HomeMy WebLinkAbout1972-10-03 - Special City CouncilOctober 3, 1972 Stephenville, Texas The City Council met on the above date with Mayor Jones presiding and the following members present: Toby Stone, Garland Loudermilk, W. M. Irwin, Charles Riggins, Raymond Anderson, Larry Hammett, Jack Curtis, and Doug Smithey. Others present were: City Administrator Shelton, Director of Public Works Gann, Fire Marshall Ferguson, Director of Parks & Recreation Isham and City Attorney Chandler. Minutes of the last meeting were read. Motion was made by Councilman Irwin, seconded by Councilman Riggins, to approve minutes as read. Motion carried. Mr. Homer Hunter of Hunter & Associates came before the Council with a report on a request from Lone Star Gas Co. for a rate increase. Mr. Hunter presented the Mayor and council members with three charts and the figures on which he based his recommendation to reject the rate increase as requested by Lone Star Gas Co. Mr. Jess Johmson, representing Lone Star Gas Company, asked for these charts and figures for Lone Star Gas to study and made a reply before any final decisions were made. After some discussion, Councilman Irwin made a motion that the Council authorize permission for Mr. Hunter to negotiate with Lone Star Gas on whatever basis he deemed necessary , seconded by Councilman Loudermilk. After more discussion this motion was withdrawn and Councilman Smithey made the motion to reject the rate in- crease as requested by Lone Star Gas Company, Councilman Irwin seconded and the motion carried. Mayor Jones brought up for discussion the Sanitary Landfill Site which is located in the Oak Dale Community. Mr. Homer Hunter reported that the subsurface invest= igation had proved favorable on the core drills and tests from Texas Testing Lab. and that these report# indicate the site will be acceptable to the State. Mr. Hunter stated that he had giy#p this report to City Administrator Shelton for the City Council to study i£4qq fq desired. Mr. Carl Lunce, Attorney Scott Allen, Mr. Carl Crimmins, Mr. Bill Morgan, Mr. Bill Fanning and others spoke before the Council voicing their objections to this site for the landfill.' Mayor Jones and the Council stated they were in sympathy with r AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT TO SAID CITY, WHICH LAND JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPH- ENVILLE AND WHICH ORDINANCE DESCRIBES SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: That certain land adjacent to the City of Stephenville and specifically described as follows: All that certain 4.15 acres of land, apart of the John Blair Survey, Abst. No. 32, Erath County, Texas, and being all of that certain 5 acres of land which was excepted by Lemuel A: Brock et ux in their deed to Stephenville Land, Inc., dated April 17, 1968 and of record in Vol. 423, Page 451, in the Deed Records of Erath County, Texas, that was not annexed to the City of Stephenville, Texas, by annexation ordinance of record in Vol. 463, Page 478, said 'Deed - Records, and 'this tract described by metes and bounds as follows: BEGINNING in the East line of N. Dale Ave. at a point 25 ft. S 30 E from the NWC of the 0.85 acres described in the above mentioned ordinance, at the Northern SWC of said 0.85 acres,' for NWC of this, THENCE S 30 E 301.9 feet to the Southern NWC of said 0.85 acres; THENCE N 60 E 564 feet to an internal corner of said 0.85 acres; THENCE N 30 W 301.9 ft. to an internal corner of said 0.85 acres; THENCE S 60 W 564 feet to the place of beginning; All of that certain 7.6 acres of land, a part of the John Blair Survey, Abst. No. 32, in Erath County, Texas, and being the Northerly 1046.7 ft. of the land shown on plat made for the Schuler Estate which ' is of record ' Page in Vo1.458 age 548, in the Deed Records of Erath County, Texas, and including the North 6.5 feet of the Norma Moorhead Lot No. 7 in Block No. 139 of said City of Stephenville, and this being all of the former Schuler Estate land not previously annexed to said City of Stephenville, and BEGINNING at the present NEC of the former Schuler land in the South line of W. Frey St., at the NWC of the Groesbeeck Addition, for NEC of this; THENCE S 60 W 317.2 ft. to the NEC of the South Tanglewood Addition which was annexed to said City by ordinance of record in Vol. 463, Page 478, in the Deed Records of Erath County, Texas; THENCE S 30 E 1046.7 ft. to the SEC of said South Tanglewood Addition in North line of former Block No. 139 of said City of Stephenville as shown by King's 1956 Map of said City as adopted by ordinance of record in Vol. 381, Page 105, in said Deed Records; THENCE N 60 E 317.2 feet to the West line of the Groebeeck Addition; THENCE N 30 W 1046.7 feet to the place of beginning; is hereby received into the City Limits of Stephenville and made a part of the City of Stephenville and the City Limits of the City of Stephenville are hereby extended in accordance with the lines of the tract of land hereinabove described. The above and foregoing ordinance was introduced at the meeting of the City Council of the City of Stephenville held on the August , 1972, by Alderman Stone 1st day of it was moved by Alderman At such time Curtis and seconded by NPAMI R NMI Alderman Anderson , and being put to a vote, such motion carried to theceffect that this ordinance be published for one issue in the Stephen- ville Empire- Tribune and that by such publication notice be given in accordance with Section 5 of Article 1 of the City Charter of Stephenville Texas, that this ordinance will be finally acted upon at a.meeting of the City Council to be held at least 30 days after such publication; and any citizen of Stephenville or of the territory to be annexed, and which is hereinabove described, shall have the right to contest such annexation by filing with the City a written petition setting out their reasons for such contest and such citizen or citizens shall be given an opportunity to be heard before said ordinance in the form hereinabove set out or in a form to be amendedby this Council shall be acted upon. This proposed ordinance was duly published in the Stephenville Empire Tribune in the issue of August 9, 1972, and notice was thereby given that this ordinance would be acted upon at least 30 days "after such publication. The City Council of Stephenville met on the3rd day of October 1 , 1972, and a quorum being present:,.the City Secretary was called upon to advise the council whether any written petitions or contests of the proposed annexation had been,filed with her for presentation to the City Council. The ,City Secretary advised that no written petitions or contests of any kind had been filed and that no person had made any inquiry of her concerning the annexation. Thereupon, it was moved by Alderman Irwin. and seconded by Alderman Hammett that this ordinance be finally passed as hereinabove set out. Said motion being put to a vote it carried unan- imously. The foregoing attached notice was published in said news- one paper once each week for tW6 consecutive weeks, to wit: August 9 , 19 72 , and 19 . , The charge for publishing said notice is based on the.rate of X19.25 , which is the lowest published classified rate of said newspaper. � -4 "f L ~ Subscribed and sworn to before me this the day of Notary Public in and for C2�. ,, sue. ��GGL✓' IV the landowners in the community but at the same time stated their concern for the City in regard to the law which states that the City must have a Sanitary Landfill and meet the state requirements. After thorough discussion and it seemed the dis- cussion had reached a stalemate, Councilman Curtis made the motion to let the option, expire and concentrate on a larger tract of land toward the Dublin area, seconded by Councilman Stone. Motion did not carry by a vote of 5 to 3.. Councilman Smithey asked that the Committee be instructed to continue to look for other land. Mr. Ed Sullivan appeared before the Council presenting to the Mayor and council members a petition with approximately 450 signatures requesting the City to de- signate the property known as the Jaycee Park for a city park and to include this park in the city's budget next year for development as a city park. After some discussion, Councilman Smithey made the motion to withdraw any bid or plans to sell the property known as the Jaycee -Park, seconded by Councilman Hammett. Motion carried. Mayor Jones asked for the Council to grant him authorization to sign the papers making application to the Texas Parks and wildlife Dept. for assistance in the de- velopment of two city parks. The amount requested was $219,429.00 with a period of five years to complete the park project. Motion was.made by Councilman Curtis, seconded by Councilman Hammett, authorizing Mayor Jones to sign all papers for application for state assistance in developing two city parks. Motion carried. Motion was made by Councilman Curtis, seconded by Councilman Smithey, making Dir. `, of Parks & Recreation Isham Project Director for the development of the two city 111 parks. Motion carried. Mayor Jones reported he had received answers from four of the five cities he had written 'requesting information of the "Dog Ordinance" of their cities. Mayor ...._._ Jones turned this information over to the committee of Councilmen Loudermilk, Curtis and Hammett, with Councilman Loudermilk as chairman, for study and to re- port to the Council their findings. City Administrator Shelton reported it had been brought to his attention that in the new budget the patrolmen's salaries were some higher than the firemen's salaries. Mr. Shelton asked the Council to consider a change in the budget to take care of this. Councilman Curtis made the motion, seconded by Councilman Irwin, to in- crease the firementfs salaries from $486.00 per month to $490.00 per month. Motion carried. It was decided to reimburse the Church of God for payment of past taxes on the church property. Councilman Smithey presented a preliminary plat of the Smithey & Christian sub - division to the Council. The lay of the land presents a problem in that they need a cul -de -sac and a more narrow street than the Sub - Division Ordinance re- k quires. Councilman Smithey requested that the Council recommend to the Planning Commission use of the "Hardship Clause" in the Sub - Division Ordinance. Council- man Irwin made the motion to accept the preliminary plat as presented, subject to the approval of the Planning Commission, seconded by Councilman Curtis. Motion carried. City Attorney Chandler presented the second reading of the ordinance annexing the "�A Lem Brock property into the Stephenville city limits. Motion was made by Council- man Irwin, seconded by Councilman Hammett, to accept the ordiaance as read. Motion carried. The Chamber of Commerce had requested the city to assist in the city wide clean up program. Councilman Irwin made the motion to authorize payment up to $600.00 to assist the Chamber of Commerce in the city clean up and in removal of junk cars, seconded by Councilman Riggins. Motion carried.
