SEPTEMBER 2, 1975 CITY COUNCIL CHAMBERS CITY HALL, CITY OF STEPHENVILLE, TEXAS The City Council met in Regular Session Tuesday, September 2, 1975 at 7 :00 P.M. with Mayor Pro -Tem James T. Chambers presiding in the absence of Mayor Donald R. Jones. Councilmen Jesse Sexton, Larry Hammett, Neal Guthrie, W. M. Irwin, Raymond Anderson and Charles Riggins were present. Councilman Guthrie moved, seconded by Councilman Irwin, to approve the minutEs of the August 5th Regualr Session, August 18th Special Session and August 21st Special Session as written. Motion carried unanimously. Mayor Pro -Tem Chambers explained that the committee that was to study the re- quest of Texas Power & Light Co. for a rate increase is still working with Texas Power & Light and are waiting for more figures and have requested this agenda item be tabled until a future meeting. Mr. Gerald Cook, manager of the Chamber of Commerce, gave a report of the Chamber's activities and a financial report on Hotel -Motel Occupancy Tax contract between the City and the Chamber of Commerce. After some discussion of the closing of a portion of North Columbia St. between Minnie and Frey Streets, Mayor Pro -Tem Chambers appointed the Street Committee, consisting of Councilmen Guthrie, chairman, Sexton and Hammett, to make a further study of this and make their recommendation at the next meeting. The Depository Bids of The Stephenville Bank & Trust Co. and The Farmer's First National Bank, both of Stephenville, were opened and discussed. City Administrator Shelton appointed a committee of Councilmen Hammett and Guthrie to study these bids with him and make their recommendation at the next special meeting. Councilman Sexton moved, seconded by Councilman Hammett, to approve the Position Classification and Pay Plan for city employees. Motion carried unanimously. Discussion on this had been held at previous meetings and the council members had made a detailed study prior to this meeting. Councilman Irwin moved, seconded by Councilman Sexton, to adopt the ordinance approving the budget and the ordinance approving the tax rate for the fiscal year October 1, 1975 to September 30, 1976. Motion carried unanimously. ORDINANCE APPROVING THE BUDGET SUBMITTED BY THE CITY ADMINISTRATOR OF THE CITY OF STEPHENVILLE FOR THE FISCAL YEAR OCTOBER 1st, 1975 to SEPTEMBER 30th, 1976. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: ORDINANCE I LEVYING ADVALOREM TAXES ON BOTH REAL AND PERSONAL PROPERTY IN THE CITY OF STEPHENVILLE FOR THE YEAR 1975; PROVIDING FOR OCCUPATION TAXES ON EVERY PERSON, FIRM OR CORPORATION PURSUING ANY OCCUPATION, PROFESSION OR BUSINESS IN THE CITY OF STEPHENVILLE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Mayor Pro -Tem Chambers and the council commended City Administrator Shelton for his efforts in holding the tax rate to the same figures as last year and for his management of the city budget. Mayor Pro -Tem Chambers explained that, due to Mayor Jones' request to be present for the discussion of the charter revision recommendations, he would delete that item from the agenda. After some discussion, Councilman Anderson moved, seconded by Councilman Riggins, to hold a Special Election on November 4, 1975, to fill council seat, place 4, vacated by Roy McCoy. Motion carried unanimously. After some discussion, Councilman Sexton moved, seconded by Councilman Hammett, to reject the offer of Mr. Doug Smithey regarding a proposed long -term lease agreement of approximately 13 acres of West End Cemetery property. Motion carried unanimously. The following persons came before the council voicing their opposition to the one - way streets: Chuck Gildner, Mrs. T. R. Moore, A. A. Schrimsher, J. H. Perry, Opal Belcher, Mrs. Jones, Jim Musgrove, E. E. Moser and Earl Weathers. There were approximately 60 others in the audience protesting the one -way streets. Mayor Pro -Tem Chambers assured them that the council will take these comments into consideration and will give their decision at a later date. M Mayor Pro -Tem Chambers announced that the council would go into closed executive �! session on pending litigation. (8;00 p.m.) Mayor Jones arrived at approximately 8;15. i At 9:10 p.m. it was announced that the council was back in open session with Mayor Donald R. Jones presiding. Councilman Irwin moved, seconded by Councilman Sexton, to retain legal council to represent our police officers who have been allegedly charged with false arrest. Motion carried unanimously.
