BE IT RESOLVED by the City Council of the City of Stephenville, Texas, that the following named Streets in the City of Stephenville, Texas, DISTRICT No. 1. Vanderbilt Street: From its intersection with the W. property line of Cain Ave. to its intersection with the E. property line of Everett St. DISTRICT No. 2. Vanderbilt Street: From its intersection with the W. property line of Lillian St. to its intersection with the W. property line of Cain Ave. DISTRICT No. 3. Mcllhaney Avenue: From its intersection with the N. property line of Washington St. to its intersection with the S. property line of Vanderbilt St. DISTRICT No. 4. 011ie Avenue; From its intersection with the N. property line of Tarleton Ave. to its intersection with the N. property line of Frey St. DISTRICT No. 5. Clinton Avenue: From its intersection with the N. property line of Tarleton Ave. to its intersection with the S. property line of Vanderbilt St. DISTRICT leo. 6. Devine Street: From its intersection with the N. property line of Long St. to its intersection with the S. property line of Washington St. DISTRICT No. 32. Tarleton Avenue: From its intersection with the E. property line of N. Belknap Stl to its intersection with the W. property line of X. -Graham St. DISTRICT No. 33• Floral Strdet: From its intersection with the N. property line of Long St. to its intersection with the S. property line of College St. DISTRICT No. 34. Clinton Avenue: From its intersection with the N. property line ole Vanderbilt St. to its intersection with the S. property line of Frey Street, be improved as follows, to -wit: 1. That same shall be graded, raised and filled, 2. That the roadway of said Streets shall be improved with one of the following materials to be selected by the City Council after competitive bidding upon specifications therefor, to be prepared by the City Engineer, to-witeto a. 2j" Vitrified Brick Pavement on 9" Water Bound Macadam Base. b. 2111 Vitrified Brick Pavement on 5" Concrete Base. c. 1t" Warrenite Bitulithic Gearing Surface on Black Base. d. 2" Warrenite Bitulithic Wearing Surface on 5" Concrete. Base. e. 2" Rock Asphalt 'Nearing Surface on 9" 'Nater Bound Macadam Base. f. 2" Rock Asphalt nearing Surface on 5" Concrete Base. g. 6" One Course reinforced concrete pavement using mesh. h. 6" One Course reinforced concrete pavement using bars. i. 6" Vibrolithic Concrete Pavement. And, the City Engineer is directed forthwith to prepare and file with the City Council Specifications for the said improvement of said streets in accordance herewith. 3. That the cost of making the improvements be paid in the following manner, to -wit: a. The City of Stephenville, Texas, shall pay one-fourth the total cost of the improve:vents. b. The remainder of the cost of such improvements shall be paid by the owners of property abutting upon said Streets named to be unproved. The'portion of said cost payable by the City of Stephenville, Texas, shall be payable in cash monthly on or before the 15th day of the current month on estimates prepared by the City Engineer, in the swam of 900 of the value of the work done, and materials furnished, up to and including the last day of the preceding month. Upon com�letion of each unit, or district, of work the Engineer shall within fifteen days make certification thereof to the City, which shall then pay to the Contractor on or before the 15th day after the date of the final acceptance the balance due by it after deducting all previous payments and any monies that may be held under the terms of their Contract. That the portion of the cost of such im rovements payable by such property owners ahall be paid in six ( ) equal installments. One payable upon completion and acceptance of the work by the City, one within one year, one within two years, one within three years, one within four years, and one within five years from said date of acceptance, and to bear interest from said date at the rate of 8i0 per annum, provided that said owners shall have the right to discharge any installment before maturity by payment thereof with accrued interest. That the portion of said cost to be paid by the property owners shall be assessed against them and their property and constitute a personal liability of such property owners, and lien against their respective property and shall be assessed in accordance with the "Front Foot Plan or Rule", in proportion as the frontage of each owner is to the whole number of front feet of abutting property to be improved; provided, that if, in the opinion of. the City Council, the application of this rule shall be unjust or unequal in any case, then the City Council shall adipt such rule of apportionment as shall be just and equal and effect equality between property owners in view of the equities of each owner, the benefit to each and the burden im- posed upon each by means of such imL rovement; and, in no event shall any assessment be made against any owner or his property in excess of the actual benefit to such owner in the enhanced value of his property caused by such improvement; and, provided that no such assessment shall be made until after notice to such property owners and rearing to them, as provided by the General Paving Law. That the personal liability of such owners and the lien upon their property, as fixed by such assessment, shall be enforced as is provided by said charter by sale of said property as for ad valorem taxes of the City, or by suit in any court having juris- diction, together with costs and reasonable attorney's fees, if incurred. And after such assessment the City Council shall cause to be issued to the Contractor doing the work, assignable certificates in accordance with said General Paving Law, setting forth the amount assessed against each owner, and his property, and the terms and time of payment thereof. That the Contractor to whom the work may be let shall not be obligated to lay or construct any improvement in front of the property of any owner, which property may be exempt from the enforcement of an assessment against the same, unless such owner shall first secure to said Contractor to his or its satisfaction., the payment of the portion of Ahe cost payable for such improvement.
