ORDINANCE DECLARING THAT PORTION OF TURNER STREET IN THE CITY
OF STEPHENVILLE AND BEING OF THE DIMENSIONS OF 50 FEET ON ITS
NORTH AND SOUTH LINES AND 40 FEET ON ITS EAST AND WEST LINES
AND LOCATED IMMEDIATELY NORTH OF LOT 12 OF BLOCK A-30 OF
GROESBEECK-AND McLELLAND ADDITION IN THE CITY OF STEPHENVILLE
AS SHOWN BY KING'S 1956 MAP OF STEPHENVILLE TO HAVE BEEN
ABANDONED AS A STREET, ORDERING SAME VACATED AND CLOSED AND
PROVIDING FOR THE CONVEYANCE THEREOF TO DAN MALONE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE:
Section One
That portion of Turner Street in the City of
Stephenville which is adjacent to land owned on the west and
north by Tarleton State University and on the south and east
by Dan Malone and being of the dimensions of 50 feet on its
north and south lines and 40 feet on its east and west lines
and located immediately north of Lot 12 of Block A-30 of the
Groesbeeck and McLelland Addition in the City of Stephenville
as shown by King's 1956 Map of Stephenville at page 690
thereof is hereby declared to have been abandoned for street
purposes and said portion of said street is hereby ordered
vacated and closed.
Section Two
That portion of Turner Street hereinabove described has been
appraised and is hereby found by the City Council of the City
of Stephenville to be of the value of $200.00. Tarleton
State University and Dan Malone are the only owners of land
adjacent to that portion of Turner Street above described,
and Tarleton State University has executed relinquishment of
any rights to purchase any portion of said land. The sum of
$200.00 having been offered by -Dan Malone for the purchase of
said land, it is hereby ordered and directed that George
Swearingen, Mayor of the City of Stephenville, execute a
special warranty deed to Dan Malone conveying the above
described land, and such deed shall be delivered to said
grantee upon payment by him to the City of Stephenville of
said sum of $200.00 together with costs of preparing
relinquishment from Tarleton State University and deed to him
in the sum of $75.00,
PASSED and APPROVED this ZZ day of July, 1989.
