy L. Stafford, City Secretary Randy Thomas, City Attorney Mayor Lohrmann called the meeting to order at 5:30 p.m. and declared a quorum present. II. ACTIVITY REPORT ON DELINQUENT TAX COLLECTIONS Jeff Brown, attorney with the firm of Calame Linebarger Graham & Pena, L.L.P., gave the report of delinquent ad valorem tax collections made on behalf of the City. He stated that during the period from September 1, 1994 through December 31, 19951 the amount of $91,650.27 has been collected for the City in delinquent taxes, penalty and interest. January 16, 1996 Minutes 292 III. FINANCE COMMITTEE A. Cemetery Fees Councilmember Corbin gave the report for the Finance Committee, and stated that an Urn Garden has been established as part of the West End Cemetery Expansion. Also, stipulations need to be made for "stacking interments". Councilmember Corbin moved that the following fees, lot sizes, and regulations be adopted for the Cemetery Department: Urn Garden: Lot size to be 24 inches by 24 inches. Rules and Regulations: Only individual plot markers will be allowed. All markers shall leave at least cone -inch border around each plot. All markers shall be of a flat type and maybe no higher than one inch above Bound level. No glass or breakable containers allowed. No landscaping of any type will be allowed. Fees per lot: City residents, $175; County residents, $185; Non -property owner in city or county, $200. These fees do not include filing fee with the county clerk, which at the present time is $9.00 per one page document. Stacking Interment: Rules and Regulations: Bottom interments must be buried in concrete vault. All top interments must be buried in accordance with city operated cemetery guidelines. All burials will follow state guidelines, according to State Health and Safety Codes. Fees: Plots sell for double the price of regular plots. City residents, $700; County residents, $750; Non -property owner in city or county, $800. These fees do not include filing fee with the county clerk, which at the present time is $9.00 per one page document. Be Defibrillator Specifications Councilmember Corbin moved to approve the bid specifications for two monitor defibrillators. Councilmember Hillin seconded the motion which passed by unanimous vote. C. Fire Truck Specifications Councilmember Corbin requested that this item be moved for discussion in the Executive Session. There was no opposition to this request. January 16, 1996 Minutes 293 IV. D. Gasoline Bids E. City Computer Plan PROCLAMATION FOR "COWBOY APPRECIATION DAY" Councilmember Evans moved to adopt a proclamation designating Friday, January 26, 1996, as Cowboy Appreciation Day, to honor local cowboys and cowgirls, Ty Murray, Tom Reeves, Jerry Jetton, Adam Carrillo, Tuff Hedeman, and J. J. Hampton. V. EXECUTIVE SESSION At 6:05 p.m. Mayor Lohrmann recessed the open portion of this meeting, and the Council immediately went into executive session in compliance with the provisions of the Texas Open Meetings Law, Subchapter D., §551.072, Government Code, Vernon's Texas Codes, Annotated, in accordance with the authority contained in Deliberation Regarding Real Property. VI. ACTION TAKEN ON MATTERS DISCUSSED IN EXECUTIVE SESSION (if necessary) Mayor Lohrmann reconvened the Council into open session at 6:55 p.m. Councilmember Evans moved to authorize City Administrator Don Davis to continue to negotiate a contract for sale for new city property. The motion was seconded by Councilmember McCray. Councilmembers Terrell and Corbin, having filed an Affidavit of Conflict of Interest with the City Secretary, abstained from voting on this motion. The motion passed by the following vote: AYES: Councilmembers Hodges, Pollan, Evans, Hillin, Brown, McCray, and Mayor Lohrmann. NOES: None. ABSTENTIONS: Councilmembers Terrell and Corbin. Councilmember Evans moved to approve the bid specifications on the three fire trucks. Councilmember Corbin seconded the motion which passed by unanimous vote. ADJOURN There being no other business to come before the Council at this time, Mayor Lohrmann adjourned the meeting at 6 : 5 7 p.m. January 16, 1996 Minutes 294 ATTEST: Cindy L affor , 00 City Se etary January 16, 1996 Minutes Ilb -.00d.,.o 'o r....;p _ _ avinia Lon,hrmanayor 295 PROCLAMATION WHEREAS, the City of Stephenville and Erath County are very fortunate in having an Ate group of cowboys and cowgirls residing in our community; and WHEREAS, the City of Stephenville and Erath County have become the beneficiaries of the talents of these professional athletes, as evidenced by Stephenville being recognized as the Cowboy Capitol of the World; and WHERFAs, these professional cowboys and cowgirls serve as ambassadors for the City of Stephenville as they travel throughout the nation; and WHEREAS, the community feels indebted to these six athletes for an outstanding job of competing in the Professional Rodeo Cowboys Association and the Professional Wornen's Rodeo Association. NOW, THE FORE, I, Lavinia Lohrmann, Mayor of the City of Stephenville, do hereby proclaim JANUARY 26, 1996 as COWBOY APPI2ECIATION DAY in the City of Stephenville and do hereby recognize and acknowledge the efforts of Ty Murray, Tom Reeves, Jerry Jetton, Adam Carrillo, Tuff Hecleman, and J. J. Hampton for their outstanding accomplishments. FURTHER, the City of Stephenville hereby expresses its appreciation to these professional cowboys and cowgirls for heir line representation of this community.
