HomeMy WebLinkAbout1990-O-14 - Municipal Solid Waste Management RegulationsORDINANCE NO. 1990-14 AN ORDINANCE DECLARING THAT ALL REGULATIONS OF THE MUNICIPAL SOLID WASTE MANAGEMENT REGULATIONS AS PUBLISHED BY THE TEXAS HEALTH, AND THE UNITED STATES ENVIROMENTAL PROTECTION OTHER APPLICABLE RULES AND REGULATIONS OF THE FEDERAL, AND CITY SHALL BE OBSERVED. DEPARTMENT OF AGENCY AND ALL STATE, COUNTY, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: SECTION ONE Compliance with Laws. All regulations of the Municipal Solid Waste Management Regulations as published by the Texas Department of Health, and the United States Enviromental Protection Agency and all other applicable rules and regulations of the federal, state, county, and City shall be observed, and shall include the following: A. Occupants of residence shall place their garbage into city approved containers and shall place the container adjacent to the street on which the residence is located between the property line and pavement edge for pick up for the general garbage collection. B. Grass clippings and leaves shall be placed into city approved containers by the resident with a maximum number of ten (10) and shall be placed between the property line and pavement edge. Brush shall be bundled or boxed in a manageable condition and not to exceed four (4) feet in _ length and individual pieces not to exceed four (4) inches in diameter. C. Residential customers who are physically impaired from carrying containers shall not be required to place their garbage containers between the property line and pavement edge. Arrangements shall be made with the Contractor for the location of the containers. D. Every resident shall keep all garbage containers used by such person securely closed in such a manner as to prevent the scattering of the contents. E. The meddling, pilfering, scattering contents, or illegal use of all garbage containers shall be prohibited. F. No fecal material, oil, sludge, and any radioactive, toxic, acidic or volatile material, or other waste, chemical, compound, mixture, substance, or article designated by the terms defined in the Municipal Solid Waste Management Regulations of the Texas Department of Health shall be placed with the general collection of non -hazardous waste. G. Tires shall be split, quartered, or shredded prior to being a part of the general collection, no whole tires shall be permitted as a part of the general collection. H. Recycling of solid waste and collection of hazardous household waste shall be done in accordance with the Municipal Solid Waste Management Regulations of the Texas Department of Health. I. Commingling of hot incinerated ash with other refuse shall be prohibited. SECTION TWO Landfill Opa eratin Hours. The City Landfill will be open to the public as follows: Monday 8:30 a.m. - 3,00 p.m. Tuesday 8:30 a.m. - 3:00 p.m. Wednesday 8:30 a.m. - 3:00 p.m. Thursday 8:30 a.m. - 3:00 p.m. Friday 8:30 a.m. - 3:00 p.m. Saturday 8:30 a.m. - 12:00 noon SECTION THREE Landfill Rates. The schedule of fees for services and disposal of solid waste at the City of Stephenville Landfill are as follows: A. Minimum Charcre $10.00 This includes cars, pick-ups, vans, and suburbans. Pick-ups with loads up to bed level will be included in the minimum charge fee; however, pick- ups with loads over the bed will be charged by the cubic yard. All other vehicles such as trucks, trailers, roll offs, and compactors, will be charged by total capacity on a per cubic yard basis. B. Cubic Yard Charge for solid waste disposal will be a minimum of $4.25 per cubic yard. The City shall retain the right to negotiate tipping fee rates with all commercial haulers. C. Special Waste Fees - Solid Waste which requires special handling shall be as follows: 1. Bio-Medical Waste - $35.00 per cubic yard (1 cubic yard minimum) 2. Asbestos - $35.00 per cubic yard (2 cubic yard 1111.111111 U111 ) 3. Bulky Items (such as trees and shrub trimmings exceeding 4in length and/or 4" in diameter, wire, wooden pallets, mattresses, and building materials) - $6.75 per cubic yard. D. No Tarp or Cover Charge $5.00 - This charge is for all vehicles transporting solid waste to the Landfill without a cover, tarp, or other means of securing the load in a manner to prevent items from falling or blowing from the vehicles. SECTION FOUR Residential Rates. Residential rates for garbage collection shall be $7.00 per month and billed as a part of the water and sanitary sewer billing. SECTION FIVE Commercial Accounts. All commercial accounts shall be billed for garbage collection of an amount not less than $7.00 as a part of the water and sanitary sewer billing. SECTION SIX Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $200.00. �/'1 SECTION SEVEN � t This ordinance shall go into effect immediately from and after its passage and publication as provided by law.
