Jones presiding and the following members present: Toby Stone, W. M. Irwin, Larry Hammett, Raymond Anderson, Charles Riggins, Doug Smithey, and Garland Loudermilk, Others present were: City Administrator Shelton, Director of Public Works and City Attorney Chandler. `,.... The purpose of the meeting was to discuss the proposed franchise to Billy R. Bledsoe for garbage collection and disposal." Mr. Bledsoe was present along with his attorney Mr. Donald F. McNiel,II. The discussion included defining the term garbage, trash and refuse as used in paragraph two, the changing of the wording in paragraphs four an five. The Council and Mr. Bledsoe agreed to increase the liability insurance from $10,000.00, - $20,000.00 - $5,000.00 - to $100,000.00 - $300,000.00 - $10,000.00 - if the rates for this additional insurance were not prohibitive. The wording in paragraphs ten and eleven was';also changed by deletions in paragraph ten and addition in paragraph eleven, also in paragraph eleven the "commercial, industrial, or other accounts, was defined more clearly. It was also decided to leave out paragraph twenty. After much discussion, Councilman Irwin moved to accept the franchise with the above changes. Councilman Hammett made the second. Motion carried. Mr. Douglas Eubanks appeared before the Council with a complaint of -blow- ing paper at the landfill site. Mayor Jones said this would be corrected. Mr. Eubanks also asked that the City amend their application to the State to include a buffer zone around the Landfill. The Mayor brought up for consideration the removal of the restrictions on the golf course. There was some discussion on this and the Mayor asked that the Council give this some thought and it will be discussed more at the regular Council meeting on Tuesday night. Meeting adjourned. TT ST: ���j City Secretary 435 ADMINISTRATOR ORDINANCE AN ORDINANCE CREATING THE OFFICE OF ADMINISTRATOR FOR THE CITY OF STEPHEN- VILLE, TEXAS, AND PRESCRIBING HIS. POWERS AND DUTIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS; Section 1. Appointment and Qualifications: The City Council shall appoint an Administrator of the City who shall be responsible to the City Council for the administration of all the affairs of the City. He shall be chosen by the Council solely on the basis of his administrative training, experience and ability. He may or may not be a resident of the City of Stephenville when appointed, but shall reside within the corporate limits of the City during his tenure in office. No member of the City Council shall, during the time for which he is elected and for one year thereafter, be appointed City Administrator. Section 2. Term and Salary: The City Administrator shall not be appointed for a definite term but may be removed at the will and pleasure of the City Council by a vote of a majority of the entire City Council. The action of the City Council in suspending or removing the City Administrator shall be final. In case of the absence or disability of the City Administrator, the City Council may designate some qualified person to perform the duties of the office during such absence or disability. The City Administrator shall receive compen- sation as may be fixed by the Council Section 3. Power and Duties of the City Administrator: A. The City Administrator shall be responsible to the City Council for the efficient administration of the City Government. He shall have the authority to appoint and remove all Department Heads. He shall have the authority to appoint and remove all other city employees. He may authorize the head of a department to appoint and remove subordinates in his respec- tive department. It shall be unlawful for the City Council or any of its members to attempt to dictate the appointment of any person to office or employment by the City Administrator. Except for the purpose of inquiry, the Council and its members shall deal IM with the administrative service solely through the City Administrator, and neither the Council nor any member thereof, shall give orders to any of the subordinates of the City Administrator, either publicly or privately. B. Prepare, or cause to be prepared, the annual budget and be responsible for its administration after it is adopted by the City Council. C. Keep the City Council informed on the Finances and activities of the City. D. Attend all meetings of the Council with the right to take part in the discussion but having no vote. E. To recommend to the Council for adoption such measures as he may deem necessary or expedient. F. To see that all terms and conditions imposed in favor of the City of Stephenville, its inhabitants in any public utility franchise are faith- fully kept and performed and upon knowledge of any violation thereof to call the same to the attention of the governing body. G. To see that all laws and ordinances are enforced. H. To perform such other duties as may be prescribed by ordinance or resolution by the City Council. I. To make a full written report to the governing body as soon after the close of each month's accounts as possible, showing the operation and expenditures of each department for the preceding month, and a comparison of such monthly expenditures, by departments, with the monthly allowances made for such departments in the annual budget, and to keep the governing body fully advised at all times as to the financial condition and needs of the city. J. To act as, or appoint, a purchasing agent for the City of Stephenville and to purchase all merchandise, material and supplies needed by the City and may establish, if needed,, a suitable storehouse where such supplies, shall be kept and from,which same shall be issued as needed; and to adopt such rules and regulations governing requisitions and transactions of business between himself as such purchasing agent and the heads' of the de- partments, officers and employees of the City as the governing body may approve. I It shall be the duty of the purchasing agent to give opportunity for compe- tition on purchases and sales, except when the nature of the purchase or sale is such that competition is impossible or impracticable. All purchases in excess of $500.00, except of real estate, or rights or easements therein, shall be by contract to the lowest responsible bidder and all sales in excess of $950.00 except of real estate or rights or easements therein, shall be made to the highest bidder after public notice and the receipt of sealed bids, unless the governing body by ordinance, determines that it is impos- sible or impracticable to purchase or sell in such manner. All sealed bids received shall be opened in public and thereafter shall be subject to public inspection. The purchasing agent may reject all bids and readvertise for new bids. The purchasing agent may require successful bidders to furnish secu- rity conditioned upon the faithful performance of their contract or condi- tioned upon the payment of the wages and compensation of all laborers employed on work for which a contract is made by the contractor, subcontractor, agent or any other person, or condition for both. The purchasing agent shall not let any contract for periods exceeding one year for street lighting,, public improvements, labor or supplies. In case of accident or other circumstances creating an emergency, the Administrator may, with the consent of the governing body, award contracts and make purchases for the purpose of repairing damages caused by said accident or avoiding said public emergency; but immediately afterwards, he shall file with the Mayor a certificate showing such emergency and the necessity of such action together with an itemized acount of all expenditures. K. To recommend to the governing body the salaries to be paid each appointive officer and subordinate employee of the City; and it shall be the duty of the governing body to pass ordinances or resolutions, from time to time, fixing rates of compensation. L. To recommend to the governing body, in writing, from time to time, for adoption, such measures as he may deem necessary or expendient. Section 4. Bond of Administrator: The City Administrator shall furnish such surety bond as may be required s 437 I by the City Council by ordinance, the premium to be paid by the City. Section 5. Civil Defense: The City Administrator shall act as Civil Defense Coordinator for the City of Stephenville and will keep the City Council advised in Civil Defense matters. To make recommendations to the City Council for expenditures and grant applications in the area of Civil Defense. Section 6. Previous Ordinances: All ordinances of the City prescribing the duties of Department Heads shall remain in full force and effect except insofar as they conflict with the provisions of this ordinance in which case the provisions of this ordinance shall govern.
