Barnes, City Manager Staci L. King, City Secretary Randy Thomas, City Attorney I. Call to Order Mayor Svien called the meeting to order at 5:30 p.m. II. Regular Agenda 1. First Reading of an Ordinance Granting to Atmos Energy Corporation a Franchise to Construct, Maintain, and Operate Pipelines and Equipment in the City of Stephenville, Texas for the Transportation, Delivery, Sale, and Distribution of Gas In, Out Of, and Through Said City for all Purposes Staci King, City Secretary, read the caption of the ordinance in accordance with the City of Stephenville Charter. An additional two readings are required by city charter before action can be taken. 2. Consider Approval of a Resolution Approving a Negotiated Settlement Between the Atmos Cities Steering Committee and Atmos Energy Crop. Regarding the Company's 2020 Rate Review Mechanism Filing Rochelle Ditmore, Atmos Energy Corporation, was present to answer questions. MOTION by Brady Pendleton, second by Mark McClinton, to approve Resolution No. 2020-R-21 approving a negotiated settlement between Atmos Cities Steering Committee and Atmos Energy Corp. regarding the company's 2020 Rate Review Mechanism Filing. MOTION CARRIED by unanimous vote. 3. Set the Maximum Proposed Tax Rate MOTION by Mark McClinton, second by Alan Nix, to set the maximum proposed tax rate at $0.4574 per $100 valuation. MOTION CARRIED by unanimous vote. 4. Set the Time, Date, and Location of Public Hearings on the Proposed Tax Rate MOTION by Mark McClinton, second by Gerald Cook, to set the time, date, and location of the public hearing on the FY2020-2021 as follows: Tuesday, September 15, 2020 at 5:30 p.m. in the City Hall Council Chambers, 298 W. Washington. MOTION CARRIED by unanimous vote. III. Planning and Zoning Commission Steve Killen, Director of Development Services PUBLIC HEARING Case No: RZ2020-007 - Applicant is Requesting a Rezone of the Property Located at 1540 West Long, Being Lot 2, Block 8 of the South Side Addition to the City of Stephenville, Erath County, Texas, from Industrial District (1) to Multi -Family District (R-3) Steve Killen, Director of Development Services, presented the application to Council. Planning and Zoning Commission made a unanimous positive recommendation. Mayor Svien opened the public hearing. No one came forward to speak in favor of or opposition to the rezone. Mayor Svien closed the public hearing. Consider Approval of an Ordinance Rezoning the Property Located at 1540 West Long, Being Lot 2, Block 8 of the South Side Addition to the City of Stephenville, Erath County, Texas, from Industrial District (1) to Multi -Family District (R-3) MOTION by Justin Haschke, second by Alan Nix, to approve Ordinance No. 2020-0-25 rezoning the property located at 1540 West Long, being Lot 2, Block 8 of the South Side Addition to the City of Stephenville, Erath County, Texas, from Industrial District (1) to Multi -Family District (R-3). MOTION CARRIED by unanimous vote. PUBLIC HEARING Case No.: RZ2020-008 - Applicant is Requesting a Rezone of a Property Located at 811 N. Miller, being Lot 9A, Block 2 of the Miller Addition to the City of Stephenville, Erath County, Texas, from Neighborhood Business District (B-1) to Industrial District (1) Steve Killen, Director of Development Services, presented the application to Council. Planning and Zoning Commission made a unanimous positive recommendation. Mayor Svien opened the public hearing. No one came forward to speak in favor of or opposition to the rezone. Miller, being Lot 9A, Block 2 of the Miller Addition to the City of Stephenville, Erath County, Texas, from Neighborhood Business District (B-1) to Industrial District (1). MONTHLY BUDGET REPORT Monica Harris, Director of Finance, gave the following report: In reviewing the financial statements ending July 31, 2020, the financial indicators are as expected, considering the impact of COVID-19. Property Tax - We received $42K in property taxes in the month of July, resulting in a $426K or 7.03% increase over funds collected through July last fiscal year. The $6.48 million collected through July is 100.85% of budget. Sales Tax - We received $500K in sales tax in July, resulting in $21K or 4.48% more than the funds collected last July. The $5.2 million collected is 79.3% of the $6.57 million budgeted, which is about 3.5% less than anticipated. HOT Funds - We received $254K in revenue in the Hotel Occupancy Tax fund through July, as compared to $355K in revenue through last July. We spent $138K in Hotel Occupancy Tax funds through July as compared to $393K last year. Both are a direct reflection of the impact of COVID- 19. Revenue (Budgetary comparison) - The target budget for operating revenue is $24.1 million. We received $24.08 million in revenue through July, resulting in $20K under the target budget. This is a result of the impact of COVID-19. Expenditures (Budgetary comparison) - The target budget for operating expenditures is $17.4 million. We expended $15.4 million through July resulting in $1.92 million under the target budget. Revenue (Prior year comparison) - Operating revenue received last year was $23 million as compared to the current year's $24.08 million, resulting in a $1.13 million increase due to service charges, property taxes, grants, and insurance proceeds. Expenditures (Prior year comparison) - Operating expenditures last year were $15.36 million as compared to the current year's $15.43 million, resulting in a $76K increase due to wages and City Of Stephenville Regular City Council Meeting - 01 Sep 2020 Page 3 of 5 benefits, maintenance, and marketing and grants for SEDA. New Programs - The Downtown Revitalization project and the CDBG GLO project are still in progress. VII. Stephenville Type B Economic Development Authority Update Jeff Sandford, Executive Director, updated council on economic development activity in Stephenville. He also updated the council on SEDA's efforts to assist businesses affected by COVID-19. Vill. CONSENT AGENDA 1.
