February 3, 1959.
The City .Council net in regular session on the above date with Mayor Evans
presiding and the following aldermen present: Virgil Dickerson, Marvin Ratliff,
Chas. Riggins, Walter Brandon, Albert Graves, Van E. Allen, Scott D. Reed and
Earl Weathers.
Present,also were Water Supt. Gann and Chief Cornell.
Minutes of previous meetings were read and approved.
Alderman Graves reported Mr. Brice Stone had contacted him and wanted to just
pay for water and sewer extension to one of his lots. This was discussed and it
was moved by Alderman Ratliff -vaeonded by Alderman Dickerson, to accept Mr. Stone's
payment for water and sewer extension to one lot, if Mr. Stone would give the City
a note for the balance and make monthly payments on this note. Motion carried.
It was moved by Alderman Dickerson, seconded by Alderman Brandon, to adopt
an ordinance making it unlawful for a minor, except in course of employment, to
loiter upon the streets of Stephenville, Texas, between the hours of 11 :30 P. M.
and 5:00 A. M., and making it unlawful for any parent, or person having custody,
to permit a minor to be upon the streets within such time limits unless there
exists a necessity therefor; providing a penalty for violation of such ordinance
and declaring it an emergency. Motion carried. (Said ordinance being attached
to and becoming a part of these minutes).
Mayor Evans presented a report from several of the local ladies clubs which
contained several recommendations for traffic safety within the City. The report
was referred to the Law & Order Committee for their study.
It was moved by Alderman Reed, seconded by Alderman Brandon, that the Annual
City Election be called to be held on April 7, 1959, in accordance with Election

Ordinance on Page 86C of Minute Book F, and the State Statutes proceedure for
use of the secret ballot. The Election to be for electing one alderman from
each of the four wards of the City, to serve a two year term of office. Motion
carried. Mayor Evans appointed Mr. Homer Stephen as City Election Judge, Mr.
Stephen in turn to select his assistants.
It was moved by Alderman Dickerson, seconded by Alderman Graves, to adopt
the following Resolution:
RESOLVED, that the Mayor, J. Louis Evans, execute to R. A. Bennett and wife,
Ola Bennett, a Quitclaim Deed conveying to them that certain land described as
follows:
All that certain lot, tract or parcel of land, being the westerly part of
Lot 8, in Block 13, of the Sims Addition to the City of Stephenville, Erath County,
Texas, described as follows.
Beginning at the N. W. C. of the Southerly.15 feet of said Lot 8, at a point
16 feet N. 30 W. from the N. W. C. of the J.-G. White Lot $ in said.Sims Addition
for the S. W. C. of this;
Thence N. 30 W. with line of the
Course property out of the John Blair
the East line of the Golf Club Road;
Thence N. 1 30 W. with the Eas
feet to a railroad tie corner post at
Block 3 of the said Sims Addition, in
Survey;
Wm. Sims Survey and East line of the Golf
Survey 180 feet to a fence corner post in
t line of said Golf Club Road as fenced 88
the S. W. C. of the Jack Arthur Lot 7., in
the North line of Block 13 of said Sims
Thence Southerly 130 feet to a point 50 feet N. 60E from the.West line of
said Sims Survey;
Thence S. 30 E. running parallel to and 50 feet Easterly of the West line
of said Sims Survey to a point 15 feet Northerly of the North line of the J. G.
White Lot 5 for the S. E. Corner of this;
Thence S. 68 - 15 V;. running parallel to and 15 feet Northerly of the North
line of said White Lot 5 to the place of beginning.
Which deed shall recite a nominal consideration of .$1.00 paid. Motion for
the above resolution was carried.
It was moved by Alderman Dickerson, seconded by Alderman Ratliff, to transfer
$500.00 from the General Fund to the Park Fund. Motion carried.
It was moved by Alderman Reed, seconded by Alderman Brandon, to transfer
$1000.00 from the Sewer Maintenance Fund to the Water Works Operating Fund. This
is to pay back money that was loaned some time ago. Motion carried.
Discussed at this time was the East 2 of Block 9, Frey First Addition, which
had been bought at a Tax Sale by the City. Mr. Arnold Hale has offered to buy this
property. It was moved by Alderman Ratliff,
the following resolution: seconded by Alderman Graves, to adopt
RESOLVED, that the Mayor, J. Louis Evans, execute to Arnold E. Hale, a Quit -
claim Deed conveying to him that certain land described in Sheriff's Deed under Tax
Foreclosure, dated August 23,. 1958, and recorded in Vol. 365, Page 413, of the Deed
Records of Erath County, Texas, and being the East 2 of Block 9 in .the Frey First
Addition to Stephenville, Texas, according to the map recorded in Book 43, at page
48, in the Deed Records. of Erath County, Texas,.. for the sum of $400.00. Which deed
shall be in the form of a Quitclaim, and recite that all interest of the City of
Stephenville acquired under said Tax Deed is conveyed by the deed to the said Arnold
E. Hale; which deed shall be attested by the City Secretary. Motion carried.'
It was moved by Alderman Dickerson, seconded by Alderman Graves, that bills
and accounts be allowed and ordered paid. Motion carried.
There being no other business, the Council stood adjourned subject to the
Mayor's call.

AN ORDINANCE MAKING IT UNLAWFUL FOR A MINOR, EXCEPT IN COURSE OF EMPLOYMENT,TO
LOITER UPON STREETS OF STEPHENVILLE, TEXAS, BETWEEN THE HOURS OF 11:30 P.M.
AND 5 :00 O'CLOCK A.M.; MAKING IT UNLAWFUL FOR ANY PARENT OR PERSON HAVING
CUSTODY TO PERMIT A MINOR TO BE UPON THE STREET'S WITHIN SUCH TIME LIMIT UN-
LESS THERE EXISTS A NECESSITY THEREFOR; PROVIDING A PENALTY FOR VIOLATION OF
SUCH ORDINANCE.. AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Section One
It shall be unlawful for any child under the age of 18 years to loiter
and remain upon any of the streets of the City of Stephenville, Texas, except
when engaged in lawful employment, between the hours of 11:30 o'clock p.m. and
5:00 o'clock a.m., unless such child shall be accompanied by its parent or
guardian, or some other person having legal custody of such child.
Section Two
It shall be unlawful for any parent, guardian or other person having
legal care and custody of any child under the age of 18 years to allow or
permit any such child, while in his or her legal custody to go or loiter upox; any
of the streets in the City of Stephenville within the time and as prohibited in,
this ordinance, unless there ,exists a necessity therefor.
Section Three
Any person found guilty of violating the provisions hereof shall be
uilty of a misdemeanor and shall upon conviction be fined not less than
`55.00 nor more than $100.00.
Section Four
In the event any section, clause, sentence or paragraph or any
portion of this ordinance shall, for any reason be adjudged by any court of
competent jurisdiction to be invalid, such invalidity shall not affect, impair
or invalidate the remainder of this ordinance.
Section Five
The fact that conditions exist in the City of Stephenville requiring
that this ordinance be effective immediately, creates an emergency and ul
imperative public necessity that this ordinance go into effect immediately
from and after its passage and publication as provided by law, and any pro-
visions of the ordinances of the City of Stephenville or of the law providing
otherwise are hereby suspended.
