HomeMy WebLinkAbout1960-12-06 - Regular City Council67 The City Council met in regular presiding and the following aldermen Chas. Riggins, Burl Lawrence, Albert and J. P. Hedrick. Others present were Water Supt. City Atty. Chandler. Minutes of previous meetings we Stephenville, Texas December 6, 1960. meeting on the above date with Mayor Evans present: Virgil Dickerson, I. D. Reynolds, Graves, Raymond Anderson, Scott D. Reed Gann, St. Supt. Collins, Chief Cornell and ?e read and approved. A group, representing the Stockers Safety Council, appeared before the Council to announce their organization had planned to place white crosses at places in the City where the most traffic accidents occur. This group asked permission to carry out this project and stated they plan to pay for all ex- pense involved. The Council agreed for this group to go ahead with their pro- ject, also expressed appreciation for their work and interest in traffic safety. Alderman Graves reported that Mr. B. B. Gilly had offered to rent the old Dump Ground on the Lingleville Road at $20.00 per month. It was moved by `''lder- man Graves, seconded by Alderman Dickerson, to rent the old Dump Ground property to B. B. Gilly on a month to month basis for $20.00 per month. Motion carried. Alderman Graves also reported a person had asked to move into the house at the Sewer Plant. It was agreed to let the Sanitary Committee handle this matter. It was moved by Alderman Graves, seconded by Alderman Riggins, to give Guy Manning one week of vacation, then the Fire Committee and Law & Order Committee get together and work out a policy for vacation of the Nightwatchman in the future. These committees to report back to the Council. Motion carried. Messrs. Hale, Richardson and Biells appeared before the Council to discuss the sewer problem on Lydia Avenue. The Council informed this group that the pro- ject is being worked out and the property owners will be notified as soon as the details are complete. Alderman Dickerson discussed the need to widen Collins Street between Belknap and Graham. This would involve considerable expense, and since there is no money set up in this budget, it was agreed to wait until later to do this work. It was moved by Alderman Lawrence, seconded by Alderman Graves, to adopt the following resolution:. RESOLUTION. RESOLVED, that the City Attorney, Joseph A. Chandler, be, and he is hereby directed to file suits in condemnation for State Highway right -of -way on land in the City of Stephenville against the following defendants relative to land owned by them as shown below; each parcel of land to be condemned being specifically described in deeds prepared by the State Highway Department from surveys made by the State Highway Department and which deeds and the descriptions resulting from said surveys are a part of the permanent records of the City of Stephenville and are in the custody at this time of the City Secretary of the City of Stephenville; said tracts of land and the owners thereof as known being as follows: Joe B. Meador and wife, Mrs. Joe B. Meador, and being Parcel No. 6, with Part 1 thereof being 1.327 acres and Part 2 thereof being 0.356 acre out of the John Blair Survey, Abstract 32, and being out of land conveyed by Roy Stafford and wife to Joe Meador and wife, recorded in Vol. 348, page 220, Deed Records of Erath County, Texas, the City having offered $1,200.00 for Part 1 and $145.00 for Part 2, and said owners having refused to accept said amounts; W. C. Parham and wife, Mrs. W. C. Parham, tract out of Lot 4 -A of Block 143, City Addition to Stephenville, having been conveyed to said owners by deed recorded , in Vol. 367, page 241, Erath County Deed Records, and containing 16,362 feet as described in State Highway description, said owners having refused to accept the sum of $1150.00 offered for said land by City of 'jtephenville;, Mrs. J. McNeill Sr., a widow, tract out of Lot 7 -A, Block 32, South Side Addition toA' t Kenville, Texas, and part of land conveyed to Mre. McNeill by deed recorded in Vol. 339, page 418, Erath County Deed Records, and stated in said Highway Department description of said land to contain 0.322 acre for which the City of Stephenville offered to Mrs. McNeill the sum of $130.00 which she has refused; Guy Manning and wife, Ruby Manning, land out of Lot 3, Block 32, South Side Addition to Stephenville, Texas, and out of land described in deed to Guy Manning recorded in Vol. 295, page 561,, Erath County Deed Records, and stated in said State Highway Department description to contain 0.314 acre for which the City of Stephenville offered to said owners the sum of $79.00 which was refused; Mrs. Ruby Manning, wife of Guy Manning, tract out of Lot 5 -A, Block 33, South Side Addition to Stephenville, Texas, said land out of which that sought to be acquired comes being recorded in deed in Vol. 337, page 209, Erath County • Deed Records, and recited in said State Highway Department description to contain 0.039 acre, for which the City of Stephenville offered said owner the sum of $10.00 I which was refused; Ruby Edna Manning, wife of Guy Manning, tract out of Lot 7, Block 33, South Side Addition to Stephenville, Texas, and being out of land conveyed to said owner by deed recorded in Vol. 337, page 209, Deed Records of Erath County, Texas, said land sought to be acquired from Mrs. Manning for highway purposes being described in State Highway Department description to be 0.621 acre and for ld ich the City of Stephenville offered Mrs. Ruby Edna Manning the sum of $155.00 which was refused by her; E. H. Burk and wife, Minnie Burk, land out of a part of Lot 24, Block 143, City Addition to Stephenville, Texas, which land is described in deed to said owners recorded in Vol. 363, page 490, Erath County Deed Records, and which land sought to be acquired for highway right -of -way is stated in State Highway Depart- ment description to contain 7,064 square feet of land, for which the City offered to said owners the sum of $369.00 which they refused; Roy Sherrill and wife, Mrs. Roy Sherrill, tract out of Lot 5, Block 320 South Side Addition to the City of Stephenville, Texas, being described in deed to Roy Sherrill recorded in Vol. 287, page 438, Erath County Deed Records, and stated in the description of theState Highway Department to contain 0.085 acre of land and for which the City of Stephenville offered said owners the sum of $21.00 which offer was refused; Clyde S. King and wife, Mrs. Clyde S. King, tract of land out of a part of Lot.8, Block 35 of the South Side Addition to Stephenville, Texas, and being out of the land described in Vol. 284, page 35, Erath County Deed Records, said land being stated in State Highway Department description thereof to contain 0.102 acre for which the City of ''tephenville offered said owners the sum of $26.00 which was refused; G. D. Fitzhugh, a single man, tract out of Lot 4 -A, Block 19, South Side Ad- dition to Stephenville, Texas, and being out of the tract of land described in deed's to said owner, recorded in Vol. 3720 page 161, Erath County Deed Records, and stated in the State Highway Department description of said land from a survey thereof to contain 0.176 acre, for which the City of Stephenville offered said owner the sum of $130.00 which was refused by said owner; Joe B. Meador tract out of John Blair Survey, Abstract 32, being out of the - land described in deed from Roy Stafford and wife to Joe B. Meador and wife, Ethel Meador, recorded in Vol. 348, page 220, Deed Records of Erath County, Texas, which land is stated in the State Highway Department description from its survey thereof to contain 0.584 acre of which 0.051 acre is in Dale Avenue at the present time and leaving 0.533 acre to be taken as new right -of -way, for which the City of Step- henville offered said owners the sum of $750.00 and which was refused by them; BE IT FURTHER RESOLVED that suits in condemnation be filed by the City Attorney on behalf of the City of Stephenville to acquire the fee simple title thereto and that the City of Stephenville by and through its City Council at its regular meet- ing held on December 6, 1960, is hereby expresuing its decision to take the fee of said lands to be condemned as provided in Article 1109b of the Revised Civil Statutes of Texas. Said motion having been put to a vote and same carried unanimously. It was moved by Alderman Lawrence, seconded by Alderman Graves, to adopt the following resolution: RESOLUTION RESOLVED, that the Mayor of the City of 6 tephenville, JS Louis Evans, be and he is hereby authorized to execute on behalf of the City of Stephenville to the State of Texas, a deed conveying to said State of Texas for the sum of $268.00, which deed shall be attested by the City Secretary, and described as follows: Being a tract or parcel of land situated in the County of Erath, State of Texas, and being out of Block 74, City Addition to the City of Stephenville, as recorded in Vol. 325, page 471, of the Deed Records of Erath County, in the John Blair Survey, Abst. 32, and a part of a tract of land conveyed by J. M. Matthews and wife, M. F. Matthews, to the City of Stephenville by deed dated May 7, 1923, and recorded in Vol. 193, page 282, conveyed by Mrs. E. C. Cox, a feme sole, to the City of Stephen- ville by deed dated July 31, 1909, and recorded in Vol. 111, page 29, of the Deed Records of Erath County, said tract or parcel of land herein conveyed being more particularly described as follows, to -wit: and 10.0 ft. southerly1and fnormal ncenterlinecsurveyostationo114e }R68e10oonoreloca- tion of U. S. Hwy. 67 & 377, said point being the southwest corner of the said City of Stephenville tract and the northeast corner of the R. E. Martin tract as conveyed by H. K. Boyd et ux to R. E. Martin by deed dated December 7, 1948, and recorded in Vol. 310, page 266, of the Deed Records of Erath County; Thence N 670 36 t W along the west line of the City of 'Stephenville tract and the East line of the Oscar H. Guerra tract, and the center of the Bosque River, a distance of 112.9 feet to a point to corner, said point being opposite and 80.00 feet northerly; and normal to centerline Survey Station 114+00.28; Thence N 590 �4t E, 692.39 feet to a point in the East line'of the City of Stephenville tract and the West line of the Mints. Hutchinson tract, said point being opposite and 80.00 ft. northerly and normal to centerline Survey Station 120 +92.67; Thence S 300 531 E Along the East line of the City of Stephenville tract and the West line of the Minta Hutchinson tract, 86.96 feet to a point in the north line of the R. E. Martin tract opposite and 6.96 feet southerly and nor - mal to centerline Survey Station 120 +93.09 on relocated U.S. Hwy. 67 & 377, said point being the southeast corner of the City of Stephenville tract and a south- west corner of Mints. Hutchinson tract;. Thence S' 590 071 W along the north line of the R. E. Martin tract and the south line of the City of Stephenville tract, 625.00 feet to the place of be- ginning and containing 1.339 acres of land, more or less, all out of said Block 74, City Addition to the City of 6tephenville, in the John Blair Survey, Abst. 32, all of which is new right -of -way hereby conveyed by this instrument. Motion for the above resolution carried unanimously. Alderman Reynolds asked the opinion of the Council on having a formal ded- ication of the City Airport. It was agreed to wait on account of the weather. :Alderman Riggins reported that other cities have passed ordinances which place a $2.00 charge when persons give checks that are returned for insufficient funds. Discussed but no action taken. Alderman Hedrick reported that Leroy Adams had complained about the No Parking signs across the highway from his business and asked that these signs be taken down. Alderman Hedrick recommended the signs be removed and if it does not work out, then place them back. Alderman Reed retorted there have been two monuments pushed over at the West End Cemetery, also some foot markers moved and stolen. The monuments will be put back up as soon as the equipment is available. Alderman Graves reported the need to place net wire at the Dump Ground in order to keep burning paper from blowing on the adjoining property. This was referred to the Sanitary Committee for handling. The Council discussed asking for bids to furnish the City with lubricating oil. It was agreed to wait until the next time bids are called to furnish gas- oline. The following bids were received for a polishing machine for the City Hall: Austin Chemical Cot Tornado, 15 inch machine, 12 H. P. Motor--------------- - - - - -- X291.15 Jones Chemical Co; Clark, F. M. 15 - -- It was moved by Alderman Dickerson, seconded by Alderman Lawrence, to purchase the Clark Polishing Machine from Jones Chemical Co. Motion carried. The following bids were received for painting the City Hall: Huey Bros ------------------------- $748.00 Red Hale -- --- -- ------- --- -- -- - - - -- 723.50 It was moved by Alderman Graves, seconded by Alderman Riggins, to award the bid for painting the City Hall to Huey Bros. for $748.00. Motion carried. The following bids were received for a new Pick -Up for the Water Department: Herrin Motor Co -------------------- $1599.43 Jones Chevrolet Co----------- - - - - -- 1597.61 It was moved by Alderman Hedrick, seconded by Alderman Reed, to accept the bid of Jones Chevrolet Co. in the amount of $1597.61. Motion carried. It was moved by Alderman Riggins, seconded by Alderman Dickerson, that bills and accounts be allowed and ordered paid. Motion carried.
