HomeMy WebLinkAbout2020-R-06 - NCTCOG Solid Waste Programs Grant RESOLUTION NO. 2020-R-06 A RESOLUTION OF THE CITY OF STEPHENVILLE AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION WITH THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS ("NCTCOG") FOR A REGIONAL SOLID WASTE GRANTS PROGRAM GRANT; AUTHORIZING THE EXECUTIVE DIRECTOR TO ACT ON BEHALF OF CITY OF STEPHENVILLE IN ALL MATTERS RELATED TO THE APPLICATION;PLEDGING THAT IF A GRANT IS RECEIVED, CITY OF STEPHENVILLE WILL COMPLY WITH THE GRANT REQUIREMENTS OF NCTCOG,THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY("TCEQ")AND THE STATE OF TEXAS; PROVIDING FOR SEVERABILITY; REPEALING CONFLICTING RESOLUTIONS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the NCTCOG is directed by the TCEQ to administer solid waste grant funds for implementation of the NCTCOG's adopted regional solid waste management plan; and WHEREAS, City of Stephenville is qualified to apply for grant funds under the Request for Applications in the State of Texas. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF CITY OF STEPHENVILLE: SECTION 1. The Executive Director is hereby authorized to request grant funding under the NCTCOG Request for Applications of the Regional Solid Waste Grants Program and act on behalf of City of Stephenville in all matters related to the grant application and any subsequent grant contract and grant project that may result. SECTION 2. If the project is funded, the City of Stephenville will comply with the grant requirements of the NCTCOG, TCEQ, and the State of Texas. SECTION 3. The grant funds and any grant-funded equipment or facilities will be used only for the purposes for which they are intended under the grant. SECTION 4. Activities will comply with and support the adopted regional and local solid waste management plans adopted for the geographical area in which the activities are performed. SECTION 5. All Resolutions and parts thereof in conflict herewith are hereby expressly repealed insofar as they conflict herewith. SECTION 6. It is hereby declared that the sections, paragraphs, sentences, clauses and phrases of this resolution are severable and, if any phrase, clause, sentence, paragraph or section of this resolution shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this resolution, because the same would have been enacted by the City Council without the incorporation of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. This Resolution shall take effect immediately from and after its adoption and it is accordingly so resolved. PASSED and APPROVED this the 4th day of February, 2020. pfSTF C,� •• .••.15.
