HomeMy WebLinkAbout2020-03-25 - Special City Council0-4 841W tE'�kr<5 Special City Council Meeting Wednesday, March 25, 2020 at 2:00 PM The City Council of the City of Stephenville, Texas, convened on Wednesday, March 25, 2020, at 2:00 PM, in the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Special City Council Meeting, with notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: COUNCIL PRESENT: COUNCIL ABSENT: OTHERS ATTENDING: Mayor Doug Svien Council Member Mark McClinton Council Member Carla Trussell Council Member Nick Robinson Mayor Pro Tern Brady Pendleton Council Member Ricky Thurman Council Member Alan Nix Council Member Gerald Cook via Videoconference Council Member Brandon Huckabee Allen L. Barnes, City Manager Staci L. King, City Secretary Randy Thomas, City Attorney EMPLOYEE BENEFITS TRUST MEETING 1. Call to Order Mayor Svien called the meeting to order at 2:00 p.m. 2. Employee Health Benefits for 2020-2021 Employee Health Benefit plans for 2020-2021 were presented. 3. Adjourn The meeting was adjourned at 2:10 p.m. II. SPECIAL CITY COUNCIL MEETING 1. Call to Order Mayor Svien called the meeting to order at 2:10 p.m. 2. Consider Approval of Employee Benefits for 2020-2021 This item was tabled to the next council meeting. 3. Consider Approval of an Ordinance Postponing May 2, 2020 Special Election to the November 3, 2020 Uniform Election Date MOTION by Mark McClinton, second by Brady Pendleton, to approve Ordinance No. 2020-0-14 postponing the May 2, 2020 Special Election to the November Uniform Election Date. MOTION CARRIED by unanimous vote. 4. Consider Approval of an Extension of the Declaration of Public Health Emergency Adopted on March 18, 2020 and Other Matters Related Thereto Mayor Svien recessed the council meeting at 2:24 p.m. to allow the Erath County Commissioner's Court to approve a Declaration of Disaster. Mayor Svien called the meeting back to order at 2:54 p.m. MOTION by Brady Pendleton, second by Gerald Cook, to amend the City's March 18, 2020 Declaration of Public Health Emergency to incorporate the conditions of Erath County's March 25, 2020 Declaration of Public Health Emergency. MOTION TO AMEND (1) by Brady Pendleton, second by Carla Trussell, by the addition of the following "Businesses Resaonsibility to the Public: Businesses, employers, employees and customers all have a shared responsibility to promote public health in the normal course of business activities. All businesses operating within the City of Stephenville, Texas are ORDERED to take extreme care and all actions necessary to prevent the spread of COVID-19. Extreme care and action include but is not limited to the following practices: a. Monitoring the body temperature of all employees; b. Prior to opening for business and throughout the day disinfecting all surfaces; c. Encouraging all employees to wash their hands on an hourly basis; d. Mandate all employees and customers abide by the social distancing guidelines attached; e. Limit travel of employees outside the city limits of the City of Stephenville, Texas; and f. Allow employees whose job functions permit them to work within the confines of their own home to do such. Businesses and employers are encouraged to implement any and all measures necessary to prevent the spread of COVID-19 and are ORDERED to post all measures on the door of entrance to their businesses." MOTION TO AMEND THE AMENDMENT by Carla Trussell, second by Brady Pendleton, to amend by the addition of the requirement "All businesses must provide hand sanitizing stations at at least one entrance." AMENDMENT CARRIED by unanimous vote. MOTION TO AMEND (1) carried by unanimous vote. MOTION TO AMEND (II) by Brady Pendleton, second by Ricky Thurman, to define a gathering as follows:" an assembly or meeting, especially a social or festive one, or one held for a specific purpose not to include essential business activities." MOTION CARRIED, Brandon Huckabee casting a dissenting vote. MOTION TO AMEND (III) by Mark McClinton, second by Brady Pendleton, to include language that the city will not terminate utility services for the duration of the disaster City Of Stephenville Special City Council Meeting - 25 Mar 2020 declaration. MOTION CARRIED, Brandon Huckabee casting a dissenting vote. MOTION TO AMEND (IV) by Ricky Thurman, second by Brady Pendleton, by the addition of the following "This Declaration hereby orders that, in an effort allow for a safer shopping environment and allow sufficient opportunity to find the goods they need, 6:00 am until 10:00 am, Monday, Thursday, and Saturday, are hereby designated as shopping times exclusively for those age 60 or over in all grocery stores, general goods stores, and dollar -type stores. This excludes hardware stores, pharmacies, and other soft goods stores. Those over the age of 60 may shop at any other time if they wish." MOTION TO AMEND THE AMENDMENT (IV) by Brandon Huckabee, second by Brady Pendleton, to change the senior shopping hours to 6:00 a.m. until 10:00 a.m. AMENDMENT CARRIED by unanimous vote. MOTION TO AMEND (IV) carried by unanimous vote. MOTION TO AMEND (V) by Carla Trussell to limit Walmart and HEB to no more than 100 customers. MOTION FAILED for lack of second. MOTION TO AMEND (VI) by Ricky Thurman to require that individuals showing symptoms of illness must use the drive-thru at the pharmacy, when available. Council member McClinton pointed out that the declaration already required those exhibiting symptoms to stay home. MOTION WITHDRAWN. MOTION TO AMEND (VII) by Brandon Huckabee, second by Ricky Thurman, by the addition of the following: "This Declaration hereby orders the closing of the following: Personal service businesses or one-to-one businesses including, but not limited to, tanning salons, tattoo and body piercing parlors, hair salons, barbershops, nail salons, massage parlors, and massage activities ancillary to another business unless prescribed by a professional health care provider." MOTION CARRIED, Mark McClinton and Brady Pendleton casting dissenting votes. MOTION TO AMEND (VIII) by Ricky Thurman, second by Brandon Huckabee, by the addition of language that designates $250,000 in funding to stimulate all restaurants in the city. MOTION TO AMEND THE AMENDMENT (VIII) by Nick Robinson, second by Mark McClinton, to include personal service/one-to-one businesses. AMENDMENT CARRIED by unanimous vote. MOTION TO AMEND (VIII) carried by unanimous vote. MOTION to adopt a Declaration of Public Health and Safety Emergency, as amended above, CARRIED by unanimous vote.
