HomeMy WebLinkAbout1973-11-30 - Special City Council124A Stephenville, Texas November 30, 1973 The City Council met in a called meeting on the above date with Mayor Donald R. Jones presiding and the following members present: Jim Chambers, Jack Curtis Roy McCoy, Charles Riggins, Jess Sexton, Larry Hammett and Toby Stone. Others present were: City Administrator Shelton, Director of Public Works Gann, Director of Parks & Recreation Isham, and City Inspector Lookingbill. Mr,. Virgil Morgan presented the Mayor and Council Members with a copy of the City audit for 1972 -3. Mr. Morgan answered some questions concerning his recommendations which, he said, were minor changes in the bookeeping system. Mayor Jones asked the Council to study the audit and he would ask for approval at the next regular meeting. Mr. Bryon Singleton, Manager of Texas Power & Light Co., came before the Council asking for a rate increase. Mr. Singleton stated that he was asking for an average increase of 10%. The less power used the smaller the increase. Mayor Jones asked the Council to refer to their copies of a letter from Hunter and Assoc. concerning the rate increase. Mayor Jones asked the Council to study this and it would be discussed again at the next regular meeting. Mr. Calvin McGee, Chairman of the Plumbing Board, came before the Council to report that the Plumbing Board recommends adopting the Texas Municipal League Plumbing Code, with some minor changes. Mr. McGee reported that the Plumbing Board had met, with most of the local plumbers attending, and it was the unanimousl decision that the above code was needed. After quite a bit of discussion, it was the consensus of the Council to study before making any decision. Parks and Recreation Director Isham. came before the Council to present the bids received for the windscreens for the new tennis courts at the City Park. Motion carried. Mayor Jones brought up the question of Christmas lights on the square. Mr. Shelton reported that the merchants of the downtown area had decided not to put up the Christmas lights in order to conserve energy. The Mayor appointed a committee of Councilmen Curtis, Chairman, Sexton and Riggins to make a survey to determine What ways the City can conserve on energy and report bact to the Council. Mayor Jones reported that he had received a letter from Mrs. Latham Howell re- questing a warning signal be placed at the Frey St. crossing of the Santa Fe rail- road. Mr. Shleton reported that he had written a letter to Santa Fe concerning warning signals. Mayor Jones asked the Council to study their copies of excerpts from the Minute Books concerning the Water & Sewer line extensions and they will go over them at a later date. Mayor Jones reported he had received a letter from the Texas Municipal League con- cerning the Girl Scout's house. The letter stated that legally the City could not let the Girl Scouts put a house on City owned property. The letter also stated that a lot of cities do this when there are no objections. The Mayor asked the committee to study this again in the light of the above mentinned letter and report back to the Council. Councilman Hammett asked about the status of the wrecked police car. City Admini- strator Shelton reported that they had taken estimates and were having the car re- paired. Councilman Stone asked about the status of utilities at the new high school property. Mr. Gann stated there was no water and sewer available at this time. Councilman Curtis stated that he had received a letter concerning the firing of Don Parrack and the resignation of Roy Don Parrack of the Police Dept. City Admini- strator Shelton reported that he had talked with Chief Watkins about this and said Chief Watkins had not stated any specific thing but had said it was a combination f r .e j of things that had brought the situation about. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: Section One That ordinance passed by the City Council of Stephenville relating to Airport Advisory Board for such City, on May 6, 1969 and recorded in Volume I Page 150A of the minutes of the City Council is hereby repealed. Section Two There is hereby created the Airport Advisory Board of the City of Stephenville, to be composed of 8 members. All members shall be resident citizens of the City of Stephenville, Texas, and shall be appointed for two -year terms, and until their successors are appointed and qualified. Members of the Airport Advisory Board shall be appointed by the Mayor, with the advice and consent of the City Council. Appointments to the Advisory Board shall be made immediately by the Mayor. Section Three The Airport Advisory Board shall select from among its members a chairman and a vice chairman, and it shall adopt, subject to the approval of the City Council, such rules and regulations governing its proceedings as it may deem proper. Such rules and regulations shall not be inconsis- tent with the ordinances of the City. The Advisory Board shall appoint a secretary, who may, but need not be, a member of the Board. The Secretary shall keep a record of all transactions of the Board. The manager of the airport shall provide the Advisory Board with all information necessary for the performance of its duties. Section Four The Airport Advisory Board shall from time to time make such general studies of airport construction and operation as may be useful in keeping the municipal airport efficient and adequate to the needs of the City and of the air transportation industry; it shall make recommenda- tions to the City Council in respect to construction, expansion, improve- ments, maintenance, and operation of such airport. It shall call the manager's attention to any failure by personnel of the airport to carry out any orders or policies adopted by the City Council; and it shall, acting in an advisory capacity, work toward the general improvement of the airport and the advancement of the City as an air transportation center. Section Five No person having any financial interest in any commercial carrier by air, or in any concession, right or privilege to conduct any business or render any service for compensation upon the premises of the municipal airport shall be eligible for membership on the Airport Advisory Board. Section Six All members of the Airport Advisory Board shall serve without compen- sation, but may be reimbursed for all expenses reasonably incurred by them in the performance of their duties as members of such Board, when authorized by the City Council. Light Company and the City f: of Stephenville , increasing the amount of street rentals paid by Texas Power & Light Company to the City of Stephenville to three per cent (3 %) of its annual gross electric revenues be„ and the same is hereby, approved. Mayor ATTEST; J ity ecretary s_ R E S O L U T I O N A WHEREAS, certain areas of Stephenville are subject to periodic flooding from rivers, causing serious damages to properties within these areas; and WHEREAS, relief is available in the form of Federally subsidized flood insurance as authorized by the National Flood Insurance Act of 1968; and WHEREAS, it is the intent of this Council to require the recognition and evaluation of flood hazards in all official actions relating to land use in the flood plain areas having special flood hazards; and WHEREAS, this body has the legal authority to adopt land use and control measures to reduce future flood losses pursuant to Article 974a. of Texas Revised Civil Statutes and the Stephenville Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED, that this Council hereby: 1. Assures the Federal Insurance Administration that it will enact as necessary, and maintain in force for those areas having flood or mudslide hazards, adequate land use and control measures with effective enforcement provisions consistent with the Criteria set forth in Section 1910 of the National Flood Insurance Program Regulations;,and 2. Vests The Building Inspector with the responsibility, authority, and means to: (a) Delineate or assist the Administrator, at his request, in delineating the limits of the areas haveing special flood hazards on available local maps of sufficient scale to identify the location of building sites. (b) Provide such information as the Administrator may re- quest concerning present uses and occupancy of the flood plain. (c) Cooperate with Federal, State, and local agencies and private firms which undertake to study, survey, map, and identify flood plain or mudslide areas, and cooperate with neighboring communities with respect to management of adjoining flood plain and /or mudslide areas in order to prevent aggravation of existing hazards. (d) Submit on the anniversary date of the communityes initial eligibility an annual report to the Administrator on the progress made during the past year within the community in the development and imple- mentation of flood plain management measures. 3. Appoints The Building Inspector to maintain for public inspect- ion and to furnish upon request a record of elevations (in relation to mean sea level) of the lowest floor (including basement) of all new or substantially improved structures located in the special flood hazard areas. If the lowest floor is below grade on one or more sides, the elevation of the floor immediately above must also be recorded. 4. Agrees to take such other official action as may be reasonably,; - necessary to carry out the objectives of the program. RESOLUTION B -I WHEREAS, the City of Stephenville has adopted and is enforcing the Uniform Building Code, Local Zoning Ordinance, and WHEREAS, Section 103 of the Uniform Building Code of the aforesaid prohibits any person, firm or corporation from erecting, constructing, enlarging, altering, repairing, improving, moving or demolishing any building or structure without first obtaining a separate building permit for each building or structure from the Building Inspector. WHEREAS, the Building Inspector must examine all plans and speci- fications for the proposed construction when applicatinn is made to him for a building permit. NOW, THEREFORE, BE IT RESOLVED by the Stephenville City Council of Stephenville, Texas, as follows: 1. That the Building Inspector shall review all building permit applications for new construction or substantial improvements to deter- mine whether proposed building sites will be reasonably safe from flood- ing. If a proposed building site is in a location that has a flood hazard, any proposed new construction or substantial improvement (including pre- fabricated and mobile homes) must (i) be designed (or modified) and an- chored to prevent flotation, collapse, or lateral movement of the structure (ii) use construction materials and utility equipment that are resistant to flood damage, and (iii) use construction methods and practices that will minimize flood damage; and 2. That the Public Works Director shall review subdivision pro- posals and other proposed new developments to assure that (i) all such proposals are consistent with the need to minimize flood damage, (ii) all public utilities and facilities, such as sewer, gas, electrical, and water systems are located, elevated, and constructed to minimize or eliminate flood damage, and (iii) adequate drainage is provided so as to reduce exposure to flood hazards; and 3. That the Public Works Director shall require new or replacement water supply systems and /or sanitary sewage systems to be designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems into flood waters, and require on -site waste disposal systems to be located so as to avoid impairment of them or con- tamination from then during flooding. (� ,.cep M gCiot Secre ary Date Passed December 4, 1973 ORDINANCE N0, An Ordinance approving certain Rate Schedules filed by Texas Power & Light Company in the City of Stephenville , Texas, and providing conditions under which such Rate Schedules may be changed, modified, amended or withdrawn: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE , TEXAS: SECTION 1: That Texas Power & Light Company, having filed on the 12th day of November , 19 73 , its Rate Book No. W- 74 -11, containing a set of electric Rate Schedules and the Service Regulations referred to therein, with the City Secretary, the same are hereby approved as Schedules of Rates and Service Regulations under which said Company is authorized to collect charges from its customers for the sale of electric power and energy within the corporate limits of the City until such time as said Rate Schedules and Service Regulations may be changed, modified, amended or withdrawn, with the approval of the City Council, SECTION 2: The filing of the Rate Schedules and Service Regulations, and the approval of same by the City Council, in the manner herein provided, shall constitute notice to the con- sumers of electricity, within the City, of the availability and application of such Rate Schedules and Service Regulations, SECTION 3: Such Rate Schedules and Service Regulations, shall become effective and shall be in full force and effective March 1, 1974 and shall apply to all bills rendered after February 28, 1974, PASSED AND APPROVED at a Regular meeting of the City Council of Stephenville Texas, this the 4th day of December 19 73 .
