City of Stephenville - City Council
Tuesday, March 4, 2014, 5:30 P.M.
The City Council of the City of Stephenville, Texas, convened on March 4, 2014, at 5:30 p.m., in
the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business
Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time,
place and subject thereof, having been posted as prescribed by Chapter 551, Government Code,
Vernon's Texas Codes Annotated, with the following members present, to wit:

Call to Order. The meeting of the Stephenville City Council was called to order at 5:30
p.m. on Tuesday, March 4, 2014, by Mayor Weldon.
H. Citizens' General Discussion.
Tarleton students Marisa Waldon, Andy Hatcher, and Sarah McCann addressed the
council to make citizens aware of the 16" Annual Tarleton Roundup, which is a day of
service performed by students, faculty/staff and community volunteers benefiting the
residents of Stephenville. This year's event will be held on March 22. Volunteers will
perform tasks such as washing windows, raking leaves, painting, and other cleaning
duties. This year recycling, tire haul off and document shredding services will be
available. The TSU Environmental Society will also be participating to conduct clean-up
work on the Bosque River.
Metta Collier, representing Keep Stephenville Beautiful (KSB), addressed council
concerning the Bosque River Trail Corridor Project (BRTC). She invited everyone to an
open house on March 20 where citizens can learn about the BRTC and the initial
planning for a strategic plan for this effort. The final document will be submitted to
council for adoption in June 2014. Collier reported that efforts to improve the Bosque
River began in 2011 when the city, county, and Texas Department of Transportation
joined forces to clean a one -mile area of the river stretching from the College Farm Road

Bridge to the Washington Street Bridge and the low water crossing on Long Street. This
project included clearing of massive timber and log jams as well as major dump sites
containing tires, household appliances, and general debris.
As a result of these efforts, Collier and Michele Dunkerly met with representatives of the
Meadows Foundation in Dallas, which led to the introduction of Dr. Andy Sampson, a
notable water river conservationist in Texas. This led KSB to the application and
subsequent award of a National Park Service assistance grant in 2013. Kathryn Nichols
was appointed as the NPS facilitator, and has been working on this project since October
2012.
Collier reported that there is a diverse group of over 40 volunteers working on this
project along with 23 advisory board members and many Tarleton students.
111. PLANNING AND ZONING COMMISSION
A. PUBLIC HEARING to consider request to rezone from B-2 "Retail and Commercial
Business District' to B-5 "Restaurant—Alcoholic Beverage Service", part of Lots 32
and 36, Block 139, City Addition, located at 2115 W. Washington Street
Mayor Weldon opened a public hearing. Betty Chew, Director of Community
Development, reported that applicant is requesting this zone change to facilitate a
new restaurant at this location.
Speaking in Favor of the Re -Zoning: No one.
Speaking in Opposition of the Re -Zoning: No one.
Mayor Weldon closed the public hearing.
B. Consider Adopting Ordinance No. 2014-04 rezoning from B-2 "Retail and
Commercial Business District' to B-5 "Restaurant—Alcoholic Beverage Service",
part of Lots 32 and 36, Block 139, City Addition, located at 2115 W. Washington
Street
MOTION by Scott Evans, second by Casey Hogan, to adopt Ordinance No. 2014.04.
MOTION CARRIED by unanimous vote.
C. PUBLIC HEARING to consider adding "Restaurant with Alcoholic Beverage Service"
to the conditional uses in the DT "Downtown District' zoning classification
Mayor Weldon opened a public hearing. Betty Chew advised that the Planning and
Zoning Commission recommends approval of this change to the zoning classification.

Michelle Dunkerly, 1442 PR 1214, Stephenville, requested this change stating that
adding this additional conditional use will preserve the integrity of the Downtown
District by allowing this use within the framework of the Downtown District zoning.
She said that It will prove especially helpful to buildings large enough to have
multiple uses, including two-story structures, and will further the vibrant interaction
between retail, service, residential, government and public use contemplated by the
Zoning Ordinance for the Downtown District.

Mayor Weldon closed the public hearing.
D. Consider Adopting Ordinance No. 2014-05 Amending the Zoning Ordinance to add
"Restaurant with Alcoholic Beverage Service" to the conditional uses in the DT
"Downtown District" zoning classification
MOTION by Russ McDanel, second by Casey Hogan, to adopt Ordinance No. 2014-05.
MOTION CARRIED by unanimous vote.
IV. PERSONNEL COMMITTEE REPORT
A. Consider Approval of Contract with Wethe & Associates for Employee Benefit
Consulting Services
MOTION by Doug Svien, second by Scott Evans, to approve the Contract with Wethe
& Associates. MOTION CARRIED by unanimous vote.
B. Compensation Study
Casey Hogan explained that the compensation study takes the average survey
position pay multiplied by 105% and adjusted for the cost of living by subtracting the
4% difference in Stephenville and the survey cities cost of living index.
MOTION by Scott Evans, second by Doug Svien, to approve the pay plan and forward
it to the Finance Committee. MOTION CARRIED by unanimous vote.
V. PLANNING AND DEVELOPMENT COMMITTEE REPORT
A. Consider Approval of the 2014 Brick Street Project. MOTION by Scott Evans, second
by Brady Pendleton, to approve the 2014 brick street project, which includes East
Long, East College and Devine Streets. MOTION CARRIED.
B. Code Updates. City of Stephenville is currently under the 2006 International Codes.
The trade boards will be meeting to review the 2012 International Codes.

C. Housing Tax Credit Program. Evans advised that the committee recommends opposing
applications under this program. Mayor Weldon mentioned that in the response letter
to the Texas Department of Housing and Community Affairs, programs were
highlighted that the City of Stephenville is participating in and that the private sector is
also meeting some of our multi -family needs.
VI. FINANCE COMMITTEE REPORT—Consider Approval of Water and Sewer Rate Structure
MOTION BY Doug Svien, second by Russ McDanel, to adopt the new water rates, which
would increase the volume charge from $3.50 per 1,000 gallons to $3.65 per 1,000
gallons. MOTION CARRIED by unanimous vote.
VII. CONSENT AGENDA
MOTION by Russ McDanel, second by Doug Svien, to approve the consent agenda.

VIII. Comments by City Administrator
Mark Kaiser reported that the repair and rehabilitation of the Garfield Water Storage
Tank has begun.
IX. Comments by Council members
Casey Hogan offered condolences to the family of Barry B. Thompson, 13" president of
Tarleton State University and chancellor emeritus of the Texas A&M System. Thompson
died on March 1.

Malcolm Cross encouraged citizens to consider applying for a position on the volunteer
boards and commissions.
Doug Svien said that he has received positive statements about the traffic signal at the
intersection of 011ie, Alexander Road, and Washington.
Mayor Weldon congratulated the SHS boys' basketball team, the Tarleton Texans, and
the Tarleton TexAnns and wished them all success in the playoff games.
X. EXECUTIVE SESSION. At 6:25 p.m., Mayor Weldon recessed the open portion of the
meeting, and council went into executive session in compliance with the provisions of
the Texas Open Meetings Law, Subchapter D, Government Code, Vernon's Texas
Codes, Annotated, in accordance with Sec. 551.071 Consultation with Attorney—Frank
Reed and Mary Winona Casselman vs. The City of Stephenville, Texas, Cause No. CV -
32352, District Court of Erath County, Texas
Council reconvened in open session at 6:41 p.m.
XI. Action taken on matters discussed in executive session (if necessary)
MOTION by Doug Svien, second by Russ McDanel, to approve the contract with Garry
Lewellen, McMillan & Lewellen P.C. in connection with the Frank Reed and Mary
Winona Casselman vs. The City of Stephenville lawsuit. MOTION CARRIED by unanimous
vote.
XII. Adjourn
Mayor Weldon declared the meeting adjourned at 6:44 p.m.

ORDINANCE NO. 2014-04
AN ORDINANCE REZONING THE LAND DESCRIBED FROM THE ZONING CLASSIFICATION OF B-2
"RETAIL AND COMMERCIAL BUSINESS DISTRICT" TO B-5 "RESTAURANT — ALCOHOLIC BEVERAGE
DISTRICT".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
All that lot, tract or parcel of land being part of Lots 32 & 36, Block 139, City
Addition, known as 2115 W. Washington Street, City of Stephenville, Erath County,
Texas.
And it is hereby rezoned and the zoning classification changed from the classification of B-2
"Retail and Commercial Business District" to B-5 "Restaurant — Alcoholic Beverage District", in
accordance with the Zoning Ordinance of the City of Stephenville.
PASSED AND APPROVED this the 4th day of March, 2014.

AN ORDINANCE AMENDING SECTION 6.7 DOWNTOWN DISTRICT (DT) AS SET OUT HEREIN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
Section 6.7 Downtown District (DT) of the Zoning Ordinance of the City of Stephenville is
hereby amended as follows:
By adding the following conditional use to Section 6.7.C:
6.7.0 (4) Restaurant with Alcoholic Beverage Service;
