HomeMy WebLinkAbout1990-O-04 - Section XXIII Of Zoning OrdinanceORDINANCE 1990-04 AN ORDINANCE AMENDING SECTION XXIII OF THE ZONING ORDINANCE OF THE CITY OF STEPHENVILLE PROVIDING CONDITIONS FOR THE ISSUANCE OF SPECIAL USE PERMITS FOR CONDITIONAL USES AS LISTED IN EACH ZONING DISTRICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One That Subsection 2(h) of Section XXIII of the Zoning Ordinance of the City of Stephenville -be amended to read 44 as follows: Authorize the issuance of special use permits for _ conditional uses as listed in each zoning.district. The Board of Adjustment may require compliance with such conditions as to operations, site development, parking, signs and time limit as may be deemed necessary in order that such use will not seriously injure the appropriate use of neighboring property, and will conform to the general intent and purpose of this Ordinance. Such uses shall comply with the height and area regulations, and parking and green space regulations, of the district in which they may be located. A building permit or certificate of occupancy shall not be issued for any use to be located in a zoning district which permits that use only as a. conditional use unless a special use permit has first been issued by the Board of Adjustment in accordance with the following provisions. A special use permit may be granted by the Board of Adjustment if the following conditions have been met: 1. That the specific use will be compatible with and not injurious to the use and enjoyment of other property and will not significantly diminish or or impair property values within the vicinity. 2. That the establishment of the specific use will not impede the normal and orderly development and improvement of surrounding property. 3. That adequate utilities, access, drainage and other necessary supporting facilities- have been or will be provided. 4. The design, location, and arrangement of all drive- ways and parking spaces will provide for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments. 5. That adequate safety and nuisance -prevention meastres have been or will be taken to prevent or control offensive odor, fumes, dust, noise, vibration and conditions and activities dangerous to persons or property. 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring property. 7. That there is sufficient landscaping and/or screening to insure harmony and compatibility with adjacent property. 8. .Special use permits shall be for a period of time not to exceed two (2) years. Upon reapplication, to the Board of Adjustment, the filing fee will be waived, and the time may be extended for successive periods of two (2) years, provided there shall be new notice and public hearing before each extension. � Section Two .This ordinance shall go into effect from and after its passage as provided by law. .
