HomeMy WebLinkAbout1991-O-11 - Uniform Plumbing CodeORDINANCE NO. 1991 - 11 AN ORDINANCE OF THE CITY OF STEPHENVILLE, TEXAS, ADOPTING THE 1988 EDITION OF THE UNIFORM PLUMBING CODE AS AMENDED, REGULATING THE ERECTION, INSTALLATION, ALTERATION, ADDITION, REPAIR, RELOCATION, REPLACEMENT, MAINTENANCE OF USE OF ANY PLUMBING OR RAINWATER SYSTEM OR PARTS THEREOF, INCLUDING ALL PIPING, FITTINGS, FIXTURES, APPURTENANCES AND ETC., USED FOR THE CONDUCTION OF WATER, SEWAGE, GAS AND RAINWATER IN AND ABOUT ALL BUILDINGS, STRUCTURES AND PREMISES IN THE CITY OF STEPHENVILLE, TEXAS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; REPEALING CHAPTER 14, SECTION 1, OF THE CODE OF ORDINANCES OF THE CITY OF STEPHENVILLE ENTITLED "UNIFORM PLUMBING CODE - 1982 EDITION" AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: SECTION ONE That certain documents, one (1) copy of which is on file in the office of the City Secretary of the City of Stephenville, Texas, being marked and designated as "UNIFORM PLUMBING CODE - 1988 EDITION," including all appendices as published by the International Association of Plumbing and Mechanical Officials and as revised and amended by the same and the City Council of the City of Stephenville; be and the same is hereby adopted as the code of the City of Stephenville, for regulating the erection, installation, alteration, addition, repair, relocation, replacement, maintenance or use of any plumbing or rainwater system or parts thereof, including all piping, fittings, fixtures, appurtenances and etc., used for the conduction of water, sewage, gas and rainwater in and about all buildings, structures and premises in the City of Stephenville; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions, and terms of such "UNIFORM PLUMBING CODE - 1988 EDITION," including all appendices as published by the International Association of Plumbing and Mechanical Officials and as revised and amended by the same and the City Council of the City of Stephenville, Texas, on file in the office of the City Secretary of the City of Stephenville, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance. SECTION TWO All construction and installation covered by such code shall be inspected by the City Inspector of the City of Stephenville who shall determine whether such code has been complied with and upon finding any violation of the code is authorized to make written report to the person making such violations, what these violations are and to give the installer a specified time to correct such violations. If same are not corrected within the time specified, installer shall be guilty of misdemeanor and complaint may be filed by the City in the Municipal Court of the City of Stephenville for violation of this code and upon conviction of this violation, the ro") person found guilty shall be fined in any sum not less than $50,00 nor more than $200.00. Each days continuation of the violation shall constitute separate offense. SECTION THREE That Chapter 14, Section 1, of the Code of Ordinances of the City of Stephenville, Texas, entitled "Uniform Plumbing Code - 1982 Edition," and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION FOUR That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION FIVE That the City Secretary of the City of Stephenville, Texas is hereby ordered and directed to cause this ordinance to be published in a newspaper in general circulation. SECTION SIX That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect thirty ( 30 ) days from and after the date of its passage and adoption.
