TUESDAY, AUGUST 19, 2014 — 5:30 P.M.
The City Council of the City of Stephenville, Texas, convened on August 19, 2014, at 5:30 p.m., in the
Council Chambers at Stephenville City Hall, 298 West Washington Street, forth purpose of Special Council
Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place
and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas
Codes Annotated, with the following members present, to wit:

Call to Order. The meeting of the Stephenville City Council was called to order at 5:30 p.m.
on Tuesday, August 19, 2014, by Mayor Weldon.
II. Public Hearing on the Budget for Fiscal Year 2014-15
Mayor Weldon opened a public hearing on the budget. City Administrator Mark Kaiser gave
an overview of the budget.
III. Consider the Time, Date and Place of a Public Hearing on the Tax Rate for 2014
MOTION by Boyd Waggoner, second by Doug Svien, to set public hearings on the tax rate
for 2014 on Tuesday, September 2, 2014, at 5:30 p.m. in the Council Chambers at City Hall,
298 West Washington, Stephenville, Texas. MOTION CARRIED by unanimous vote
IV. Consider Approving Ordinance No. 2014-18 Amending the Subdivision Regulations to
Provide for Delegate Approval Responsibility
MOTION By Russ McDanel, second by Brady Pendleton, to adopt Ordinance No. 2014-18.
MOTION CARRIED by unanimous vote.

V. Consider Approving Resolution No. 2014-08 Accepting the 2014 Brick Street Project
MOTION by Casey Hogan, second by Brady Pendleton, to approve Resolution No. 2014-08.
MOTION CARRIED by unanimous vote.
VI. EXECUTIVE SESSION. At 6:01 p.m., Mayor Weldon recessed the open portion of the
meeting, and council went into executive session in compliance with the provisions of the
Texas Open Meetings Law, Subchapter D, Government Code, Vernon's Texas Codes,
Annotated, in accordance with 551.074 Personnel Matters (a)(1) to deliberate the
appointment, employment, evaluation, reassignment, duties, discipline, ordismissal of
public officer or employee—Evaluation of City Administrator. City Administrator Mark
Kaiser and City Secretary Cindy Stafford were excused from the executive session.
Council convened in open session at 8:37 p.m.
VII. Action taken on Matters Discussed in Executive Session. No action was taken.
VIII. Adjourn
The meeting adjourned at 8:41 p.m.

ORDINANCE NO. 2014-18
AN ORDINANCE AMENDING THE SUBDIVISION REGULATIONS OF THE CITY OF STEPHENVILLE, PREVISOUSLY
ADOPTED BY ORDINANCE NO. 1991-12APPROVED BYTHE CITY COUNCIL ON JUNE 4,1991, BY APPOINTING
THE CITY ADMINISTRATOR AS THE INTERIM AUTHORITY DELEGATING APPROVAL RESPONSIBILITY FOR
REPLATS, AMENDED PLATS, AND SITE DEVELOPMENT PLANS AS AUTHORIZED IN SECTION 212 OF THE
LOCAL GOVERNMENT CODE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
Whereas, the City of Stephenville's Subdivision Ordinance and the Local Government Code provide
criteria for approval of replats, amended plats, and site development plans; and
Whereas, the City Council of the City of Stephenville has by Ordinance No. 1995-27, dated
September 5, 1995, delegated approval responsibility for replats, amended plats, and site development plans
to the Director of Community Development in accordance with the criteria established in the Subdivision
Regulations of the City of Stephenville adopted by Ordinance No. 1991-12; and
Whereas, there exists a temporary vacancy in the office of Director of Community Development, and
the City Administrator should be named as the interim authority to assume said duties until the position of
Director of Community Development has been filled.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
That the City Council of the City of Stephenville hereby delegates approval responsibility for replats,
amended plats, and site development plans as authorized in Section 212 of the Local Government Code to
the City Administrator of the City of Stephenville as long as a vacancy occurs in the position of Director of
Community Development. Once the position of Director of Community Development has been permanently
filled, the duties herein granted to the City Administrator shall revert to said Director.
PASSED AND APPROVED at a meeting of the City Council of the City of Stephenville, Texas, this 19`h
day of August, 2014.

RESOLUTION NO. 2014-08
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS, TO ACCEPT THE 2014 BRICK
STREET REPAIR PROJECT AND AUTHORIZE FINAL PAYMENT TO MSU INDUSTRIES, LLC, FINDING AND
DETERMINING THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Stephenville entered into a unit price contract with MSU INDUSTRIES, LLC
with a final estimated total cost of $69,525.00; and
WHEREAS, the actual work was completed at a total cost of $69,525.00 of which $62,572.50 has
been previously paid to the contractor, leaving an amount due of $6,952.50; and
WHEREAS, the city has received a recommendation of final payment from the Engineer of
Record and staff has observed the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS, THAT;
SECTION 1. The 2014 BRICK STREET REPAIR PROJECTS is hereby accepted, and the City
Administrator is authorized to make final payment to the contractor.
SECTION 2. It is hereby officially found and determined the meeting which this resolution was
passed was open to the public as required by law.
