The City Council met in regular session on the above date with Mayor Evans presiding and the following aldermen present:: Virgil Dickerson, Chas. Riggins, Walter Brandon, Albert Graves., Dean Murray, Scott D. Reed and J. P. Hedrick. Present for the meeting were St. Supt. Collins, Chief Cornell and City Atty. Chandler. Minutes of previous meetings were read and approved. Mr. Arthur Hutchinson appeared before the Council to discuss the land south of the Bosque River, which land the City has agreed to buy from him. Mr. Hutchin- son stated there is a small strip of land between the 3 acres owned by the City and the Bosque River and asked that something be worked out so this would not be out off from his land. It was agreed that the City Attorney work this out. Mr. John Keith came before the Council and presented the field notes• on the land across the Bosque River from the City Park. It was moved by Alderman Dicker- son, seconded by Alderman Brandon, to pay Mr. Keith $145.00 for surveying the above mentioned land. Motion carried. It was moved by Alderman Dickerson, seconded by Alderman Brandon, to ask Mr. Hutchinson to prepare the abstract on the 37 plus acres of land and the City will pay $200.00 per acre for this land. Motion carried. Mr. George Fagan, of Homer Hunter Associates, appeared before the Council to; report that in order for the Automatic Control Cables (for the proposed water im- provement program) to be placed on the Texas Power & Light Company's poles., it would be necessary to install some additional guy wires and to install some longer poles in certain areas. It was asked that the installation of the guy wires be handled by the contractor and the installation of the longer poles be handled by Texas Power & Light Company. It was moved by Alderman Reed, seconded by Alderman Riggins, to adopt a "res- olution directing the City Secretary to publish notice to bidders for construction of Water Works Improvements and notice that the City Council intends to issue Time Warrants;, prescribing the form of notice, specifying the general prevailing rate " of per diem wages in the City of Stephenville and Erath County, and resolving other matters relating thereto. Motion carried (said resolution being attached to and becoming a part of these minutes). Mr. Taylor Allmon, of Rauscher, Pierce & Co., appeared before the Council to present a resolution approving final estimate of Douglas A. Lott on the construe tion of,Airport facilities. It was moved by Alderman Murray, seconded by Alderman Dickerson, to adopt this resolution. Motion carried (said resolution being attached to and becoming a part of these minutes). Mr. Allmon also presented a proposal for the paying off of the warrants on the Water Improvement Program. After discussion, it was asked that Mr. Allmon prepare some other proposals for the Councilts consideration. Alderman Graves reported Mr. C. A. Butler had asked for a refund on sewer line on W'. Tarleton St. It was agreed that under the circumstances Mr. Butler would be due no refund. , Alderman Graves also reported the Santa Fe Railroad work crew had driven a piling into the main sewer line west of town and the sewer lift station was flooded. The extent of damages to the pumping equipment not yet known. Alderman Dickerson reported the residents of St. Felix Avenue had asked for a street light. It was agreed to check into this. Alderman Dickerson reported the Gulf States Telephone Company had offered to pay $800000 for a lot, 150 ft. x 150 ft. of Lot 60 Block 12, Shappard & Collins. Addition. It was moved by Alderman Hedrick, seconded by Alderman Reed, to sell this lot to the Telephone Company for $800.00 if they will pay the cost of abstracts, or for 01000.00 and the City furnish abstracts. Motion carried. 40 Alderman Murray reported Kenneth Long is interested in buying a 3 acre tract of land adjoining the City Airport. After discussion, it was moved by Alderman Dickerson, seconded by Alderman Graves, to advertise for bids on certain tracts of land at the City Airport, bids to be opened at the first regular meeting of the Council in February. Motion carried. Alderman Redrick reported that Mr. Lee Orbison had asked for water to supply a swimming pool at this motel at the same rate as persons who live in the City Limits. The Council agreed that Mr. Orbison would have to pay the regular ratesi for customers outside the City Limits. e Alderman Riggins reported Mr. Carl Crimmins had completed the annual City Audit. It was moved by Alderman Riggins, seconded by Alderman Reed, to approve the 1958 -59 City Audit as prepared by Mr. Crimmins. Motion carried. Graves, seconded by Alderman Brandon, to adopt the RESOLUTION Resolved, that the Mayor of the City of Stephenville, Texas, J. Louis Evans, is hereby authorized to sign presentation to hold the Water Rights on reservoir sites on the North Bosque River and to submit same to the State Board of Water: Engineers, Box 2311, Capitol Station, Austin 11, Texas. Motion for the above was carried. It was moved by Alderman Riggins, seconded by Alderman Graves,, to pay C. Leyton Willis for his engineering services provided the Airport Committee is sat- isfied with such sergices. Motion carried. It was moved by Alderman Brandon., seconded by Alderman Graves, that bills and accounts be allowed and ordered paid. Motion carried. ADVERTISEMENT FOR BIDS Sealed proposals addressed to the Mayor and Councilmen of the City of Stephenville, Texas, will be received at the office of Mr. Rex Cates, City Secretary, until o'clock, on for furnishing and installing water system improvements. CONTRACT "A" - Pump Station Improvements and Reservoir $3,500.00 Bid Bond CONTRACT "B" - Well Collector Lines $2,000.00 Bid Bond CONTRACT "C" - Electrical and Automatic Controls $1,200.00 Bid Bond CONTRACT "D" - Water Wells $2,000.00 Bid Bond CONTRACT "E" - Deep Well Pumps $1,000.00 Bid Bond Bidders must submit with their bids a Cashiers or Certified Check in the above amounts payable without recourse to the City of Stephenville, Texas, or a Proposal Bond in the same amount, from a reliable Surety Company, as a guarantee that Bidder will enter into a contract and exe- cute bond and guarantee forms provided within five (5) days after notice of award of contract to him. Bids without check or proposal bond will not be considered. Bidders must also submit an experience record on the forms provided. In accordance with Chapter 93, Acts of the 56th Legislature, which be- came effective April 27, 1959, the successful Bidder will be required to furnish not only a performance bond in the amount of the contract, but also a payment bond in the amount of the contract, for the protec- tion of all claimants supplying labor and material as defined in said law. The bonds must be executed by an approved Surety Company holding a permit from the State of Texas to act as Surety and acceptable accord- ing to the latest list of companies holding certificates of authority from the Secretary of the Treasury of the United States, or other Surety or Sureties acceptable to the Owner. All unit prices must be stated in both script and figures. The Owner reserves the right to reject any or all bids and to waive formalities. In case of ambiguity or lack of clearness in stating the price in the bids, the Owner reserves the right to consider the most advantageous construction thereof, or to reject the bid. Unreasonable or unbalanced unit prices will be considered', sufficient cause for rejection of any bid or bids. Bidders are expected to inspect the site of the work and to inform them- selves regarding local conditions and conditions under which the work is to be done. Not less than the prevailing rate of per diem wages for work of similar character in the City of Stephenville, and County of Erath, and not less than the general prevailing rate of per diem wages for legal holidays, Saturdays, Sundays, and overtime work shall be paid to all laborers, workmen and mechanics employed', in said City and County on the above project. Hunter Associates, Consulting Engineers, 3708 Abrams Road, Dallas 14, Texas, upon the deposit of $50.00 as a guarantee of the safe return of the plans and specifications. Deposits will be returned provided: [.,Y11 or (1) All Bidders return the plans and specifications in good condition within 72 hours after the bid date; (2) All Non - Bidders return the plans and specifications in good condition 72 hours prior to bid date; (3) If the above is not complied with 50% of deposit only will be returned. No refund on the plans and specifications returned later than ten (10) days after bid opening will be obligatory. It is the intention of the City Council to issue the time warrants of the City of Stephenville for payment of a part or all of the contract to be made pursuant to this notice, and to pay part or all of the Engi- neer's fees and inspection and testing fees. The maximum amount of time warrant indebtedness to be incurred for said purposes shall be $175,000.00, the maximum rate of interest such time warrants are to bear is 5 -1/4% per annum, and the maximum maturity date thereof shall be December 31, 1984. The City has obtained a commitment from an invest- ment company for the purchase of said warrants, so that said warrants shall be delivered to the Contractor on approved estimates with the stipulation that the Contractor will immediately deliver said warrants to said investment company and receive in cash the par value therefor.
