ORDINANCE DECLARING THAT -PORTION OF NORTH. CAREY AVENUE SITUATED
BETWEEN- WEST ELM STREET ' ON THE SOUTH AND ' WEST" OAK STREET ON THE
NORTH TO HAVE- BEEN' ABANDONED FOR STREET --PURPOSES, ORDERING THE
SAME VACATED' AND CLOSED, FINDING THE VALUE -THEREOF. AND
AUTHORIZING THE- CONVEYANCE -.OF A PORTION OF SAME TO -JEAN
NOONKESTER, A PORTION OF -SAME TO JOSEPHINE MARTINEZ, A PORTION
OF SAME TO RONNIE FROST AND A PORTION'OF SAME TO R. VIRGIL
RAINS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,
TEXAS:
Section One
That certain land being that part of North Carey Avenue
bounded on the south by West Elm Street and on the North by West
Oak Street and described as follows:
0.239 acre, and being part of North Carey Avenue, situated
between Blocks 10 and 11, Crow -Styles Addition to the City
of Stephenville, Erath County, Texas, according to King's
1956 Map of said City, attached to adoption recorded in
Volume 381, page 105, Deed Records of Erath County, Texas,
and the 0.239 acre being described as follows:
BEGINNING at an iron rod set at the SW corner of Block 11,
Crow -Styles Addition, in north line of West Elm Street and
east line of North Carey Avenue, for the SE corner of this
tract;
THENCE S 601 W with north line of West Elm Street, 50 feet
to an iron rod set at the SE corner of Block 10 f or the SW
corner of this tract;
THENCE N 301 W 208 feet to an iron rod at the NE corner of
Block 10, for the NW corner of this tract;
THENCE N 600 E with south line of West Oak Street 50 feet
to an iron rod set at the NW corner of Block 11 for the NE
corner of this tract;
THENCE S 301 E 208 feet to the place of beginning,
containing 0.239 acre;
is hereby declared to have been abandoned for street purposes
and is hereby ordered vacated and closed for street purposes.
Section Two
That portion of the land hereinabove described and being
the easterly 25 feet of the northerly 104 feet has been
appraised and is hereby found by the City Council of
Stephenville, Texas to be of a value of $390.00. Said amount
having been offered by Josephine Martinez for said land, it is
hereby ordered and directed that Larry Hammett, Mayor of the
City of Stephenville, execute a special warranty deed to the
said Josephine Martinez, and such deed shall be delivered to the
said Josephine Martinez upon the payment by her to the City of
Stephenville of said amount of $390.00, the said Josephine
Martinez owning lot adjacent to said land and having the prior
right to purchase same.
Section Three
That portion of the land hereinabove described and being
the westerly 25 feet of the northerly 104 feet has been
appraised and is hereby found by the City Council of
Stephenville, Texas to be of a value of $390.00. Said amount
having been offered by Jean Noonkester for said land, it is
hereby ordered and directed that Larry Hammett, Mayor of the
City of Stephenville, execute a special warranty deed to the
said Jean Noonkester, and such deed shall
said Jean Noonkester upon the payment by
Stephenville of said amount of $390.00, the
owning lot adjacent to said land and having
purchase same.

easterly 15 feet of the southerly 104 feet has been appraised and
is hereby found by the City Council of Stephenville, Texas to be
of a value of $234.00. Said amount having been offered by Ronnie
Frost for said land, it is hereby ordered and directed that Larry
Hammett, Mayor of the City of Stephenville, execute a special
warranty deed to the said Ronnie Frost, and such deed shall be
delivered to the said Ronnie Frost upon the payment by him to the
City of Stephenville of said amount of $234.00, the said Ronnie
Frost owning lot adjacent to said land and having the prior right
to purchase same.
Section Five
That portion of the land hereinabove described and being the
westerly 35 feet of the southerly 104 feet has been appraised and
is hereby found by the City Council of Stephenville, Texas to be
of a value of $546.00. Said amount having been offered by R.
Virgil Rains for said land, it is hereby ordered and directed
that Larry Hammett, Mayor of the City of Stephenville, execute a
special warranty deed to the said R. Virgil Rains, and such deed
shall be delivered to the said R. Virgil Rains upon the payment
by him to the City of Stephenville of said amount of $546,00, the
said R. Virgil Rains owning lot adjacent to said land and having
the prior right to purchase same.
PASSED and APPROVED this 2nd day of February, 1988.
