ORDINANCE AUTHORIZING THE MAYOR, LARRY HAMMETT, TO EXECUTE
RIGHT-OF-WAY EASEMENT TO ERATH COUNTY, TEXAS, ON STRIP OF LAND
OUT OF THE CITY OF STEPHENVILLE LANDFILL FOR PUBLIC ROADWAY
PURPOSES, PROVIDING THAT ERATH COUNTY WILL CONSTRUCT AND
MAINTAIN FENCE ON INSIDE BOUNDARY LINE OF THE EASEMENT
SEPARATING SUCH STRIP OF LAND FROM THE CITY OF STEPHENVILLE
LANDFILL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Section One
Larry Hammett, Mayor of the City of Stephenville, is hereby
authorized to execute deed, on behalf of the City, to Erath
County, Texas, granting and conveying to Erath County an
easement for public roadway purposes in consideration of Erath
County, Texas, constructing and maintaining a fence separating
such land from the landfill area, that certain parcel of land
out of said landfill site and on and across such parcel of land,
described as follows:
All that certain 4.66 acre tract of land out of the T. S,
Freeman Survey, Abstract No. 280, in Erath County, Texas,
being part of that certain 100 acre tract of land described
in deed from Cecil C. Smithey et ux to the City of
Stephenville, dated February 20, 1973 and recorded in Volume
486, page 268 of the Deed Records of Erath County, Texas, and
described as follows:
BEGINNING at an iron rod set in the east line of a County
Road, being the SE corner of the E. Ruiz Survey and at an
inner corner of the T. S. Freeman Survey, being the NE corner
of the City of Stephenville 100 acre tract described in deed
mentioned above, for the NE corner of this tract, from which
a fence corner post hole at the NE corner of said County Road
bears N 290 29' W, 19.4 feet;
THENCE S 290 29' E, along a fence line along the east line of
said County Road, 2362.79 feet to a railroad spike found in
place at the S,E corner of said 100 acre tract, for the SE
corner of this tract;
THENCE S 590 07' 06" W, along the south line of said 100 acre
tract, at 36.12 feet pass a fence corner post in the west
line of said County Road, continuing in all 56.12 feet to an
iron rod set for the most easterly SW corner of this tract;
THENCE N 290 32' 54" W, parallel to and 20 feet westerly at
right angles from a fence line along the west line of said
County Road, 2300.13 feet to an iron rod set for an inner
corner of this tract;
THENCE N 750 11' 09" W, 33.28 feet to an iron rod set for an
inner corner of this tract;
THENCE S 590 11' 10" W, parallel to and 20 feet southerly at
right angles from a fence line along the south line of a
County Road, 1761.58 feet to an iron rod set in the west line
of said 100 acre tract, for the most northerly SW corner of
this tract;
THENCE N 290 40' 51" W, at 20 feet pass a fence corner post
in the south line of said County Road, continuing in all
36.20 feet to an iron spike found in place in said County
Road, being the NW corner of said 100 acre tract, for the NW
corner of this tract;
THENCE N 590 06' 12" E, along said County Road and the south
line of the E. Ruiz Survey, 1844.33 feet to the place of
beginning and containing 4.66 acres of land with 2.78 acres
being within the right of way of an existing County Road.
