HomeMy WebLinkAbout1972-03-30 - Special City CouncilMarch 30, 1972 Stephenville, Texas The City Council met on the above date in a called meeting, with Mayor Skipper presiding and the following members present: Toby Stone, Doug Smithey, Mrs. Fred McCleskey, Raymond Anderson, Charles Riggins, Garland Loudermilk and W. M. Irwin. The Mayor read a letter from the Graham News, reporting the Graham Centenial. It was decided to turn this matter over to the Chamber of Commerce. Mayor Skipper also stated that he and Mr. Stone had placed Cecil Stone in the position of Acting Chief of Police. A letter of resignation is forth coming from Chief Cornell. A letter about Direct Dialin was passed around. It was decided that the City had no actual legal capacity in requesting Direct Dialing. The Mayor is tp write a letter to the Tel -ohone (7n, reauesting some ,information C -BilifIedl+ jc�.. y Councilman Smithey reporting for the Petition Committee stated the City payed $.25 cemts per name to verify these signatures. Councilman Smithey reported 1545 signatures, with 543 registered voters, 820 non - registered, 94 duplications, 74 non- residence and 14 forgeries. In conclusion Smithey stated the City wasted $386.25 because there were gross mistakes in registration. Mr. Smithey and his secretary called 100 names out of the non - registered group with the following results: 1 deceased, 12 no contact, 4 didn't know if they were registered, 15 were not registered, 68 were registered. After discussion a motion was made by Councilman Smithey to get a legal opinion from City Attorney Chandler as to what can be dose with the petition. The motion was seconded by Councilman Stone. i_ After discussion in which Councilman Riggins and Councilwoman McCleskey stated opinion as to the re- investigation of..the names on the petition by the same source that did the initial investigation. At this time the Council went into recess, so Councilman Smithey could call Mr. Chandler. At the reconvening of the Council, Councilman Smithey reported his questions: 1. Could the Council do anything and the answer of the petition could be tabled or the Council could act on it. 2. Is it a legal petition, answer, everyone has the right to petition and there are no specific number of signatures required on a petition. At this time the motion and the second were withdrawn. Councilman Smithey read both petitions. Councilman Loudermilk made a motion that the petition be returned and rechecked. Councilwoman McCleskey seconded this motion. , Motion carried. Councilman Stone reported he could not accept the report as fact even after it is re- checked. It was moved by Councilman Smithey and seconded by Councilman Stone to replace Administrator Cates in compliance with the petition. Motion failed to carry. Mr. Dave Montgomery requested that Hillcrest,be paid the balance of money owed to them on the lift station. It was moved by Councilman Loudermilk and seconded by Councilman Smithey to pay Hill - crest the $2,000. owed by the City upon acceptance of said lift station. Motion carried. There being no other business at this time the Council stood adjourned, subject to the Mayor's call. Mayor ATTEST: City Secretary
