The City Council met in a called meeting on the above date with Mayor Pro -tem
Garland Loudermilk presiding. Other members present were Toby Stone, Raymond
Anderson, Doug Smithey, Jack Curtis and Charles Riggins
Others present were City Administrator Marshall Shelton and Director of Public
Works R. Y. Gann.
The purpose of this called meeting was to decide on the paving situation in
Stephenville.
Mr. Thomas Anderlitch and Mr. Claud Shelton appeared before the City Council
representing Texas Securities Corporation.
Mr. Anderlich explained that under Article 1105B of the Texas Statute, a city
has the right to levy an assessment against property owners for the paving of
the streets providing that the city pays at least 10% of the cost. If a person
has their property declared a homestead, then their signature must be given in
acceptance of this lain.
Mr. Anderlitch explained the method that Texas Securities Corp. goes into in
order to get the streets paved. They would solicit the property owners adjacent
to unpaved streets and determine who could, w ho,could not and who would not pay
for the paving. The people who were considered hardship cases would be put into
the hands of the council to collect from.
Texas Securities Corp. initial fee would be $1500.00. This is only to pay legal
fees and get everything rolling. Their payment plan is -- nothing due until it
is accepted by the City Council. Ten days later 1/5 would then be due and one
payment per year for four years. This is to be at 7516' simple interest.
Two questions were raised, these being:
(1.) Can City do its own contract work according to Article 1105B.
(2.) Does City Charter allow City to do its own contract work.
Mr. Anderlitch requested a City Charter and promised to give answers on this at
a later date.
At this point the Mayor appeared and took over the proceedings.
It is the concensus of the Council to pave all traveled streets and they decided
to put this before the Planning Commission. City Administrator Shelton is to
bring this before the Planning Commission.
It was brought before the Council that the tax roll which was presented at the
last meeting failed to be accepted. Mayor Jones made the motion to accept the
tax roll. Councilman Stone seconded the motion and it passed'.
There being no further business at this time the Council stoo adjced subject
